Some agencies expressly include online material in background investigations, but practices differ: a social-media presence alone is not evidence of unsuitability, and no single rule describes every U.S. department. Check the hiring agency’s current instructions, answer application questions honestly, and do not assume that either a private profile or a controversial post will be treated the same way everywhere.
1. Bias-related posts may raise suitability concerns
For peace-officer hiring in California, the Commission on Peace Officer Standards and Training (POST) says a social-media check may identify evidence of bias-related behavior, traits, or attributes. The agency is expected to relate relevant findings to suitability for peace-officer employment, rather than treating every post as an automatic disqualification. POST also says information protected under fair-employment laws, and information unrelated to suitability, should not be provided to employers. A lawful political opinion, protected characteristic, or mere association is not the same thing as evidence of biased conduct. Meaning, context, and the connection to the role matter; do not assume that a viewpoint alone establishes how an agency will assess an application.
2. Evidence of illegal or otherwise unsuitable conduct may matter
California POST describes potentially relevant results as including illegal or immoral behavior, as well as other behavior that may indicate unsuitability. Those are examples of screening considerations, not a universal or exhaustive list for every employer. The practical question is whether material is authentic and relevant to the duties and trust involved in the job—not whether an account contains something an observer finds disagreeable. Agencies’ rules and assessments can differ.
3. Context, patterns, and time can change how material is read
A post is not always evaluated in isolation. California POST says the depth of a search may depend on circumstances: evidence of unsuitable conduct can prompt a longer review to assess patterns, while agencies should treat candidates consistently. California Department of State Hospitals policy provides a concrete example of case-by-case considerations. It lists the person’s age at the time, time elapsed, any pattern, severity, likely consequences, recurrence, relevance to public-safety employment, and aggravating or mitigating factors. 4. Public visibility and private-account boundaries are not the same everywhere
California POST says a peace-officer social-media check may search candidate postings wherever they appear, including social-networking sites, blogs, and forums. It also says the check does not require or permit infringement of privacy rights. POST’s FAQ notes that whether California Labor Code section 980 applies to public-sector employers is unsettled; that statement is not a definitive answer about every agency or situation. Other published policies illustrate different boundaries. California Department of State Hospitals bars its hiring coordinator from requiring passwords, account information, or access to password-protected social accounts. The Georgia Bureau of Investigation example in the federal guide says applicants are notified, passwords are not used, private profiles are not accessed, and only public-domain information is searched. 5. Verification and filtering can shape what decision-makers see
California Department of State Hospitals policy calls for open-source results to be accurate, verified, and validated, and for potentially impermissible information to be withheld from selection decision-makers. California POST likewise says reported results should be limited to information relevant to suitability and should not include protected information. A 2022 California State Auditor review shows why it is unwise to assume that a written process guarantees uniform practice. The auditor examined five departments and five hiring decisions per department. Of the reviewed officers with public social-media accounts, one applicant account contained biased content when the auditor conducted its review; the auditor could not determine whether departments had seen or considered it during their background investigations. What applicants should do
- Read the hiring agency’s current application and background-investigation instructions, and ask the agency about its process if the instructions are unclear.
- Be accurate and candid when answering application questions. Do not assume that deleting content or changing account visibility changes what you are required to disclose.
- Do not volunteer passwords or private-account access based on a general assumption that every department requires it; published examples and applicable rules vary.
- If asked about specific online material, be prepared to explain its context honestly, including when it was posted and any relevant changes since then.
Washington state provides one example of an explicit rule: WAC 139-07-020 lists review of social-media accounts among required background-check information. California POST provides detailed guidance for its peace-officer checks, while noting the unsettled question about Labor Code section 980 and public employers.
