A former Cornell student identified in court papers as Jane Doe alleges that she was drugged and sexually assaulted at the university’s Chi Phi fraternity house in October 2024. The allegations are contested, and the reviewed reporting establishes no criminal conviction. After a civil lawsuit brought the case back into public view, New York Gov. Kathy Hochul appointed Attorney General Letitia James special prosecutor on October 1, 2026. As of October 3, no charging decision had been reported.
What does the lawsuit allege?
The civil complaint says Jane Doe was given ketamine and repeatedly sexually assaulted at the Chi Phi house. According to Associated Press reporting on documents and interviews, she said she initially consented to some sexual activity but became uncomfortable as additional men arrived. Her account and the accounts of the accused differ sharply over consent and participation; some men denied nonconsensual sex or said they did not touch her.
In a police-interview transcript cited by AP, Doe said, “Yes. It was coercion, yes,” and, “I can say with 100% confidence I was raped.” Those are her statements, not a court’s finding. At a 2025 university hearing, she described feeling “like bait” and “like lions around me,” AP reported. The civil case and the university process are distinct from a criminal prosecution, and the claims remain disputed.

Why was the criminal investigation reopened?
A central dispute is what information the district attorney received before declining charges in 2024. Tompkins County District Attorney Matthew Van Houten said he relied on a police summary rather than the full interview transcript, and that the summary did not include key statements Doe later described. He said, as reported by AP, “Seeking justice sometimes requires us to reconsider or reopen cases when we are provided with additional evidence.”

Cornell said it sent Doe’s sworn statement and Snapchat screenshots under its protocol. The Washington Post reported that the university did not answer whether all interview evidence had been turned over. These accounts leave the completeness of the initial evidence submission disputed; the renewed review has not yet produced a reported charging outcome.
What did Cornell do separately from the criminal process?
AP reported that Cornell’s internal inquiry involved 50 interviews with 32 witnesses and 12 hearing days. Publicly reviewed records describe both areas of agreement and serious disagreement about consent. Cornell has said some students were expelled or suspended, but has not released detailed outcomes, citing student-privacy law. At least one student has separately sued over the university’s disciplinary process and sanction.

It is misleading to reduce Cornell’s response to essay-writing sanctions. AP reported that some essay or class requirements concerned other conduct, while the university also said some students were expelled. University discipline is not a criminal conviction, and the privacy limits mean the public record does not establish every student’s individual outcome.
What do Cornell’s campus survey figures show—and not show?
Cornell’s Presidential Task Force on Campus Sexual Assault reported findings from its 2025 survey in 2026. The undergraduate response rate was 13%, down from 34% in 2023; the task force cautioned that the low response rate limits estimates and interpretation. These are respondents’ reports of experiences, not verified crime counts or evidence about the people in this case.

The Greek-affiliation difference does not establish that fraternity membership causes assault, and campus-wide survey estimates do not establish what happened in this particular case. The low response rate is especially important when interpreting any of the percentages.

ABC News reported that Doe texted in October 2024, “My reputation is destroyed and I’m utterly ashamed.” That message describes her own reported distress; it is not evidence that the allegations have been adjudicated or a measurement of how the public views fraternities as a whole. The case has brought renewed scrutiny to a fraternity chapter and to how institutions and law enforcement handle reports, but the record remains contested and the criminal review is ongoing.
