AI-Generated Athlete Endorsements vs. Licensed Sports Advertising: What Brands Need to Know

An AI-generated athlete ad is not automatically legal, authorized, or deceptive. In the United States, a brand must clear two separate questions before publishing: does it have permission to use every recognizable athlete identity attribute and organizational mark in the creative, and is the resulting advertising truthful, substantiated, and transparent about material connections? Artificial generation answers neither question.

The Federal Trade Commission (FTC) says endorsements must be truthful and not misleading across media. The U.S. Patent and Trademark Office (USPTO) explains that name, image, voice, catchphrase, and signature moves can fall within name, image, and likeness (NIL) rights that generally arise under varying state laws. A synthetic voice, face, or motion therefore needs the same disciplined clearance as a filmed campaign, with additional contract language for digital replicas.

The short answer: AI changes production, not the permission standard

A brand cannot avoid an athlete’s rights merely by generating a realistic avatar instead of hiring the athlete for a shoot. If viewers can identify a real athlete, the campaign should be treated as a potential use of that person’s NIL. Permission should cover the specific attributes used—such as the athlete’s name, face, voice, nickname, catchphrase, or signature move—and the way a model will generate, alter, store, distribute, and reuse them.

At the same time, an approved likeness does not make the message lawful. The FTC’s Endorsement Guides, revised in June 2023, state that endorsements must be truthful and not misleading. An apparent athlete testimonial can imply that the athlete used, tested, prefers, or experienced a product. Those implications need evidence. The FTC describes the Guides as guidance rather than regulations, but says it may investigate unfair or deceptive practices under the FTC Act. Read the agency’s overview at FTC Advertisement Endorsements.

Think of clearance as two gates:

  • Rights gate: Every person, mark, recording, and synthetic attribute shown or heard is authorized for the campaign’s media, territory, term, edits, and reuse.
  • Advertising gate: Every express and implied claim is truthful, supported, and accompanied by clear disclosure of material connections where consumers encounter the endorsement.

Both gates must be open. A signed likeness release cannot cure an unsupported product claim, and a truthful ad cannot cure an unauthorized digital replica.

What counts as an AI-generated athlete endorsement?

“AI-generated” covers several different production methods, and the legal risk depends on what the audience is likely to perceive—not on the vendor’s technical label.

Fully synthetic athlete likeness

A model may create a fictional athlete who resembles a real person without using an original photograph or recording. If the resemblance makes a particular athlete identifiable, the campaign can still implicate publicity or NIL rights. Calling the character fictional is not a substitute for a rights analysis.

Digital replica of a consenting athlete

A brand may train or prompt a system with an athlete’s approved face, voice, movements, or prior performances. This is the clearest case for an explicit digital-replica license. The USPTO recommends that contracts and licenses expressly address AI-generated depictions and digital replicas. See its current Name, image, and likeness guidance, last updated September 17, 2026.

Voice cloning or motion synthesis

An ad may show a generic body while using a recognizable voice, or reproduce a signature celebration without showing a face. Those attributes can be identifying on their own. A release limited to “photographs” or “video appearances” may not clearly authorize synthetic voice or motion generation.

AI-assisted editing of a real shoot

Face replacement, lip synchronization, age changes, automated translations, and generative background changes can create new uses beyond the original footage. The contract should state whether such alterations are allowed and whether the athlete or representative receives approval rights.

What the FTC requires from an AI endorsement

Truthful, non-misleading messages

The FTC’s core principle is simple: “Endorsements are an important tool for advertisers, and they can be persuasive to consumers. But the law says they also have to be truthful and not misleading.” That standard applies whether the message is filmed, animated, or generated by a model.

An AI character that looks and sounds like an athlete can reasonably be understood as speaking for that athlete. The brand should examine the entire impression created by the visuals, script, captions, audio, landing page, and surrounding context—not just literal wording.

No invented product experience

The FTC says endorsers should not claim experience with products they have not tried. A synthetic athlete cannot truthfully say, imply, or appear to demonstrate personal use when the real person never used the product. This includes statements such as “I wear these every game,” “This supplement fixed my recovery,” or “I switched to this service last season” unless the represented endorser actually had that experience and the claim remains current.

Even where an athlete has used a product, the brand needs evidence for objective claims about performance, safety, health, durability, or results. A license to use the athlete’s identity is not substantiation.

