The Trump administration has appealed a federal court order that paused a Department of Homeland Security rule changing how long some international students and other nonimmigrants may remain in the United States. The appeal, filed September 30, 2026, challenges an interim order postponing the rule’s effective date; it does not itself put the rule into effect or overturn the court’s order.
What the administration appealed
Federal defendants filed a notice of appeal on September 30, 2026, asking the U.S. Court of Appeals for the First Circuit to review a September 14 order from the U.S. District Court for the District of Massachusetts in Presidents’ Alliance on Higher Education and Immigration et al. v. U.S. Department of Homeland Security et al., No. 1:26-cv-13799.
The district court postponed the effective date of DHS’s final rule under Section 705 of the Administrative Procedure Act (APA). The government’s appeal contests that interim relief. Filing an appeal does not by itself lift the pause or mean the First Circuit has reversed the district court.
What the September 14 order did—and did not do
Judge F. Dennis Saylor IV granted relief only to the extent of postponing the final rule’s effective date. The court’s order says: “Plaintiffs’ motion for APA § 705 relief, a preliminary injunction, or, in the alternative, summary judgment, is GRANTED to the extent that it seeks to postpone the effective date of the Final Rule pursuant to the Administrative Procedure Act, 5 U.S.C. § 705.” It also says that requests for vacatur, summary judgment, or other relief were “DENIED without prejudice to its renewal.” The order is transcribed in the [Government Publishing Office’s court record](https://www.govinfo.gov/content/pkg/USCOURTS-mad-1_26-cv-13799/pdf/USCOURTS-mad-1_26-cv-13799-0.pdf).

- It did: postpone the rule’s scheduled effective date while the order remains operative.
- It did not: vacate the rule, finally decide whether it is lawful, or permanently block it.
Some university updates describe the order as a preliminary injunction. The court’s stated disposition is more specific: it granted a postponement under APA § 705, while denying other requested relief without prejudice.
What DHS’s rule would change
DHS published the final rule on July 17, 2026, with an original effective date of September 15. It would replace “Duration of Status” (D/S)—the designation under which qualifying nonimmigrants generally remain for the duration of their authorized program—with an admission end date. Under the planned framework, qualifying students and exchange visitors would need to seek an extension to stay beyond that date.

University guidance describes the proposed F- and J-category admission period as tied to the program end date and capped at four years, plus a grace period. The rule also includes extension procedures and other academic-mobility provisions. Those are descriptions of what the rule would do if it takes effect, not changes currently in force while the court’s postponement remains operative. - J visas: exchange visitors, including researchers, professors, or instructors at U.S. colleges and universities.
- I visas: foreign press representatives.
The University of Alabama’s summary also addresses F- and J-category dependents and implementation provisions. The rule should not be described broadly as a restriction on all international student visas.
What international students should understand now
Harvard’s International Office said on September 14 that while the court order is in place, the Duration of Status designation remains intact and the rule has no impact on visa status. The office also noted that the order is not permanent and can be appealed. The appeal was filed on September 30. For students and exchange visitors, the practical distinction is between the rule’s possible future requirements and the present effect of the court order. The appeal is a challenge to the pause; it is not a decision that changes an individual’s status. People with questions about their own immigration records should consult their school’s international office or an immigration lawyer rather than infer an individual outcome from the case’s procedural status.

Vanderbilt’s international office reported that a hearing to discuss next steps was scheduled for October 2, 2026. Its update does not state what happened at that hearing or report a later First Circuit decision. The available updates therefore establish that the government appealed and that a hearing was scheduled, but not the hearing’s outcome or any subsequent appellate action. Until a later court action changes the posture, the key questions are whether the First Circuit will alter the district court’s postponement and how the underlying challenge to DHS’s rule will be resolved. An appeal alone does not answer either question.
