Ireland’s Section 3 rape-shield law restricts questions and evidence about a complainant’s sexual experience, but it does not prohibit them outright: a judge may allow them. In an editorial published on 2 October 2026, the Irish Examiner argues the provision is not protecting complainants as intended and calls for clearer rules, effective legal representation and transparent monitoring. Those are the editorial’s proposals, not changes already made to the law.
What Section 3 of Ireland’s rape-shield law does
Section 3 of the Criminal Law (Rape) Act 1981 establishes a general restriction on evidence or cross-examination about a complainant’s sexual experience, except experience related to the charge, at a relevant sexual-assault-offence trial. The judge can grant leave for such evidence or questioning, so the provision is not an absolute ban. The revised statutory text records subsequent amendments and the section’s application to sexual-assault trials.
The current framework also provides for separate legal representation when an application is made to question a complainant about prior sexual experience. The Department of Justice says 2024 legislation extended that right to sexual-assault trials. This safeguard exists alongside the judge’s role in deciding whether the proposed evidence or questioning may proceed.
What the Maynooth study found—and what it cannot establish
Sinéad Ring, Associate Professor of Law at Maynooth University, authored Sexual Experience Evidence in Irish Rape Trials, which the university describes as the first qualitative study of Section 3. It draws on 21 in-depth interviews with barristers, solicitors, policy specialists, court accompaniment workers and Legal Aid clerks. Rape Crisis Ireland supported the independent academic report.

As summarized by the Irish Examiner, the report identifies continued use of assumptions that prior consent predicts later consent, or that sexual experience undermines credibility. These are findings reported from qualitative interviews, not a population survey or a count of courtroom outcomes.
What the 39% figure means
Maynooth University’s 2026 summary says that at least 39% of sexual-offence trials involved an application in 2025 to introduce sexual-experience evidence. The figure counts applications, not applications granted or cases in which the evidence was admitted. The editorial says data on how many applications succeeded are unavailable, so an admission rate cannot be calculated from this statistic.

Why the editorial calls for reform
The Irish Examiner argues that the law’s stated restriction is not enough if complainants still face questioning shaped by assumptions about consent or credibility. Its editorial calls for Section 3 to be repealed and replaced with clear admissibility limits, effective representation for complainants and transparent monitoring of decisions. These are recommendations, not enacted reforms.
The argument sits alongside the accused’s fair-trial rights: the issue is how courts assess whether particular evidence is admissible while also protecting a complainant’s dignity and privacy. The editorial puts its concern plainly: “A victim’s private life offers no excuse for abuse, and smearing them must provide no route around accountability.” That is the newspaper’s wording, not a quotation attributed to an individual.