Testimonials versus ordinary reviews

FTC staff describes a testimonial as an advertising message consumers are likely to believe reflects the opinions, beliefs, or experience of a consumer or celebrity who purchased, used, or otherwise experienced the product, service, or business. A polished avatar delivering first-person praise is likely to be interpreted that way. A clearly labeled fictional announcer making a non-personal product description may create a different impression, but the total presentation controls.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The FTC staff Q&A on the Consumer Reviews and Testimonials Rule says, “The rule has no blanket prohibition on the use of AI-generated avatars in marketing.” That statement addresses the scope of that rule; it is not a general approval of any AI athlete ad. The Q&A is not definitive or comprehensive and does not create a safe harbor. The rule took effect October 21, 2024. Read the staff material at Consumer Reviews and Testimonials Rule: Questions and Answers.

Disclosure of material connections

A connection that could affect how consumers evaluate an endorsement should be disclosed. FTC staff identifies payment, free or discounted products or services, employment, and personal or family relationships as examples. The disclosure should appear with the endorsement where consumers see it, and be easy to notice and understand.

For a social post, a disclosure buried after a “more” expansion, hidden among hashtags, or separated from the video may fail to communicate the relationship. A brand should also consider whether a synthetic presentation obscures the fact that the speaker is a paid promotional vehicle. The FTC does not impose a universal rule in the cited materials requiring every AI ad to carry the words “AI-generated.” However, omitting information that changes the message’s likely interpretation can contribute to a misleading overall impression. A clear explanation of the production and relationship may be prudent, especially when viewers could believe the real athlete is speaking live.

NIL, publicity rights, and trademarks are separate from advertising rules

What NIL can include

The USPTO describes NIL as identifying attributes such as a person’s name or nickname, image in photographs and video, voice, catchphrase, and signature move. Companies may pay to use NIL to promote products or services. A campaign should inventory each attribute rather than assume that a face license covers a voice clone or that a name license covers a recognizable gesture.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

State-law variation

NIL and personality-rights protections generally arise under state law and vary by state. There is not yet a federal personality-rights law that supplies one nationwide rule. The athlete’s residence, the place where the commercial use occurs, the contract’s governing law, and other campaign facts can affect the analysis. A U.S.-wide media buy therefore needs state-specific legal review rather than a single generic assumption.

Trademark overlap

A person’s name, image, or likeness can also function as a trademark when consumers use it to identify the source of goods or services. Trademark registration has its own requirements and does not replace a likeness license. Conversely, a publicity release does not automatically grant rights in a registered mark, team logo, league emblem, event mark, uniform design, or other protected material.

Organizational rights

Showing an athlete in a team uniform, stadium, event setting, or league-branded broadcast can raise separate permissions. The sources cited here do not establish who controls any particular team, league, school, union, event, or mark. Confirm those rights with the relevant rights holder and the campaign agreement. Do not infer organizational permission from the athlete’s individual release.

AI-generated versus licensed campaign: a practical comparison

Decision axis AI-generated or synthetic execution Licensed athlete campaign
Identity authorization Needs permission if a real athlete is identifiable or an approved digital replica is used. Confirm each attribute: name, image, voice, catchphrase, movement, and other distinctive features. Needs a signed agreement defining the athlete’s approved identity attributes and uses; a traditional photo or appearance release may not cover synthetic generation.
Organizational marks AI does not grant team, league, event, school, uniform, venue, or broadcast rights. Verify every mark and setting separately. Confirm whether the athlete agreement includes, excludes, or requires separate permission for organizational marks.
Product experience Do not fabricate first-person use, preference, or results. A generated mouth movement can still communicate a testimonial. The athlete must have the represented experience, and objective claims still require substantiation.
Material connection Payment, gifts, employment, and other relationships may require a clear disclosure alongside the endorsement. The same disclosure principle applies to a filmed or live appearance.
Scope and control Specify model training, prompts, outputs, edits, voice cloning, storage, future reuse, approval, security, and takedown. Specify media, term, territory, exclusivity, edits, reshoots, approval, and reuse; add digital-replica terms if synthetic versions are possible.
Jurisdiction and policy Check state publicity law, contracts, league or union rules, school requirements, and platform synthetic-media policies for the actual campaign. Check the same rules; a conventional production method does not remove them.

