A business engaged in generation, transmission or distribution of power is expressly covered by the additional-depreciation provisions. For an assessment governed by the Income-tax Act, 1961, section 32(1)(iia) allows a further 20% of the actual cost of qualifying new machinery or plant acquired and installed after 31 March 2005. Late commissioning, used equipment, excluded office assets, insufficient profits and the change to section 33(8) of the Income-tax Act, 2025 determine how much can actually be claimed.
What additional depreciation does for a power plant
Additional depreciation is a deduction on top of ordinary depreciation. It is intended for qualifying capital machinery or plant used in specified businesses. Power-sector eligibility is not inferred from the fuel source or from whether a facility is large or small: the statutory category covers generation, transmission and distribution of power.

Under section 32(1)(iia) of the Income-tax Act, 1961, the qualifying assessee receives a further sum equal to twenty per cent of the actual cost of such machinery or plant. The provision applies to new machinery or plant acquired and installed after 31 March 2005. The ordinary depreciation claim remains a separate calculation under the depreciation rules.

Income-tax Act, 1961: the established 20% rule
For a tax year governed by the 1961 Act, section 32(1)(iia) is the key provision. Its stated rate is 20% of actual cost for qualifying new machinery or plant. If the asset is put to use for fewer than 180 days in the year of acquisition, only half of the calculated additional-depreciation amount is available in that year; the other half is allowed in the immediately succeeding previous year.

Income-tax Act, 2025: section 33(8)
The Income-tax Act, 2025 places the additional-depreciation conditions in section 33(8). Section 33(8)(a) describes the covered business as one in which the assessee is engaged in the business of manufacture or production of any article or thing or in the business of generation, transmission or distribution of power.
The 2025 Act recasts the conditions, so the rate and transition treatment must be checked against the rules and Finance Act applicable to the particular tax year. Do not automatically carry the 1961 Act’s 20% figure into a return governed by the 2025 framework without confirming the operative provisions. The Income Tax Department maintains a comparison utility for the two Acts; use the statute applicable to the previous year and assessment year in question.
Core eligibility checklist
1. The business must be in the statutory power category
Generation, transmission and distribution are each named activities. A company that generates electricity, operates a transmission network or distributes power can satisfy this business test. The cited provisions do not restrict the category to a particular fuel, source or generation technology.

2. The asset must be new machinery or plant
The item must be new, acquired by the assessee, installed by the assessee and first put to use for business. A newly manufactured turbine, boiler, generator, switchgear, substation transformer or transmission installation can therefore be considered when the remaining statutory tests are met. “New” is a legal condition, not merely a description used by a vendor; purchase records should establish that the equipment was not previously used.

3. Acquisition, installation and first-use evidence must align
Keep the purchase order, tax invoice, payment trail, capitalization entry, installation or erection certificate, commissioning record and evidence of the date on which the asset first entered business use. A purchase in one year followed by installation in another can affect the year in which the deduction is available. The commissioning date is also decisive for the 180-day test.
4. The asset must not receive a prohibited full-cost deduction
Additional depreciation is unavailable where the whole actual cost of the asset is otherwise deductible in one year under the applicable tax rules. Review the treatment of grants, incentives, special deductions and any provision that could reduce or eliminate the depreciable base before calculating the additional amount.
Assets that are expressly excluded
The statutory exclusions apply even when an item is physically located at a power station. The following categories do not qualify under the cited additional-depreciation clause:
Free tools Windows power users keep installed

- Machinery or plant previously used by another person, whether the prior use occurred in India or abroad.
- Plant installed in an office premises or residential accommodation, including a guest-house.
- Office appliances.
- Road transport vehicles.
- Ships and aircraft, which are outside the clause.
- Any machinery or plant for which the whole actual cost is deductible in one year under another provision.
This means the location of an item is not enough. A new machine installed in a control-room office may still fall within the office-premises exclusion, while a new switchgear assembly installed in a qualifying substation may be tested as plant used in the power business. Classification should follow the statute and the asset’s actual function, not only the accounting ledger name.

