It is not one technique: diffusion is a common way to generate images from text, while other systems and tools may work differently. In any workflow, a person may shape the result through choices about the subject, composition, revisions, and how the image is used. Those creative choices matter to the current U.S. Copyright Office guidance, which says a prompt alone is not enough for copyright protection.
What is AI art?
AI art is a broad label for images generated or assisted by AI. A system might create an image from a text description, use an existing image as a starting point, or help modify parts of a human-made image. The label describes the use of a tool, not a single artistic method or a guarantee that every part of the result was made by a person.

Text-to-image diffusion is one common generation approach, but it does not define all AI art. Products differ in the kinds of input they accept, the controls they provide, and how they produce or edit images.

How does AI art work?
How text-to-image diffusion creates an image
In a simplified account of a diffusion system, a model learns patterns from training examples. When asked to make an image, it starts with random noise and progressively transforms that noise toward an image that fits the description. The prompt guides the process, but it does not operate like a precise drawing instruction: a system may interpret the same words in different ways, and results vary by model and product.

That explanation applies to diffusion systems, not every image-generation architecture, and it leaves out technical details. Google Research’s July 15, 2026 explainer also cautions against assuming that outputs are always either memorized copies or entirely novel: diffusion models may generalize beyond training examples, and the relationship between memorization and generation is something to investigate.
Where people guide the process
A person can define the image’s purpose and subject, describe a direction, assess generated options, and request revisions to details such as composition. OpenAI Academy’s April 10, 2026 guide describes plain-language prompting and iterative refinement as one product’s workflow. It is an example, not a guarantee that every tool supports the same controls or produces predictable revisions.
In practice, the human contribution can include deciding what to make, selecting among alternatives, directing changes, combining elements, and placing the final image in a larger work. How much control a tool offers—and how much the user exercises—depends on the system and the task.

Can artists use AI as a tool?
Yes. An artist can use AI to explore visual directions or iterate on an idea, just as a tool can serve a particular stage of a creative process without replacing every other stage. Whether that use is worthwhile depends on the artist’s goals, the tool’s controls, and the work involved in getting a usable result.
Using a tool does not settle separate questions about authorship, attribution, payment, or whether material used to train a model was authorized. Those are distinct issues: a system may be useful to an individual artist even while its development or wider effects raise concerns.
How do AI art models affect artists?
Artists’ views are mixed, and the available figures below describe participants in a particular 2024 survey—not all artists. Juniper Lovato, Julia Zimmerman, Isabelle Smith, Peter Dodds, and Jennifer Karson surveyed 459 artists. The percentages are the shares of respondents who agreed with each statement or position reported in that study.

The study also asked about a scenario in which an output recognizably imitated a participant’s style. In that scenario, 41.39% agreed the artist whose style was represented should own the work and derivatives, while 39.22% agreed the user who generated the work should own them. These are responses to a study question, not a legal determination or a population-wide measure of opinion.

Concerns raised around AI art include its effects on working conditions, disclosure of training material, attribution, ownership, and compensation. The survey illustrates why those concerns should not be collapsed into a simple yes-or-no judgment about whether the technology can be useful.
Can you copyright AI-generated art in the United States?
Under the U.S. Copyright Office’s January 29, 2025 summary of Part 2 of its report on generative AI, an output can receive copyright protection when a human author determined sufficient expressive elements. The Office identifies human-authored material perceptible in an output and creative human arrangements or modifications as examples. It also says that AI assistance, or including AI-generated material within a larger human-generated work, does not by itself prevent copyrightability.

This is U.S. Copyright Office guidance, not a universal rule for other countries. Whether a particular work contains enough human-authored expression depends on its circumstances; the summary does not make every AI-assisted image automatically copyrightable.
Does typing a prompt make me the copyright owner?
Not by itself, according to the Office’s January 29, 2025 Part 2 summary. The Office says merely providing prompts is not sufficient for copyright protection. A prompt can be part of a creative process, but the relevant question in this guidance is whether a human contributed enough expressive authorship to the resulting work.
Register of Copyrights and Copyright Office Director Shira Perlmutter summarized the principle in the January 29, 2025 release: “Where that creativity is expressed through the use of AI systems, it continues to enjoy protection.” The statement concerns human creativity expressed through AI, not an assurance that any prompt-generated output qualifies.

How are style imitation, digital replicas, and training treated?
The Copyright Office’s Part 1 summary, discussed in a Library of Congress Copyright Office blog post dated August 6, 2024, recommended federal legislation addressing the knowing distribution of unauthorized digital replicas that realistically but falsely depict people. The Office discussed imitation of an artist’s style separately and did not recommend including style in the scope of that proposed digital-replica law. A style imitation and a realistic false depiction of a person are not the same issue, and the recommendation should not be mistaken for a law that was enacted.
Training data is another distinct question. The Office’s report index lists Part 3 on generative AI training as having a pre-publication release dated May 9, 2025, with a final version to follow. That entry does not establish a settled licensing rule, resolve whether particular training uses are lawful, or supply a court outcome. It should not be read as answering those questions through the Part 2 guidance on human authorship.
What to consider when choosing an AI art workflow
There is no single workflow that suits every image-making task. If you are comparing systems, focus on what you need to do rather than assuming that all tools work alike.

- Starting point: Does the task call for text-only image generation, or do you need to guide the system with an existing image?
- Control: What control does the tool offer over composition and revisions, and can it make the changes you need?
- Human work: Do you need to preserve or modify existing human-made work, or build a new image from a description?
- Terms and transparency: Read the product’s terms to understand how it treats prompts, uploaded images, and outputs. Do not assume those terms are the same across services.
These questions help match a workflow to a creative task; they do not resolve copyright ownership or the authorization of a model’s training data.