A clearance workflow brands can use before launch

  1. Inventory every recognizable element. List each athlete and other person depicted or heard. Note faces, names, nicknames, voices, accents, catchphrases, signature moves, tattoos, uniforms, venues, logos, statistics, and archival footage. Include elements introduced by prompts or post-production.
  2. Map the rights holder for each element. Determine whether the athlete, agent, management company, team, league, union, school, event organizer, photographer, broadcaster, or another party controls the relevant right. Do not assume the person who appears on screen controls every associated mark or recording.
  3. Match the contract to the creative. Confirm that the agreement covers AI-generated depictions and digital replicas, the approved attributes, media, territory, term, alterations, model or vendor access, future reuse, exclusivity, approval process, and takedown. These are practical drafting points recommended by the USPTO’s digital-replica guidance, not a universal statutory checklist.
  4. Describe the audience takeaway. Review the ad as a reasonable consumer would. Write down every implied message: personal use, preference, performance, health effect, affiliation, or current relationship. Include captions, comments, thumbnails, landing pages, and translations.
  5. Substantiate objective claims. Assemble competent evidence for measurable statements. Confirm that evidence matches the exact product, version, conditions, population, and time period represented. Remove or rewrite claims that depend only on the athlete’s status.
  6. Design disclosures in the execution. Put payment or other material-connection disclosures with the endorsement, not in a distant terms page. Use wording and placement that ordinary viewers can notice and understand on the platform and device where the ad appears.
  7. Obtain documented approvals. Keep the signed rights grant, rights-holder correspondence, final script, model and asset provenance, substantiation file, disclosure screenshots, approval history, and final rendered files. Record expiration dates and territory restrictions so later reuse is not accidental.
  8. Monitor and be ready to remove. Track where the creative appears, preserve evidence of unauthorized copies, and maintain a takedown path. The USPTO recommends monitoring for unauthorized uses and preserving evidence of commercial use.

Contract terms that matter for a digital replica

A generic endorsement paragraph can leave critical questions unanswered. The agreement should state, in plain language, what the brand may do and what remains prohibited.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Attributes and fidelity

  • Identify the permitted name, image, voice, likeness, likeness-based avatar, catchphrases, gestures, and performance characteristics.
  • State whether the brand may create a new voice, translate speech, alter age or appearance, or combine the athlete’s attributes with a fictional body or setting.
  • Define whether a recognizable style or signature move is included, rather than relying on a broad “likeness” term.

Media, territory, term, and reuse

  • List television, streaming, websites, social platforms, in-store displays, gaming environments, and internal or business-to-business uses as applicable.
  • Define countries or regions, campaign dates, renewal rights, archival availability, and whether the brand may use outputs in later campaigns.
  • Address paid amplification, whitelisting, localization, translations, and platform-specific edits.

Generation, vendors, and data

  • Say whether the brand may train, fine-tune, or prompt a model with the athlete’s recordings or scans.
  • Identify production vendors and prohibit them from using the assets for unrelated training or client work unless separately authorized.
  • Set retention, deletion, security, and access rules for source files, embeddings, voice models, and generated outputs.

Approval, monitoring, and takedown

  • Specify who approves scripts, voice performance, visual likeness, claims, disclosures, and final edits, and whether approval may be withheld for reputational reasons.
  • Set response times for urgent removals and define what happens when a campaign exceeds its term or a platform changes its policy.
  • Allocate responsibility for monitoring unauthorized copies and preserving evidence.

Common failure modes and how to correct them

“It is fictional, so no permission is needed”

Why it fails: A character that viewers identify as a real athlete can implicate NIL or publicity rights even when generated from scratch.

Correction: Remove identifying attributes, obtain a license covering them, or redesign the character so the intended audience is unlikely to identify a particular person.

“The athlete signed a photo release”

Why it fails: A photo or appearance release may not address synthetic voice, motion capture, model training, future edits, or digital replicas.

Correction: Amend the agreement with explicit AI-generation, attribute, media, term, territory, alteration, approval, and takedown language.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“The contract covers the athlete, so the team logo is covered”

Why it fails: Individual NIL and organizational trademark rights are different. The reviewed official sources do not identify the owner of any particular team or league right.

Correction: Inventory marks and settings, then obtain permission from the relevant rights holder or remove the material.

“The avatar can say whatever the script says”

Why it fails: A first-person statement can imply personal product experience. AI cannot manufacture that experience or evidence.

