French Deportation Rulings: How Judges Balance Conflicting Rules on Forced Removal

French courts treat an order to leave France, the choice of a return country, and a separate expulsion decision as distinct legal questions. A person’s risk of torture or other ill-treatment can bar removal to a particular country, but the outcome depends on the decision being challenged, the individual evidence, and the stage of the case. Recent Conseil d’État and European Court of Human Rights rulings show how those questions interact with asylum procedures, hearing rights, family life, children’s interests, and public order.

Start by identifying which removal decision is being challenged

An obligation de quitter le territoire français (OQTF) is an order requiring a person to leave France. It is distinct from the decision naming the country to which that person may be sent. A separate expulsion decision is another measure, as illustrated by the Conseil d’État case concerning a proposed expulsion to Russia. These terms are not interchangeable: the legal argument and the remedy depend in part on the measure at issue.

In decision 495898 of 28 October 2024, the Conseil d’État held that an Article 3 European Convention on Human Rights (ECHR) risk argument may be made against the decision fixing the country of return; that argument does not, by itself, apply against the OQTF. Article 3 prohibits torture and inhuman or degrading treatment. The distinction does not mean a person may be sent to a country where that prohibited risk exists: the destination decision has its own legal scrutiny. The rulings address different measures and procedures, so their outcomes should not be treated as a single general rule. The details of the risk, the opportunity to present relevant circumstances, and the family’s situation matter.

Destination risk must be examined independently

In 495898, the Conseil d’État said the prefect must examine the available information and ensure that the chosen destination will not expose the person to treatment prohibited by Article 3. An earlier decision by the French Office for the Protection of Refugees and Stateless Persons (OFPRA) or the National Court of Asylum (CNDA) is relevant context, but it does not decide that separate destination question for the prefect.

The court also rejected the idea that an asylum rejection ends the risk inquiry. Removal requires a thorough and complete examination of the person’s situation. When an administrative judge reviews the alleged risk, the person need not first show that the claim rests on evidence newly produced since the asylum application. The issue remains whether the individual risk is established in the removal case.

If a court annuls a decision selecting a destination, that judgment does not absolutely bind OFPRA or CNDA in their own jurisdictions. It can, however, amount to a new element that makes an application for asylum re-examination admissible. The distinction preserves the separate roles of the removal authorities and the asylum bodies.

When asylum proceedings can provide the opportunity to be heard

In decision 493675 of 5 June 2025, the Conseil d’État considered whether applicants whose asylum claims had been rejected had to receive a fresh opportunity to submit observations specifically about the resulting OQTF. It upheld the finding that the right to be heard had been respected where they had already had an opportunity during the asylum process to put forward relevant information.

The ruling is not a general exemption from a meaningful hearing. It concerns whether a separate repeat hearing is always required in this particular sequence. The court noted that an asylum applicant can understand that rejecting the protection claim may lead to a removal measure. Whether an earlier hearing is sufficient therefore depends on whether the person could effectively raise the relevant circumstances. See decision 493675.

Family life and children can weigh against expulsion

Decision 498190 concerned an interim request to suspend an expulsion to Russia. The person’s spouse had refugee status and could not accompany him there with their two very young children. The Conseil d’État upheld the interim judge’s view that the prospect of permanent family separation could create serious doubt about the expulsion’s legality under Article 8 of the ECHR, which protects respect for private and family life, and Article 3(1) of the Convention on the Rights of the Child, concerning the child’s best interests.

The court also confirmed that the interim judge had considered the seriousness of the public-order threat. The ruling shows that a serious public-order concern is part of the balance, not that it automatically overrides family-life and children’s interests. It was an interim suspension decision, not a final resolution of every issue on the merits. Read decision 498190.

Why the European Court reached a different Article 3 result

In U v. France, the European Court of Human Rights considered a Russian national of Chechen origin whose refugee status had been revoked because the authorities considered his presence in France a serious threat to state security. The Court noted that French authorities had thoroughly reviewed his situation at each stage, then made its own assessment of the evidence available. It found that he had not demonstrated a real and current risk of Article 3 treatment in Russia and therefore found no violation in the possible removal in that case. That result is specific to the applicant and evidence before the Court. It does not create permission to remove someone whose individual risk has not been assessed. Nor does it conflict with the Conseil d’État’s insistence that the destination decision must receive independent scrutiny: the rulings address the assessment of risk in different proceedings and on their respective records.

How to read a forced-removal dispute

When comparing cases or assessing an argument, ask five questions:

  • Which measure is challenged? It may be an OQTF, a decision naming the return country, or a separate expulsion measure.
  • Which right or interest is at stake? The case may concern Article 3 non-refoulement, a meaningful opportunity to be heard, family life, children’s interests, or public order.
  • Who made the assessment? OFPRA and CNDA decide asylum matters; the prefect has a separate destination-risk duty; administrative courts review challenged measures; and the ECHR assesses Convention compliance.
  • At what procedural stage is the case? A merits challenge, a question about asylum re-examination, an interim suspension request, and an ECHR judgment are not the same kind of decision.
  • What do the current circumstances and evidence establish? The individual risk, the chance to raise relevant facts, and the likelihood and consequences of family separation are case-specific.

Together, these rulings show why there is no one-step answer to whether France can carry out a forced removal. The legality depends on the precise measure, the right invoked, the authority’s role, and the evidence about the person’s present circumstances.
