Copyright asks which expressive choices are attributable to a human and whether those choices meet the relevant jurisdiction’s originality standard. In the United States, AI assistance does not automatically rule out copyright, but a prompt alone does not automatically make the user the author of the generated expression. The United Kingdom has a distinct statutory provision for some computer-generated works, while the European Union frames originality around an author’s own intellectual creation. Copyright in an image is also separate from permission to use an AI service, third-party rights, and duties to disclose synthetic content.
What makes AI-generated art different from human-made art?
Human-made art has a human creator, but that fact alone does not establish that a particular image qualifies for copyright protection. The work must satisfy the applicable jurisdiction’s requirements, including its standard for originality. Conversely, using an AI tool does not automatically make every part of the resulting image unprotectable. The relevant question is what a person contributed to the expression that appears in the final work.

That distinction separates two ideas people often conflate: whether an image looks new or distinctive, and whether copyright law recognizes protectable authorship in it. A visually novel result is not necessarily human-authored expression. A work made with digital tools, including AI, may contain protectable human expression if the relevant legal test is met.
Authorship concerns expressive choices
Authorship asks who made the creative choices embodied in the work. With an AI-assisted image, some choices may be human-made and others generated by the system. A person’s contribution might include original material they add, creative changes they make to an output, or a sufficiently creative selection or arrangement of generated material. Whether a contribution qualifies depends on the work and the law that applies; merely participating in the process does not establish authorship of every resulting element.

Originality is a legal standard, not a synonym for novelty
In its general U.S. explainer, the U.S. Copyright Office says copyright protects original works of authorship fixed in a tangible form and describes originality as independent creation by a human author with a minimal degree of creativity. That is a U.S. formulation, not a universal definition. It also shows why an image can look novel while still raising a separate question about whether a human created the expression being claimed. See the Office’s What is Copyright? overview.
How the copyright approaches differ by jurisdiction
The legal answer depends on the country or region whose law applies. These are high-level distinctions, not a determination about a particular image or dispute.

| United States | The Copyright Office’s 2025 report applies existing copyright principles to generative AI: human-authored expression may qualify, while whether a contribution is sufficient is assessed case by case. | AI assistance does not by itself bar protection; a prompt does not automatically establish authorship of generated expression. |
| United Kingdom | UK law includes a statutory provision concerning certain computer-generated works without a human creator, alongside protection for human-authored works made with AI assistance if the originality standard is met. | This is a distinct statutory context, not simply the U.S. approach under another name. The treatment of a particular AI image needs case-specific analysis. |
| European Union | A European Parliament resolution recounts the Court of Justice formulation of originality as the author’s own intellectual creation, expressed with sufficient precision and objectivity. | The cited resolution describes CJEU case law; it is not itself a new binding copyright statute or judgment. AI Act transparency rules address a separate issue. |
Can you copyright AI-generated art in the United States?
The U.S. Copyright Office’s Part 2 report, released January 29, 2025, says existing copyright principles can address generative AI outputs. It distinguishes use of AI as an assistive process from the question of whether the resulting expression is human-authored. An AI-generated element can appear within a larger work that also contains protectable human expression; use of AI alone does not disqualify the whole work.

Under the Office’s approach, copyright may cover human-authored expression perceptible in the output, creative selection or arrangement of generated material, and creative modifications made by a person. The person’s contribution must meet the applicable standard; the Office says sufficiency is evaluated case by case. Protection for a human contribution does not necessarily extend to all generated elements in the same image.

What a prompt does—and does not—establish
Typing a prompt is part of the creative process, but the Office’s approach does not treat that fact alone as automatic proof that the user authored the generated image’s expression. A prompt may communicate an intended result without establishing who made the expressive choices embodied in the output. The outcome depends on the contribution and the resulting work, not on a blanket rule that every prompt either creates or cannot create copyright.
How does UK law treat computer-generated works?
The UK government’s Report on Copyright and Artificial Intelligence, published March 18, 2026, describes the UK as one of a small number of systems with a statutory provision for works generated by a computer without a human creator. The same report says that, as in UK and EU law, a human who authors a work with AI assistance may obtain protection if the originality standard is met.

This statutory distinction means the UK should not be described as simply following the U.S. position. The existence of the provision does not, by itself, settle how it applies to a particular image generated by a particular tool. That requires analysis of the specific work and circumstances.

How does the EU originality test apply to AI art?
A European Parliament resolution adopted March 10, 2026, and published in the Official Journal on August 26, 2026, recounts the Court of Justice’s formulation that a work must be original subject matter reflecting the author’s own intellectual creation, and that creation must be expressed in a manner identifiable with sufficient precision and objectivity. The resolution is an account of CJEU case law, not a new binding copyright statute or judgment. Read the resolution in the Official Journal.

For AI-assisted art, the practical question under that framing is which elements, if any, reflect the human author’s own intellectual creation and are expressed in the work. The formulation is not equivalent to a general test of whether an image seems creative, nor does it mean every image made with an AI tool has the same copyright outcome.
Which “rights” are you asking about?
Copyright ownership is only one part of the rights picture. A person may have one kind of permission or claim without having resolved the others.
- Copyright in the image: whether protectable expression exists and who authored it under the relevant law.
- Permission to use the AI service: what the provider’s contract or terms allow. The legal framework summarized here does not establish the terms for any particular provider or account.
- Rights involving other people or material: an image may raise separate questions about a person’s likeness or other third-party material. Copyright authorship alone does not answer those questions.
- Training material: whether source works used to train a model were lawfully used is a separate issue from copyright in a particular output. The general rules discussed here do not determine the status of any provider’s training corpus.
- Disclosure of synthetic content: transparency duties can apply independently of whether anyone owns copyright in the output.
Does the EU AI Act decide who owns AI-generated art?
No. Article 50 of the consolidated EU AI Act addresses transparency rather than copyright ownership. Its text requires providers of covered systems that generate synthetic image, audio, video, or text to ensure machine-readable marking and detectability, subject to qualifications and exceptions. It also requires deployers to disclose certain generated or manipulated deepfake content. For content forming part of an evidently artistic, creative, satirical, fictional, or analogous work or programme, the provision limits the manner of disclosure so it does not hamper display or enjoyment.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsThose transparency rules do not decide who owns an image or make an otherwise unprotected work copyrightable. For the text consolidated July 27, 2026, see Article 50 of Regulation (EU) 2024/1689. This explanation does not state an application date or determine whether a specific system or use is covered.
A practical way to assess an AI-assisted image
- Identify the jurisdiction. Copyright rules are not identical across the United States, United Kingdom, and European Union.
- Separate the image’s components. Identify what was generated and what a person created, selected, arranged, or changed.
- Ask what human expression is present. Focus on expressive choices embodied in the final work, not only on effort, intent, or the fact that a prompt was written.
- Apply the local originality and authorship rules. The result may protect human contributions without covering every AI-generated element.
- Check other rights separately. Service terms, third-party interests, training-data questions, and disclosure duties are not answered just by identifying a copyright author.
This framework helps organize the questions but cannot determine the status of a particular image, contract, or dispute.