Correction: Use a non-testimonial description, document the athlete’s actual experience, or revise the script to avoid unsupported personal claims.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“The disclosure is in the caption’s last line”

Why it fails: Consumers may not see or understand a disclosure separated from the endorsement, especially in short-form video or a collapsed post.

Correction: Place a clear, readable disclosure in the video, audio, or adjacent text where the endorsement appears, and test it on the target platform.

“The FTC avatar statement is a safe harbor”

Why it fails: FTC staff says there is no blanket prohibition under the Consumer Reviews and Testimonials Rule, but also says its Q&A is not definitive or comprehensive and does not create a safe harbor.

Correction: Apply the full rights, truthfulness, substantiation, disclosure, and jurisdiction review to the actual facts.

How to decide between synthetic production and a live licensed campaign

Choose the production method only after rights and message requirements are clear.

Synthetic execution may fit when

  • The brand has a written digital-replica grant and a controlled approval process.
  • The concept needs many language versions, rapid format changes, or fictional environments that a live shoot cannot efficiently provide.
  • The script avoids invented personal experience, or the real athlete’s experience and supporting evidence are documented.
  • Model access, security, retention, and takedown obligations can be enforced across vendors.

A conventional licensed appearance may fit when

  • The campaign depends on genuine product use, demonstrations, or spontaneous testimony.
  • Consumers need an unmistakably authentic interaction with the athlete.
  • The rights holder will not grant broad synthetic-generation rights or the brand cannot monitor model outputs.
  • Production controls and platform disclosure requirements are easier to satisfy with recorded or live material.

Neither path is inherently compliant. The lower-risk choice is the one whose rights scope, evidence, disclosures, and ongoing controls match the actual creative and distribution plan.

Final pre-publication checklist

  • Every identifiable person and identity attribute is listed.
  • Individual NIL, publicity, copyright, trademark, team, league, event, school, union, and venue rights are assigned to a documented rights holder.
  • The agreement expressly addresses AI-generated depictions or digital replicas where applicable.
  • Media, territory, term, edits, translations, future reuse, model/vendor access, approval, and takedown are defined.
  • The ad does not imply product experience the represented athlete lacks.
  • Objective claims have evidence that matches the exact product and conditions.
  • Payment, gifts, employment, and other material connections are disclosed where consumers encounter the endorsement.
  • State law, contractual restrictions, league or union arrangements, school rules, and platform policies are reviewed for the campaign’s actual facts.
  • Final creative, approvals, substantiation, disclosure captures, and rights documents are retained together.

Questions brands still need to answer

Can a brand use an AI-generated athlete endorsement without permission?

Not safely when a real athlete is identifiable or the output uses that person’s NIL. Permission requirements vary by state and contract, so obtain rights covering the attributes and synthetic uses actually planned.

Does every AI athlete ad have to say it is synthetic?

The cited FTC materials do not impose a universal “AI-generated” label for every ad. Nevertheless, the full presentation must not mislead consumers, and material connections must be disclosed where required. A clear synthetic-media explanation can reduce confusion when viewers may believe the real athlete is speaking.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What rights should a brand license?

At minimum, identify the name, image, voice, catchphrase, signature move, other recognizable attributes, approved media, territory, term, alterations, future reuse, and approval and takedown procedures. Separately clear team, league, event, uniform, venue, and other marks.

Can an AI avatar claim it uses a product?

Only if the represented endorser actually had that experience and the statement is truthful and supportable. A generated performance cannot stand in for real use or evidence.

Who should review a campaign?

Use counsel experienced in athlete likeness licensing, digital replicas, and endorsement contracts, together with the rights holders and the team responsible for substantiation, privacy, platform compliance, and production security. The applicable state, league, union, school, and platform rules depend on the campaign facts.

Frequently Asked Questions

Does a synthetic athlete need to be a real person to create legal risk?

No. A fictional character that is identifiable as a particular athlete can still implicate NIL or publicity rights; changing the production method does not remove that issue.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does a trademark registration give a brand permission to clone an athlete’s voice?

No. Trademark protection and likeness permission are separate. A registration does not replace a license for voice, image, or other NIL attributes.

What should a brand retain after launch?

Keep the signed rights grant, rights-holder approvals, final creative, claim substantiation, disclosure captures, model and asset provenance, expiration dates, and takedown records.
