Short answer: A prompt by itself does not give you a U.S. copyright in an AI-generated game asset. Copyright can cover human-authored expression in the asset or in the larger game—such as original sketches, paintovers, edits, arrangements, writing, animation, sound design, or the way assets are combined—but purely machine-determined output may remain outside copyright protection. Separately, the AI tool’s contract or model license controls whether you may use, sell, modify, sublicense, redistribute, or credit that output. Treat copyrightability and contractual permission as two different questions before shipping.
Copyright and permission are separate tests

Copyrightability: what human expression is protected?
Under 17 U.S.C. §102, copyright protects original works of authorship fixed in a tangible medium, including pictorial, graphic, sculptural, audiovisual, and sound works. It does not protect an idea, procedure, process, system, method of operation, concept, principle, or discovery. For a game, an original character illustration, musical composition, dialogue recording, animation, or recorded audiovisual presentation can contain protectable expression when a human author created it and it is fixed in a file or other medium. Rules of play and game mechanics are treated differently from the expressive artwork or code used to implement them.

The U.S. Copyright Office’s Part 2 report, released January 29, 2025, states that generative-AI output can be protected when a human determines sufficient expressive elements. A human-authored work that is perceptible in the output, or a creative selection, coordination, arrangement, or modification of generated material, may qualify. The report also says that “the mere provision of prompts” is insufficient by itself. In practical terms, describing a scene and accepting the returned pixels does not automatically make you the copyright author of every expressive detail in those pixels.

Contractual permission: what the provider lets you do
Even if an output has little or no copyright protection, a provider’s terms, model license, marketplace agreement, or contributor contract can still impose obligations. Those terms may address commercial use, attribution, sublicensing, redistribution, indemnity, prohibited uses, training, data retention, or dispute resolution. Conversely, a contract may grant broad commercial rights while copyright law still protects only the human-authored parts of the result.
Do not infer ownership from marketing language such as “you own your creations.” Save the exact terms in force when each asset was generated or downloaded. Terms can change, and a later version is not reliable evidence of what applied to an earlier release.
What parts of a game asset can you protect?
Pure machine output
If the system determines the expressive details and you make no meaningful creative contribution beyond prompts, the resulting image, texture, model, music track, or voice performance may not receive U.S. copyright protection as your authored work. You can still have contractual permission to use it, and you can still own your project files or a copy of the output, but those facts are not the same as holding an exclusive copyright.
Human-authored source material
Original sketches, concept drawings, photographs, hand-written dialogue, musical motifs, recorded performances, and other human-created material can remain protectable when incorporated into an AI-assisted asset. Keep the source files and dates so you can identify what expression came from a person rather than the model.

Edits, paintovers, compositing, and arrangements
Substantial human editing can create copyright in the new human-authored expression while leaving unprotected machine-generated portions outside the claim. Examples include repainting anatomy and lighting, redrawing a face, sculpting and retopologizing a mesh, creating a hand-authored texture pass, compositing several elements into a new scene, or designing a distinctive collection and arrangement of generated assets. The protection generally follows the original choices you made, not every underlying pixel or polygon produced by the system.
Animation, writing, and sound design
Keyframes, timing, camera choreography, dialogue, lyrics, orchestration, Foley, mixing, and interactive implementation can contain independent human authorship. A game may therefore contain protectable human expression even when some concept art or raw textures began as generated material. AI assistance or inclusion of generated material in a larger human-generated work does not by itself prevent copyright in the human-authored work.
Can you sell a game that uses AI-generated assets?
Usually, the practical answer depends on the chain of contracts and the human contributions, not on a blanket “AI is allowed” rule. Before release, verify that every asset can be used in the planned channels: paid downloads, consoles, mobile stores, advertising, trailers, livestreams, localization, ports, downloadable content, and sublicensed publishing.

Check these rights in the applicable terms
- Commercial-use permission: confirm that revenue-generating games, advertisements, and promotional screenshots are permitted, including under the plan or model tier you used.
- Output ownership or license scope: determine whether the provider assigns rights, grants a license, or makes no promise about exclusivity or copyright.
- Attribution: record whether a credit, notice, link, or model acknowledgment is required in the game, store listing, documentation, or marketing.
- Sublicensing and redistribution: make sure you can include the asset inside an executable, downloadable content pack, soundtrack, or mod kit without giving players rights the contract forbids.
- Indemnity and infringement procedures: see whether the provider offers any defense or reimbursement, what exclusions apply, and who controls a claim. Never assume an indemnity exists.
- Training and opt-out clauses: understand whether your prompts, uploads, or outputs may be retained or used to improve a service, and whether an opt-out is available.
- Termination and change terms: check what happens if an account closes, a plan changes, or the provider updates its license.
- Governing law and venue: note which jurisdiction controls a dispute and whether the contract limits class actions or remedies.
A production workflow that preserves rights and evidence
Use an asset ledger from the first prototype. A publisher, platform, or investor may ask how an asset was made years after the original generation date.

