New Zealand’s Immigration and Protection Tribunal upheld the refusal of residence to a Kenyan man facing a murder charge in Kenya, according to RNZ’s 2 October 2026 report. The tribunal was reviewing his immigration appeal, not deciding the criminal case: the man had not been convicted, and his trial had not yet taken place.
What the tribunal decided
Immigration New Zealand declined the man’s residence application after concluding that he had deliberately failed to disclose the Kenyan charge. The tribunal reportedly rejected his appeal and concluded that the unresolved charge made an exception to immigration instructions inappropriate. The underlying tribunal decision was not available; the account here is based on RNZ’s report.
The tribunal was quoted as saying: “While he has not been convicted, and the evidence suggests that he is otherwise of good character, this outstanding charge makes it inappropriate that the tribunal recommend an exception to instructions be considered”. That reported reasoning distinguishes the pending charge from a conviction: the tribunal did not find him guilty of murder.
How the immigration application unfolded
The man, aged 58 at the time of the report, had worked on New Zealand dairy farms. He applied for residence under a 2022 visa category that RNZ described as using “settled, skilled or scarce” criteria; his dairy-farm work was assessed under the scarce criterion. His application included his wife and two children, who had not travelled to New Zealand.

While Immigration New Zealand was considering the application, he returned to Kenya in January 2023 after his mother died. Eleven days later, another relative died amid family conflict, according to the report. The man and a brother were later charged. RNZ reported that Kenya’s High Commission informed Immigration New Zealand of the charge and of a court order barring him from travelling outside Kenya without leave.
Immigration New Zealand deferred its decision three times, one deferral lasting 36 days, before declining residence. The applicant argued that the agency had wrongly inferred guilt or treated the charge as a conviction. He also said he had not intended to withhold the information.

Why the tribunal did not wait for the criminal case
The tribunal reportedly said Immigration New Zealand was not required to keep postponing the residence decision until the Kenyan case concluded. As RNZ quoted the tribunal: “Immigration New Zealand is not obliged to continually defer an application, or necessarily await the outcome of a decision on such matters”. This is the tribunal’s reported statement about this application, not a general account of every immigration decision involving a pending charge.
The tribunal also considered the applicant’s circumstances in New Zealand and Kenya. RNZ reported that it acknowledged he had worked in New Zealand for approximately 12 years during the previous 19 years and had positive employer references. It also noted that his wife and children remained in Kenya, that he had lived there for three and a half years, and that the charge was unresolved.

What the family said about hardship
The applicant described mental-health effects on himself and one child following the family death. His family also reported financial hardship, overdue school fees and a risk that the older child would have to give up a university degree. These are hardships described by the family in the report, not independent findings about their present circumstances.
RNZ’s report does not establish what happened in the Kenyan criminal proceedings after publication. At the time it described, the man had not been convicted and his trial had not taken place.
