The relevant question is which human or legal entity the transaction belongs to under the law that applies: who earned the income, made the supply, acted as principal or agent, or operated the relevant platform. Indian tax statutes define taxpayers and commercial roles through persons, suppliers, agents, and electronic commerce operators; the statutory material discussed here does not establish a separate AI-agent taxpayer category. That is a cautious reading of those categories, not an AI-specific ruling. The answer for any particular transaction depends on its facts and the law effective for the relevant tax year.
Start with the transaction, not the software
When an AI agent places an order, sells a service, or transfers a digital asset, ask what legal and commercial activity took place and which person or entity was behind it. The agent’s technical autonomy does not, by itself, identify the taxpayer. Relevant facts may include who authorized and configured the software, whose account or wallet it used, who contracted with the counterparty, who supplied the goods or services, and who received the proceeds or bore losses.

These are fact-finding questions, not a statutory AI-attribution test. A software agent may act within an employment, agency, outsourcing, or platform arrangement, but the arrangement and transaction documents matter. Do not infer liability from account access or technical control alone.

The Income-tax Act, 2025 definition of “person” includes individuals, Hindu undivided families, companies, firms, associations or bodies of individuals, local authorities, and artificial juridical persons. The retrieved Act text does not separately name an AI software agent as a taxpayer category. The practical inquiry is therefore who earned or received the income under the applicable law, rather than whether the agent itself made the decision.

Trace the commercial relationship
For an agent-initiated transaction, establish who owns or controls the account, who granted the agent authority and any limits on that authority, whose name appears in the contract, who performs the supply, and who receives consideration or bears refunds and losses. Those facts help describe the arrangement; they do not, individually, settle its tax treatment.
Check the law for the relevant tax year
The Act’s definition of “person” provides a framework for identifying a taxpayer, but the applicable charge, income classification, filing duties, and any collection or withholding obligations must be checked against the operative law for the transaction date and tax year. The statutory material considered here does not resolve how every transaction made without contemporaneous human approval should be attributed.

GST: distinguish supplier, agent, and electronic commerce operator
GST analysis turns on the supply and the legal roles involved. The CGST Act text defines an “agent” by reference to conducting the supply or receipt of goods or services on behalf of another, and includes an agent acting for a supplier within the definition of “supplier.” The software label does not determine whether a business is legally acting as an agent; the actual arrangement and conduct need to be examined.

When a platform role may matter
The Act defines electronic commerce to include supplies of goods or services, including digital products, over an electronic network, and an electronic commerce operator as a person who owns, operates, or manages a digital or electronic facility or platform for electronic commerce. Separate GST rules address operators, suppliers, registration, and specified supplies for which an operator may be treated as the supplier liable for tax. Using AI to facilitate a sale does not, by itself, establish that an operator rule applies.
For a live transaction, verify the current CGST Act, rules, and notifications. The CBIC bill-text rendering and sectoral FAQ identify relevant concepts, but the FAQ is explanatory and may predate later amendments. In particular, check the conditions for any operator-related liability, registration, or tax collection at source; the CBIC FAQ discusses collection at source in connection with conditions such as collection of consideration.
Income tax and GST answer different questions
| Issue | Income tax | GST |
|---|---|---|
| Who is examined? | The person identified under the applicable income-tax law; the Income-tax Act, 2025 definition includes human, organizational, and artificial juridical-person categories. | The taxable person and any relevant supplier, agent, or electronic commerce operator under the applicable GST provisions. |
| What event matters? | Income, including a potentially relevant transfer of a virtual digital asset, under the law applying to the tax year. | A taxable supply, consideration, or a specified operator activity, subject to the statutory conditions. |
| What facts help identify the role? | Contracting party, account or wallet ownership and control, authorization, receipt of proceeds, and responsibility for losses. | Who makes or receives the supply, whether a person acts on another’s behalf, and whether a person owns, operates, or manages an e-commerce facility or platform. |
| What compliance may need checking? | Applicable filing, withholding, or other obligations under the law effective for the relevant year. | Applicable registration, invoicing, collection, or reporting requirements under current provisions and notifications. |
Control, benefit, and operational involvement are useful facts to document, not a complete legal test supplied by these sources. A transaction can raise separate income-tax and GST questions, so resolving one does not automatically resolve the other.

The Income-tax Act, 2025 text defines virtual digital assets broadly. It includes specified digital representations of value, non-fungible tokens (NFTs) or similar tokens, and crypto-assets that rely on a cryptographically secured distributed ledger or similar technology. For an agent-made transaction, first establish whether the asset and event fall within the statutory definition applicable on that date; then identify the person whose transfer or income is in question and any relevant collection or withholding duties.

A definition alone does not determine who owns an asset, whether a taxable event occurred, or which person must report it.
Do not treat the legacy VDA rate as current guidance
An official Income Tax Department result for section 115BBH of the Income-tax Act, 1961 describes a 30% rate on income from transfers of virtual digital assets and restrictions on deductions and loss set-off. That result is expressly tied to the 1961 Act and year 2024. It is not sufficient to state the rate, section number, or treatment for a later tax year: verify the operative statute, commencement provisions, amendments, and rules for the year in question.
Build an attribution record before filing or advising
For a specific transaction, preserve records that let a tax professional reconstruct both the software’s mandate and the commercial relationship:
- The human or entity that owns and configures the agent.
- The authority granted, including approval thresholds and restrictions.
- The contracting party shown to the counterparty and the terms accepted.
- The wallet, payment account, or merchant account used.
- The party receiving consideration and bearing refunds, chargebacks, or losses.
- Whether the activity is a supply through a platform or the operator’s own supply.
- The asset involved and the transaction date.
- The relevant tax year, current statutory text, and applicable rules or notifications.
This record is an investigation aid, not a legal test or a substitute for advice. For an operating business, have an Indian tax professional review the contracts, account setup, GST roles, and transaction records against the law applicable to the relevant period.
What remains unsettled
The official statutory and government FAQ material considered here does not itself establish an AI-specific attribution rule for an autonomous agent acting without contemporaneous human approval. Nor does that limited set of material prove that no court decision, CBDT circular, or CBIC instruction exists. Until directly applicable authority is identified, avoid treating software autonomy as either an exemption from tax or proof that a particular person is liable; analyze the people, entities, contracts, accounts, supplies, and proceeds in the actual arrangement.
