The Allahabad High Court’s Lucknow bench has opened a separate public-interest case on noise pollution after seven-year-old Class 2 student Vaishnavi Tiwari fell ill at a Balrampur school during a nearby Ganesh immersion procession and later died. The court has expressly said it has not determined what caused her death. The family linked the incident to loud DJ music; that allegation is still distinct from an established medical cause.
What happened at the Balrampur school?
Reports said Vaishnavi became unwell at Divine Public School at about 11 a.m. on September 22, 2026, while a Ganesh immersion procession playing loud DJ music passed nearby. Teachers took her for medical care, and she later died. CCTV footage was reported to show her becoming unwell, but footage of the sequence cannot establish the medical cause. Hindustan Times and NDTV reported the incident.
Did loud DJ music cause the girl’s death?
That has not been established. The family alleged that loud sound and vibration triggered the medical emergency. Police cautioned against drawing that conclusion before a medical investigation, and the High Court said explicitly that it had reached no conclusion on the cause of death.
The district administration formed a medical committee led by Chief Medical Officer Dr Mukesh Rastogi to reconstruct the sequence and review available medical records, treatment papers and clinical findings. The committee’s reported findings said no medical evidence had then emerged directly linking the DJ sound to the death. The cited reports do not provide a final committee report or final medical cause. India Today reported on the inquiry.

Police arrested DJ owner Chandra Prakash Verma and operator Rampal Saini after an FIR. An arrest is a procedural step in an investigation; it is not a finding of guilt and does not establish medical causation.
What has the High Court directed?
On September 28, 2026, while hearing an existing noise-related public-interest litigation, the Lucknow bench of the Allahabad High Court considered an application by amicus curiae senior advocate Gaurav Mehrotra. It directed the Registry to register a separate suo motu PIL titled “Noise Pollution and Compliance of Statutory Provisions in this Regard by the Authorities Concerned.”

The bench sought reports from the Balrampur District Magistrate and Superintendent of Police and directed that the school be served so it could assist the court. The separate PIL was listed for October 12, 2026; the existing noise-related PIL, case number 15385 of 2021, was listed for October 9. Those were future hearing dates as of the latest cited reporting on October 3, 2026, and do not establish what happened at either hearing.
As reported by Hindustan Times, the bench said: “We have not drawn any conclusion as to the cause of death of the child, but the fact that loudspeakers or music instruments were being played at a very high pitch and immediately thereafter, the child collapsed in the classroom persuades us to take cognisance of the matter as noise pollution is now becoming a menace.” The court’s action is about noise pollution and statutory compliance—not a ruling that the music caused the death or that any party is liable.

Hindustan Times also reported the bench saying that people who violate statutory provisions “have to be made accountable,” and expressing the hope that the child’s parents and school would not be pressured or subjected to unnecessary interference. These are reported court remarks, not a determination of liability in this case.
What do India’s noise rules say about schools and loudspeakers?
The national Noise Pollution (Regulation and Control) Rules, 2000 set ambient noise standards according to area category and place responsibility on the relevant authorities to enforce noise-control measures. They also require written permission to use a loudspeaker or public-address system. The rules are part of the framework under the Environment (Protection) Act, 1986, which the High Court referred to in taking up the issue. The rules allow a State Government to declare an area extending at least 100 metres around an educational institution a silence zone. That does not mean every school is automatically one. Whether Divine Public School or the surrounding area had been formally designated a silence zone is not established in the cited reporting; a specific claim requires confirmation of the relevant state or local designation.

- The medical cause of Vaishnavi’s death and whether any sound exposure contributed to it.
- The medical committee’s final findings and the outcome of the police investigation.
- Whether the procession’s loudspeaker use had written permission, and whether any applicable noise limits were breached. The cited reports provide no measured sound level.
- Whether the school’s vicinity had been formally designated a silence zone.
- What district officials report to the High Court and what directions, if any, the court issues in the pending proceedings.
The court’s stated concern is broader than the unresolved cause of this one death: who is responsible for curbing noise and whether current measures are sufficient. The proceedings may address compliance monitoring and public awareness, but those are questions before the court, not findings already made.
