The order blocks unauthorized technology that interacts with or emulates WhatsApp, WhatsApp data collection, reverse engineering, account creation, and related access to customers. It is not a worldwide ban on Pegasus, a ban on every spyware deployment, or an automatic compensation program for individual users.
NSO appealed, but the district court refused to pause the injunction. As of August 2026, the injunction remains in force while the appeal and post-judgment disputes continue. WhatsApp has also asked the court to hold NSO in contempt over alleged 2026 phishing activity; that request is not itself a contempt finding.
What the November 2025 injunction actually prohibits
The operative order applies to NSO Group Technologies Limited, Q Cyber Technologies Limited, their officers, agents, employees and people acting in active concert or participation with them. Without WhatsApp’s express written permission, those covered parties may not:
- Develop, use, sell, offer, distribute, transfer or license technology that interacts with or emulates any aspect of the WhatsApp platform.
- Use such technology as an installation vector.
- Collect, or help another party collect, data from WhatsApp.
- Reverse-engineer or decompile WhatsApp code.
- Create WhatsApp accounts directly or through intermediaries or proxies.
The order also requires covered parties to delete or destroy covered code and technology, delete WhatsApp-derived data in their possession, and disable customer access to covered technology. The court retained jurisdiction to enforce the order and decide future compliance disputes. Read the permanent injunction.

Who is—and is not—bound
The order is directed at NSO, Q Cyber, their covered personnel and collaborators. It does not define foreign sovereign customers or outside counsel as “Prohibited Parties.” That distinction matters: the injunction restricts NSO’s conduct and that of specified collaborators; it does not directly order every government that may have licensed Pegasus to stop using it.
How the WhatsApp lawsuit began
WhatsApp and Meta sued NSO in the Northern District of California on October 29, 2019. WhatsApp alleged that NSO exploited WhatsApp infrastructure and a vulnerability in the service to help deliver Pegasus to target devices. The campaign was reported to have targeted more than 1,000 users; Meta described approximately 1,400 affected WhatsApp users, including journalists, human-rights defenders, diplomats and civil-society figures. What Pegasus can do
Meta described Pegasus as spyware capable of covertly compromising phones and extracting information from installed apps, including location data, email and text messages, while potentially activating a device’s microphone and camera. Capabilities vary by deployment and configuration; these are capabilities described by Meta and trial evidence, not a guarantee that every Pegasus installation has every function. Meta’s account of the verdict and evidence also notes that Pegasus has used installation methods involving browsers, operating systems and other applications, not only WhatsApp.
From the 2019 campaign to the 2025 judgment

The May 2025 verdict announcement should not be collapsed into the November injunction: damages, post-trial proceedings and injunctive relief were separate stages.

Why the court imposed a permanent injunction
The court applied the conventional four-factor test: irreparable injury, inadequacy of monetary damages, balance of hardships and the public interest. It concluded that WhatsApp and Meta met that standard. The court also considered the U.S. government’s prior determination that NSO’s activities were contrary to U.S. foreign-policy and national-security interests; that background is context, not the legal basis for every part of the private lawsuit. In refusing a stay, the court emphasized that liability rested on NSO’s own conduct—developing Pegasus, supplying it, training and supporting customers, and apparently updating it to circumvent WhatsApp security fixes—not merely on downstream acts by foreign customers. Read the stay decision.

What the ruling does not mean
- It is not a worldwide Pegasus ban. The order targets specified WhatsApp-related conduct by NSO and covered parties.
- It does not outlaw all commercial spyware. A Pegasus operation using another route, such as a browser or operating-system exploit, is not automatically covered unless it also involves prohibited WhatsApp-related conduct.
- It does not directly bind every NSO customer. Foreign sovereign customers are not defined as prohibited parties in the order.
- It does not compensate every potentially targeted person. This is an enforcement remedy for WhatsApp and Meta, not an individual claims or payment program.
- It does not make WhatsApp invulnerable. Users can still face phishing, account takeover, SIM swapping, malicious apps and unrelated device compromises.
Appeal status and continuing enforcement
NSO and Q Cyber pursued a Ninth Circuit appeal and asked the district court to stay the injunction. The court denied that request, finding no strong showing that NSO was likely to succeed and concluding that the public-interest factors weighed against a stay. The injunction therefore remains operative while appellate proceedings continue, unless an appellate order changes that status. The June 2026 contempt dispute
On June 8, 2026, WhatsApp said it disrupted spear-phishing attempts linked to NSO. According to WhatsApp, the activity involved malicious links leading to external websites and efforts to create test accounts and groups on WhatsApp. WhatsApp asked the federal court to hold NSO in contempt of the injunction. This activity is technically different from the 2019 allegations. The earlier case centered on alleged exploitation of WhatsApp technology to help deliver Pegasus. The 2026 report describes social engineering and spear-phishing. Receiving a malicious link, or seeing a test account, does not by itself prove that Pegasus was installed or that a device was compromised.
What WhatsApp users should do
- Keep WhatsApp, iOS or Android, browsers and other software updated.
- Do not open unexpected links, even when they arrive through a familiar service.
- Verify urgent requests through a separate, trusted channel.
- Use strong device locks, account protections and available multi-factor security features.
- If you receive a credible spyware alert or are a high-risk target, seek specialist incident-response help. Do not assume ordinary consumer antivirus software can detect a sophisticated commercial implant.
End-to-end encryption protects messages in transit, but it cannot protect data already exposed on a compromised device.
Why the case matters beyond WhatsApp
The judgment shows how a platform operator can use civil litigation and injunctive relief to restrict a surveillance-for-hire vendor’s access to its service. It also shows the limits of that strategy: a U.S. order against a company and its covered collaborators does not automatically control foreign governments, eliminate other infection routes or eradicate commercial spyware. Legal deterrence, technical disruption and international enforcement remain separate problems.