- Identify the source. Record the generator or model name, exact version, account or plan, generation date, prompt, negative prompt, seed, settings, uploaded source images, and output filename.
- Archive the terms. Save a dated copy or PDF of the tool’s terms of service, model license, marketplace license, and any enterprise agreement that applied at creation. Keep a hash or other change-detection record when practical.
- Preserve the complete edit history. Store raw outputs separately from sketches, paintovers, masks, 3D sculpt files, retopology, rigging, animation, writing, compositing, and sound-design sessions. Layered files and version-control history help demonstrate human choices.
- Describe the human contribution. For each shipped asset, note which portions were drawn, modeled, written, performed, arranged, edited, or selected by people. This description can support registration, a chain-of-title schedule, or a response to a rights inquiry.
- Run a similarity and clearance review. Screen for recognizable third-party characters, logos, copyrighted compositions, distinctive voices or faces, and close imitation of a living artist’s style. Flag uncertain assets for replacement or legal advice.
- Verify release rights. Check commercial use, attribution, sublicensing, redistribution, indemnity, and training provisions against the actual distribution plan, including trailers and social media clips.
- Maintain credits and approvals. Keep contributor agreements, model releases, music licenses, and required notices with the ledger. Make the in-game credits match contractual requirements.
- Obtain jurisdiction-specific advice. For a high-profile release, unusual likeness, trademark, music, or voice issue, ask counsel in each material distribution jurisdiction before launch.
Comparing asset sources for a game pipeline
No source category automatically provides the rights a commercial game needs. Compare each candidate using the same questions.

The Copyright Office has noted that open-source or downloadable models can restrict use through license terms; its notice gives the Llama 2 Community License as an example that requires attribution and includes a service-size exclusion. “Open source” therefore does not mean “no conditions.” Read the license for the particular model and version you actually used.
Do you have to disclose AI use?
There is no single U.S. copyright rule that universally requires a game developer to label every AI-assisted asset. Disclosure can nevertheless arise from a tool contract, a store or platform policy, a grant or contest rule, a publisher agreement, consumer-protection law, or a specific voice, likeness, or union arrangement. Check those obligations for the territories and platforms where you will release.

Do not claim that a tool, model, or platform has approved your use unless you have that approval in writing.

Risks that remain unsettled
The Copyright Office’s January 2025 notice identifies open questions involving substantial similarity, proof of copying, who may be liable for infringing outputs, labeling or identification, style imitation, and rights in names and likenesses. These issues are fact-specific and can change through legislation, agency guidance, and litigation.
The Office’s AI page describes Part 3 as addressing training on copyrighted works, licensing considerations, and allocation of liability; it identifies a pre-publication version released May 9, 2025. That work does not turn unsettled policy questions into universal operating rules for a shipped game.
Similarity and style
An output can create risk even when the prompt did not name a copyrighted character or artist. Compare the result against known franchises, logos, distinctive compositions, and a living artist’s signature style. Replace close imitations, retain your review record, and obtain advice when the resemblance is central to the asset.

Copyright is not the only relevant right. A recognizable person’s face or voice, a performer’s contract, a trademarked name, or a publicity right may require consent even when the generated file has uncertain copyright status. Treat these as separate clearance questions.
What ownership language should your team use?
Use precise internal labels instead of a single “owned” checkbox. A ledger can classify an asset as: human-authored and copyright-claimed; AI-assisted with identified human edits; licensed machine output with no exclusivity promise; third-party material under a marketplace license; or rejected pending clearance. Link each classification to the source files, terms version, contributor agreement, and approval date.
For registrations or investor diligence, describe the human-authored portions rather than claiming authorship of every generated element. For contracts with artists and contractors, state who owns source files, edited versions, derivatives, DLC, ports, marketing materials, and unused work. Require contributors to disclose generated or third-party material and to deliver the applicable licenses.
How U.S. rules fit an international release
This explanation uses U.S. law as its baseline. Other countries may apply different authorship standards, moral-rights rules, database protections, text-and-data-mining exceptions, or treatment of machine-generated works. A U.S. copyright analysis does not guarantee protection or freedom to use an asset in another territory. Map the countries, storefronts, and publishing partners that matter to your release and obtain local advice for unusual or high-value assets.

- Can you identify human expression? If not, do not represent the raw output as exclusively copyrighted by your studio.
- Do the applicable terms permit the planned use? Confirm commercial release, advertising, embedding, sublicensing, and redistribution.
- Is provenance complete? Require prompts, versions, dates, source material, edit history, and approvals in the ledger.
- Did clearance find a recognizable third party? Resolve characters, logos, music, faces, voices, and close style imitation before launch.
- Are disclosure and credit obligations satisfied? Apply contract, platform, publisher, grant, and territory-specific requirements.
- Can you explain the result to a platform or claimant? Keep a concise rights summary and the underlying records ready for audit.
The Copyright Office summarized the principle this way: “Where that creativity is expressed through the use of AI systems, it continues to enjoy protection.” That protection follows the human creativity expressed in the work; it is not a blanket ownership grant for whatever a model produces.