Does the deduction cover generation, transmission and distribution equipment?
Yes, the business wording covers all three activities. The equipment still has to pass the newness, ownership, installation, business-use and exclusion tests. The following examples show how to analyze common assets without treating any category as automatically eligible:
| Equipment or installation | How to test it | Typical outcome under the cited rules |
|---|---|---|
| Turbine or generator | Confirm it is new, acquired and installed by the power business, and record first business use. | Can qualify when all conditions are met; a used turbine is excluded. |
| Boiler and balance-of-plant machinery | Verify new status, capitalization as plant, installation and commissioning. | Potentially qualifying new plant; prior use or an excluded location defeats the claim. |
| Transmission transformer or substation equipment | Connect the asset to the transmission business and preserve installation and energisation records. | Potentially qualifying new plant if the statutory tests are satisfied. |
| Distribution equipment | Document that it is used in the distribution business and was first put to use by the assessee. | Potentially qualifying new plant; the activity is within the express category. |
| Used turbine, boiler or transformer | Check whether another person used it in India or abroad before acquisition. | Excluded as previously used machinery or plant. |
| Office computers, furniture or appliances | Determine whether the item is an office appliance or office installation. | Excluded categories cannot receive this additional depreciation. |
| Road transport vehicle | Classify the vehicle by its road-transport function. | Excluded by the clause, even if used to support plant operations. |
How the 180-day rule changes the first-year amount
Use for 180 days or more
When qualifying machinery or plant is put to use for at least 180 days in the year in which it is acquired and installed, the full calculated additional-depreciation amount is available for that year under the 1961 Act’s section 32 text.
Use for fewer than 180 days
When first business use occurs for fewer than 180 days, only 50% of the calculated additional-depreciation amount is allowed in the acquisition year. The remaining 50% is not lost: it is allowed in the immediately succeeding previous year. Preserve the commissioning and first-use documents so the day count can be supported if the return is reviewed.
Illustrative calculation
Assume a qualifying new generator has an actual cost of ₹100 crore and is first put to business use for fewer than 180 days in a year governed by the 1961 Act. The section 32 rate produces a calculated additional-depreciation amount of ₹20 crore. Only ₹10 crore is claimed in the first year, and the remaining ₹10 crore is claimed in the immediately succeeding previous year, subject to the asset continuing to satisfy the applicable conditions. This is an illustration; actual-cost adjustments, the governing statute and other tax provisions can change the computation.

