On September 30, 2026, U.S. District Judge Amit P. Mehta dismissed amended antitrust complaints by Chegg and Penske Media Corporation, along with affiliated publishers, against Google. The ruling rejected the complaints as legally insufficient; it did not decide whether Google infringed copyright or whether every use of publisher content in AI systems is lawful.
What the judge dismissed
The cases were filed in the U.S. District Court for the District of Columbia. Chegg’s action concerned online educational publishing; Penske Media’s plaintiffs included Rolling Stone, Billboard, Variety, The Hollywood Reporter and Deadline.
The publishers alleged that Google conditioned access to search referrals on allowing it to crawl and reuse their work. They identified snippets, language-model training and retrieval-augmented-generation answers as alleged uses. They argued that AI answers compete with publisher websites and can reduce visits supporting advertising, subscriptions and other revenue.
Both lawsuits asserted federal antitrust theories, including reciprocal dealing and monopolization-related claims. They also included California unjust-enrichment claims. Judge Mehta dismissed the federal claims and declined supplemental jurisdiction over the state claims.

Why the antitrust complaints failed
The pleadings did not show an agreement
The publishers proposed that an implied bargain existed: they supplied content, and Google supplied search traffic. The court found that the complaints did not plausibly allege a written or oral agreement, or essential terms such as price or quantity.
Publishers make content available for crawling because they want to appear in search. In the court’s formulation, that expectation alone does not establish a reciprocal-dealing contract. Judge Mehta wrote: “Plaintiffs have pleaded only that they have an ‘expectation’ that Google will send them search traffic if they make their content available for free. But an expectation is not an agreement. It is simply how a general search engine works.”
This conclusion concerns the allegations in these lawsuits. It does not mean that a separately negotiated content arrangement with Google could never constitute an agreement.

The publishers lacked antitrust standing for the general-search theory
The court rejected the argument that the publishers were participants in the general-search market as suppliers of content or purchasers of traffic. It characterized the alleged uncompensated content and lost subscription revenue as injuries in digital-publishing markets, rather than injuries suffered in general search.
The opinion also noted a conceptual problem: the complaints treated search traffic as both the consideration publishers supposedly supplied to Google and the product they purchased from Google.
The proposed markets were too broad or vague
Penske Media’s proposed market covered nearly all text-based content available online. The court found that definition implausibly broad because the complaint did not explain why materially different works—such as a blog post, legal brief, fictional story and news article—should be treated as substitutes.
Chegg’s proposed online-educational-publishing market was also insufficiently explained. The complaint did not adequately show how curation, verification, authority and pedagogical focus separated educational content from other nonfiction for antitrust purposes.
The state claims fell with the federal case
After dismissing the federal claims, the court declined to exercise supplemental jurisdiction over the California unjust-enrichment claims and dismissed those claims as well.

Why the decision matters for Google AI Overviews
The ruling removes these particular antitrust complaints at the pleading stage. It does not settle the broader dispute over whether search companies can reuse publisher material in snippets, retrieval systems or generated answers without compensation.

For publishers, the practical issue remains how AI answers may affect referral traffic, advertising and subscriptions. For Google, the decision confirms that ordinary search participation and an expectation of traffic were not enough, on these pleadings, to create the antitrust agreement the plaintiffs needed.
Judge Mehta acknowledged the consequences for publishers while emphasizing the limits of the court’s role: “The court does not treat Plaintiffs’ alleged harms lightly. Nor is it unsympathetic to the situation publishers now find themselves in, and the knock-on consequences to journalists, educators, and other online creators whose content Google takes and repurposes without compensation.” He added: “The court is bound to apply the law only as it is written, not how the court or any party believes it ought to be.”

The legal theory and procedural stage are decisive. These were antitrust cases challenging search practices, alleged reciprocal dealing and market power. A copyright case directly challenges copying, training, output or other uses of protected works. A motion-to-dismiss ruling tests the sufficiency of pleaded facts; it is not a merits verdict after discovery and trial.

Accordingly, describing this dismissal as permission to train AI on copyrighted content would be inaccurate. Related publisher-AI cases must be evaluated separately for their claims, challenged conduct, court rulings and procedural posture.
