Virginia now requires covered nicotine vape products to qualify for and appear in a state directory before retailers may sell them. That product-by-product gate, plus certification fees and paperwork, could favor manufacturers that already have products with qualifying federal status. FDA records show marketing orders for selected JUUL, Vuse and NJOY products. But those facts do not prove that Virginia’s law was designed to help large tobacco companies, that every independent product is barred, or that major manufacturers have gained sales. The “gift to Big Tobacco” is a plausible concern about market structure—not an established outcome.
What Virginia’s directory law requires
The Virginia Attorney General’s “Liquid Nicotine & Nicotine Vape Product Directory” page says manufacturers had until December 31, 2025, to certify covered products. The state says enforcement against unauthorized products began April 1, 2026, and that enforcement continues. Applications for new certification and annual recertification opened October 1, 2026.
Under the current Code of Virginia provisions effective October 1, 2026, manufacturers must certify each retail product annually. A product can qualify through FDA marketing authorization, or through specified legacy-market or premarket-tobacco-application (PMTA) conditions.
Which products can qualify
The statute’s alternative federal-status route covers a product marketed in the United States by August 8, 2016, or one for which a PMTA was submitted by September 9, 2020, if that application remains under review or has no effective final decision. A product’s eligibility is not the same as a blanket approval of its manufacturer or brand.

What certification costs
The statute sets a $5,000 initial certification fee per product and a $2,500 annual recertification fee per product. Those statutory charges, applied product by product, add a measurable compliance burden. The sources available here do not quantify how much manufacturers spend on other paperwork or compliance work.
How to check a product
For a practical answer about a specific product, check the Attorney General’s current directory rather than relying on a brand name, packaging, or a retailer’s claim. A product’s presence there is the state-level retail-sale test described by the Attorney General; the directory does not make every other product from the same company eligible.
Why the policy could favor established manufacturers
A directory gate can shift the competitive balance when eligibility depends on federal status and each product requires its own certification. A manufacturer with products that already meet a qualifying route may be better positioned to keep those products on shelves than a smaller company whose products do not qualify or whose resources are more constrained by per-product fees and administration. That is a reasonable market-structure concern, not proof that any particular business has benefited.

FDA’s “Tobacco Products Marketing Orders” page illustrates why company-wide shorthand is misleading. It lists marketing orders for JUUL devices and Virginia tobacco and menthol JUULpods in July 2025; Vuse Alto power units and tobacco-flavored pods in July 2024; and NJOY DAILY and ACE menthol products in June 2024. The same FDA page lists denials, including blu Disposable in 2025 and products from multiple firms in earlier years. Federal status must be checked product by product.

Those examples show that some products associated with major companies have marketing orders; they do not establish that every product those companies sell is authorized or directory-listed. Nor do the legal provisions and FDA orders show how many products are listed by ownership, whether Virginia consumers switched brands, or whether large firms gained market share. The available sources do not measure Virginia sales before and after the law, attribute business closures or lost sales to it, or establish legislative intent to advantage Big Tobacco.
The directory is only one part of Virginia’s enforcement approach
In a July 15, 2026, release, the Virginia Attorney General said a separate law effective July 1 requires convenience stores to obtain permits to sell vape and tobacco products. The release says the Virginia ABC Authority is to conduct regular inspections, including random underage checks and verification that stores sell approved products.

Attorney General Jay Jones said in the release: “If you are pushing a product that is illegal, we are going to step in and we are going to hold you accountable. If you are breaking the law, we are going to hold you accountable. That’s what we are going to do.” The statement describes the administration’s enforcement position; it does not establish how consistently inspections will occur or what effect they will have on youth access or the market.
What the court record does—and does not—establish
Virginia’s February 13, 2026, annual directory report says Novo Distro Inc., Tobacco Hut and Vape Fairfax Inc. sued state officials in October 2025. According to that report, a federal district court preliminarily enjoined specified enforcement provisions on December 18, 2025, and the Attorney General appealed; a related case was pending in the Fourth Circuit when the report was issued.

These dated accounts alone do not resolve the injunction’s current scope or subsequent court proceedings. Readers should not treat the February report as a statement of the present court status—or assume the later enforcement notice explains what happened in court.

Health figures provide context, not proof of the law’s effects
The Virginia Department of Health / RVO Health “Quit Now Virginia Stakeholder Report 2023,” dated January 31, 2025, includes national use figures. It reports that in 2024, 7.8% of U.S. high school students and 3.5% of U.S. middle school students used e-cigarettes in the past 30 days—about 2.1 million young people. The same report says U.S. high-school past-30-day use fell from 11.7% in 2017 to 7.8% in 2024. These are national estimates, not Virginia-only measurements, and they do not measure the directory law’s effect.
The report also says almost 15 million U.S. adults, or 6.0% of the adult population, used e-cigarettes in 2022. Among Quit Now Virginia respondents at seven-month follow-up, current ENDS use was 9% in the Standard Care program and 14% in the Behavioral Health program. Those program figures describe the respondents and follow-up reported; they are not a statewide estimate of vaping or evidence that the directory changed cessation outcomes.
What would show whether this is a gift in practice
The concern is testable, but the legal rules and FDA records alone cannot settle it. A useful assessment would need evidence that connects the directory to market outcomes, including:

- Which products are listed, their manufacturers and ownership, and changes in those counts over time.
- Virginia sales and market shares before and after implementation, including whether consumers substituted other products.
- Evidence of lost sales, business closures or compliance burdens attributable to the directory, broken down by manufacturer size.
- Consistent information about inspections and enforcement, alongside evidence about youth access and adult users’ ability to obtain products.
- Evidence about cessation outcomes and the law’s effects on adults who use nicotine.
Until those outcomes are measured, the strongest supported conclusion is narrower: Virginia’s product-level eligibility rules and fees may give an advantage to companies with products that already meet a qualifying federal-status route, but the available evidence does not establish that advantage as an actual market gain or prove a pro-tobacco purpose.
