A Massachusetts judge on October 1, 2026, denied Lindsay Clancy’s renewed request for a required finding of not guilty. The ruling means the murder charge could proceed on the evidence presented; it does not mean a judge or jury found Clancy guilty. Her first trial ended in a mistrial after jurors could not reach a unanimous verdict, and prosecutors had not yet decided whether to retry her, according to the latest detailed status report.
What the judge decided
Judge William Sullivan denied the defense request for a required finding of not guilty after Clancy’s first trial ended in a mistrial. The Associated Press reported that Sullivan said evidence, viewed in the light most favorable to the Commonwealth, could allow a rational factfinder to find the elements of murder beyond a reasonable doubt. This was a legal-sufficiency ruling, not a verdict. Sullivan did not decide that Clancy was guilty, and the ruling did not resolve whether she was criminally responsible because of mental illness.
Why the request came after a mistrial
Clancy’s first trial ended September 4, 2026, when the jury could not reach a unanimous verdict. AP reported that jurors were divided 11 to 1 in Clancy’s favor. A deadlocked jury results in a mistrial, not a conviction or an acquittal. AP report on the mistrial and post-trial hearing.

At a September 29 hearing, defense attorney Kevin Reddington argued that prosecutors had not sufficiently proved Clancy carried out the killings. “This entire case is based on speculation,” AP quoted him as saying. Prosecutor Shanan Buckingham disputed that characterization, telling the judge the record contained substantial information supporting the prosecution’s position. AP report on the hearing.
How the new argument differed from the trial defense
At trial, the central defense issue was criminal responsibility: whether Clancy, because of mental disease described in coverage as postpartum psychosis, should be held criminally responsible. The renewed request raised a different question—whether prosecutors had proved that she herself committed the killings.

According to AP’s trial coverage, jurors heard testimony that Clancy said voices instructed her to kill her children, and that her DNA was found on exercise bands used in the killings. Prosecutors argued she knew her actions were wrong; the defense argued she was not criminally responsible because of mental illness. The judge’s denial addressed whether the case could be considered by a factfinder under the legal standard described in AP’s report. It did not decide either the defense’s criminal-responsibility argument or the ultimate question of guilt.

What may happen next
As of AP’s September 29 report, prosecutors had not decided whether to retry Clancy. The options described included another trial on first-degree murder, proceeding on lesser charges, or dropping the prosecution; none had been announced as the chosen course. AP report on the prosecution’s options.
The case therefore remained pending after the October 1 ruling. The full written order was not available in the reporting cited here, so Sullivan’s reasoning should not be extended beyond the explanation AP quoted.
