FinanceBuzz’s list, updated October 1, 2026, identifies nine behaviors that can prompt a restaurant to refuse service or remove a guest. Number five is causing a scene. These are practical examples, not a universal legal test: rules and legal requirements vary by location and circumstances.
1. Being extraordinarily rude to staff
Disagreeing with a bill or raising a concern is not the same as berating, threatening, or repeatedly abusing employees. A restaurant may intervene when a guest’s conduct makes it difficult for staff to serve people safely or respectfully.
2. Displaying discriminatory behavior
Slurs, harassment, or demeaning treatment directed at staff or other guests can make the dining room hostile and disrupt service. The National Restaurant Association’s hospitality guidance recommends that restaurants set clear expectations, train staff to respond to abusive conduct, and act promptly—while also cautioning employees to account for unconscious and affinity bias rather than making assumptions about a guest.
3. Stealing restaurant property
Taking items that belong to the restaurant, rather than mistakenly leaving with something, can lead staff to ask a guest to leave and may raise legal issues. The FinanceBuzz list treats theft as a reason a restaurant may remove a customer; the specific consequences depend on what happened and local law.

4. Having too many drinks
Visible intoxication can create safety concerns for the guest, employees, and other diners. In Florida, for example, the 2026 statute governing public food-service establishments includes intoxication among the grounds relevant to refusal or removal. That is a Florida-specific rule, not a nationwide standard.
5. Causing a scene
This is the behavior the headline singles out, and it can cover more than a dramatic confrontation. Shouting, picking fights, disturbing nearby diners, or otherwise disrupting the room may prompt staff to intervene. Florida’s 2026 law lists disturbing the peace or comfort of other guests, disorderly conduct, nuisance, profanity, lewdness, and brawling among relevant grounds. Other jurisdictions may define the rules differently.

6. Violating a dress code
A restaurant may have a dress code, but the practical question is whether the rule was clearly communicated and applied consistently. A disagreement over attire is different from conduct that threatens or harasses someone, and any decision must still comply with applicable law.
7. Letting children cause chaos
Children are welcome in many restaurants, but a parent or guardian is responsible for addressing behavior that disrupts other tables or creates a safety risk. Staff may ask a family to settle the situation or leave if it continues.

8. Bringing outside food
Restaurants may restrict food brought in from elsewhere, particularly when it interferes with service or conflicts with house rules. If someone in your party needs an exception, asking staff before unpacking outside food is more likely to resolve the issue calmly.
9. Bringing a dog the restaurant does not allow
FinanceBuzz distinguishes between service dogs and other dogs, which it says are at the restaurant’s discretion. Do not treat that summary as a complete statement of access rights: rules and accommodation obligations can depend on the circumstances and applicable law. If you need to bring an animal, check with the restaurant and consult the relevant official guidance for your location.

What restaurants can do—and where the limits are
A restaurant’s ability to refuse service or ask a guest to leave is not a blanket right to remove anyone for any reason. Florida’s 2026 statute offers a specific example: it identifies conduct-related grounds and sets out notice and departure procedures, while prohibiting covered decisions based on specified protected traits. It does not establish a national rule. The law in another state or country, as well as the facts of a particular incident, may lead to a different result. De-escalation is useful when it can be done safely; it does not require employees to tolerate abuse or put themselves in danger. The National Restaurant Association’s January 20, 2022 guidance, written in the context of COVID-era policy disputes, advises staff to recognize disruptive behavior early, communicate calmly, listen before explaining a requirement, keep a disagreement as private as practical, maintain space if threatened, seek help when needed, and follow established policy. Its hospitality guidance separately urges clear responses to racist, sexist, or demeaning conduct and warns against biased assumptions.

For serious safety incidents, the Association’s September 4, 2026 public-safety guide emphasizes preparation, employee training, protocols that prioritize life safety and coordination with first responders, and careful documentation and recovery. Association President and CEO Michelle Korsmo said, “For restaurant operators, safety preparedness is good business.”

- Raise complaints calmly and give staff a chance to address them.
- Follow clearly communicated house rules, including policies on attire and outside food.
- Keep children and other members of your party from disrupting nearby tables.