What happens when the plant has little or no taxable profit?
A deduction can be available even when current business profits are insufficient to absorb it. Section 32(2) treats unabsorbed depreciation as depreciation for the following year. It is added to that year’s depreciation and can continue forward subject to the statutory conditions. The 180-day balance and any ordinary depreciation shortfall should be tracked separately in the tax computation so that the return carries the correct amount into the next period.
Book losses, tax losses and unabsorbed depreciation are not interchangeable labels. Reconcile the tax depreciation schedule to the return, identify the year in which each amount arose and preserve the computation supporting the carry-forward.
Claiming additional depreciation: a practical workflow
- Identify the governing law. Determine the previous year and assessment year, then establish whether the return is governed by section 32 of the 1961 Act or section 33(8) of the 2025 Act. Check the applicable rules and Finance Act for the transition.
- Map the business activity. Document whether the assessee generates, transmits or distributes power. If the entity has several businesses, map each asset to the activity in which it is used.
- Build an asset-level register. Record description, vendor, invoice date, acquisition date, installation date, capitalization date, location, actual cost and first-use date for every candidate asset.
- Test newness and ownership. Obtain vendor declarations or other evidence that the machinery was not previously used by another person in India or abroad. Verify that the assessee acquired and installed it.
- Screen exclusions. Remove office or residential installations, guest-house plant, office appliances, road transport vehicles, ships, aircraft and assets receiving a full-cost deduction elsewhere.
- Calculate the statutory amount. Under the 1961 Act, apply 20% of the qualifying actual cost. For a 2025 Act return, use the rate and conditions in the operative section, rules and transition provisions rather than assuming the legacy percentage.
- Apply the day threshold. If first use is for fewer than 180 days, claim only half of the calculated amount in year one and schedule the other half for the immediately succeeding previous year.
- Test absorption and carry-forward. If profits cannot absorb the allowance, classify the balance as unabsorbed depreciation and carry it under section 32(2), maintaining a year-by-year schedule.
- Reconcile the return. Tie the tax depreciation schedule to the fixed-asset register, financial statements and supporting invoices. Explain any difference between accounting depreciation and the tax claim.
Claim now, defer the balance or revisit a prior position?
| Decision point | Claim in the acquisition year | Defer or review |
|---|---|---|
| First use reaches 180 days | Apply the full amount permitted by the governing statute. | Review only if actual cost, exclusions or statute selection is uncertain. |
| First use is below 180 days | Claim 50% of the calculated amount under the 1961 Act’s rule. | Schedule the other 50% for the immediately succeeding previous year; do not force the full amount into year one. |
| Current profits are insufficient | Record the allowable deduction in the tax computation. | Carry the unabsorbed amount as depreciation under section 32(2), subject to the applicable conditions. |
| Equipment was previously used | No additional-depreciation claim is available for that asset. | Recheck whether a genuinely new replacement or separately identifiable new component was acquired; do not relabel used machinery. |
| Law changes at transition | Use the section applicable to the tax year, not the year in which the asset was ordered. | Check the 2025 Act, rules, Finance Act and Department comparison material before finalising the return. |
Common errors and how to correct them
Claiming because the asset is at a power station
A power-station location does not cure an exclusion. Reclassify office appliances, guest-house installations and road vehicles before preparing the depreciation schedule.
Treating a refurbished import as new
Equipment imported from abroad can still be previously used machinery. Obtain evidence of manufacturing and prior-use status; the exclusion covers prior use by another person in India or abroad.

Using the invoice date as the first-use date
Acquisition, installation and first business use are separate events. Use commissioning, energisation or operational records that show when the asset actually entered business service.
Claiming 20% automatically after the 2025 transition
The 20% figure is explicit in the cited section 32 text of the 1961 Act. Section 33(8) of the 2025 Act recasts the conditions, so verify the prescribed rate and transition rule for the relevant tax year.
Ignoring the succeeding-year half
A sub-180-day asset should have a carry-forward line for the unclaimed half. Omitting that schedule can permanently lose track of an amount that the statute allows in the immediately succeeding previous year.

How to handle the 1961-to-2025 transition
Start with the tax year, not the purchase order. Identify the previous year, assessment year, return form and law that governs that filing. Then read the operative section, rules and Finance Act together. The Department’s comparison utility can help locate corresponding provisions, but it does not replace checking the transition rule for the specific year.
Where an asset was acquired under the 1961 Act but its deduction is claimed or carried into a period governed by the 2025 Act, document the statutory bridge in the tax file. Keep the original calculation, the amount already allowed, the remaining balance and the provision relied on for the later year. If the transition language or prescribed rate is unclear, obtain a tax professional’s written position before filing rather than using the legacy percentage by default.
Bottom line for a power-plant owner
Generation, transmission and distribution businesses are expressly within the power-sector category. A claim still depends on a new qualifying asset, acquisition and installation by the assessee, first business use, exclusion screening and the correct tax statute. Under the 1961 Act, the 20% calculation is reduced by half in the first year when use is below 180 days, with the remainder available in the next previous year; insufficient profits move the unabsorbed amount forward under section 32(2). For periods governed by the Income-tax Act, 2025, apply section 33(8) and verify the rate and transition provisions for that tax year.
