NZ’s “Clean, Green” Reputation at Risk, Former UK Envoy Warns

On October 2, 2026, former British High Commissioner to New Zealand Laura Clarke warned that the country’s “100% Pure New Zealand” brand and clean-green reputation were at risk. Her warning followed a Dutch environmental group’s complaint to the European Commission alleging New Zealand may have breached climate and environmental commitments in its EU–New Zealand free trade agreement (FTA). The complaint is not a ruling: Trade Minister Todd McClay says New Zealand is compliant, and no breach has been established.

Why Clarke says New Zealand’s reputation is at stake

In an RNZ Morning Report interview, Clarke said the complaint tests the “integrity and the credibility” of trade-agreement commitments. She described New Zealand as a reliable trade partner known for quality produce, innovative trade agreements and a strong rule of law. In her view, trading partners expect climate commitments to be implemented, and failing to meet those expectations could damage the country’s credibility. She called it “a real risk to New Zealand’s reputation.” These are Clarke’s assessments, not evidence that trade, tourism or consumer demand has already fallen. What the EU complaint alleges

Dutch environmental group Both ENDS filed its complaint through the European Commission’s Single Entry Point mechanism. It alleges that a series of New Zealand policy decisions weakened climate safeguards in a way that conflicts with the FTA’s Trade and Sustainable Development chapter. Both ENDS is seeking compliance, according to reporting, not suspension of trade benefits. The complaint’s claims have not been adjudicated. The report on the complaint lists the policy examples raised by the group:

  • Lowering New Zealand’s 2050 methane target.
  • Removing agriculture from carbon pricing.
  • Reversing the ban on offshore oil and gas exploration.
  • Establishing a Gas Security Fund and planning an LNG import facility.
  • Passing legislation that limits climate-related claims against major emitters.

These are Both ENDS’ cited examples, not findings that any individual policy breaches the treaty.

What the trade agreement requires—and what it leaves to governments

Chapter 19 of the EU–New Zealand FTA combines a right to regulate with environmental and climate commitments. The wording matters because the complaint concerns how particular policy changes fit alongside those provisions.

Governments retain regulatory discretion

Article 19.2 recognises each party’s right to set its own domestic protection levels and to adopt or modify its laws. McClay has likewise said New Zealand is compliant and that decisions about how to meet its obligations belong to the country’s government and Parliament.

The agreement also limits weakening protections to attract trade

Article 19.2(4) says a party “shall not weaken or reduce the levels of protection afforded in its environmental or labour law in order to encourage trade or investment.” Whether the policies identified by Both ENDS fall within this provision depends on how the clause applies to those decisions; its existence alone does not establish a breach.

Paris Agreement implementation is part of the commitments

Article 19.6 requires effective implementation of the UNFCCC and the Paris Agreement, including nationally determined contributions. It says this includes refraining from action or omission that materially defeats the Paris Agreement’s object and purpose. The complaint raises questions about these commitments, but the treaty text does not decide whether the cited policies violate them.

Has New Zealand breached its EU climate commitments?

That remains an open question. Both ENDS alleges that policy changes undermine the FTA’s sustainability commitments; the New Zealand government says it is compliant. The agreement grants governments room to set domestic policy while also imposing obligations against weakening protections to encourage trade or investment and requiring effective implementation of climate agreements. Applying those clauses to the policies at issue is the contested question.

Filing a complaint is not the same as the European Commission accepting its claims, and the available reports do not establish that a panel has made findings. They also do not report suspended EU market access or a measured commercial loss resulting from the complaint.

What the clean-green brand has been said to be worth

New Zealand’s environmental image has been linked to its commercial standing before, but historical estimates should not be mistaken for current impact figures. A 2009 Cabinet paper from the Ministry for the Environment said tourism and food and agriculture then contributed around NZ$39 billion to the economy. It estimated that maintaining a 1% premium attributable to the clean-green image would be worth about NZ$390 million per annum. That was a hypothetical calculation: the paper said the value was extremely difficult to estimate and depended on how consumers valued environmental sustainability in future. Neither figure measures a loss in 2026. The 2009 Cabinet paper sets out the estimate and its caveats.

A 2010 report by the Parliamentary Commissioner for the Environment also recorded political and business leaders’ views that the image mattered commercially, while noting that its value was difficult to quantify. It quoted then Prime Minister John Key describing the environment as vital both to New Zealand’s lifestyle and to the “clean green brand” sold to the world. Business leader Stephen Tindall warned that damage to the image could carry substantial economic costs. Those were historical, attributed opinions, not verified estimates of present-day losses. The Commissioner’s report provides that context.
