The HOA State: What Florida Teaches America About Condo Associations—and Their Limits

Florida shows how private community rules can shape daily life—and how much those rules depend on what kind of association governs a home. A homeowners’ association (HOA) operates under Chapter 720 of Florida law; a condominium association operates under Chapter 718. The distinction affects owners’ rights, state oversight, and whether post-Surfside building-safety rules apply. The word “tyranny” captures a fear some owners may have, but the sources cited here do not establish that Florida associations are generally abusive. They do show why owners need to know the rules, records, and remedies attached to their particular property.

Why Florida is a useful case study

Association rules can govern more than shared amenities. Depending on the property and governing documents, they can shape assessments, maintenance, meetings, records, and decisions about common areas. Florida makes the stakes especially visible because its laws treat HOAs and condominium associations as distinct legal regimes, while reforms after the 2021 Champlain Towers South collapse added specific safety and reserve obligations for condominiums.

That is a useful lesson for readers elsewhere, not proof that every state—or every Florida community—works the same way. Association law varies by jurisdiction, and the Florida rules described here should not be assumed to apply outside Florida.

HOA versus condo association in Florida

The everyday label “HOA” is often used loosely, but Florida’s statutes make the legal distinction consequential. The Florida Senate staff analysis of Chapter 720 describes HOA membership as mandatory with parcel ownership and notes that assessments may become liens. Chapter 720 sets statutory procedures and minimum requirements, while the association’s governing documents also define its powers and duties. For condominiums, Chapter 718 governs.

State oversight described in the sources Direct state oversight is limited. DBPR’s Division of Condominiums, Timeshares and Mobile Homes has consumer-protection functions, and Miami-Dade County’s 2025 report describes DBPR authority over condominium associations under Chapter 718.
Post-Surfside inspections and structural reserves Condominium-specific requirements should not be assumed to cover every Chapter 720 HOA. Florida condominium laws include milestone inspections and structural integrity reserve studies; details depend on the applicable law and circumstances.

The table summarizes the sources’ general distinctions, not a ruling on any particular property. An association’s legal classification and governing documents matter; the term used in a listing or conversation may not settle the question.

What an HOA board can do—and what owners can access

Florida Statute 720.303 says HOA officers and directors have a fiduciary relationship to members. It also establishes meeting and official-record requirements. Board meetings are generally open to members, who may attend and speak on designated agenda items. Members, or their authorized representatives, may inspect and copy official records under the statute’s rules and timeframes.

Use records access as a practical first step

If a decision, charge, or procedure is unclear, identifying the relevant association records can help establish what happened and which rule was used. Make a focused written request that identifies the records you seek and keep a copy of the request and any response. The statute permits portable devices—including smartphones, tablets, and scanners—to make electronic copies. A scanner is optional; it is not a legal requirement.

Keep the boundary between owner and board clear

Access to meetings and records does not mean an individual member can make decisions for the association. Florida Statute 718.111 expressly states that a condominium unit owner does not act for the association merely by owning a unit. For HOAs, the statute and governing documents define the board’s powers and the member procedures that apply. The right to participate is not the same as authority to direct association business.

Where Florida HOA complaints can go

The route depends on the association type and the nature of the dispute. The Florida Senate staff analysis says no state agency directly regulates HOAs, while describing a DBPR role in consumer protection for certain regulated communities. Miami-Dade County’s 2025 report describes DBPR jurisdiction over condominium associations under Chapter 718 and cooperatives under Chapter 719; for HOAs, it describes DBPR jurisdiction as limited to election disputes. The county report says other HOA complaints are not subject to government investigation under the framework it discusses, and that members may need to litigate or use private mediation.

Those descriptions are not a universal answer to every complaint. A dispute about records, an election, a condominium safety obligation, or an assessment may involve different statutes and procedures. Check the current statute and the governing documents for the specific association, and get Florida legal advice when the stakes or deadlines matter. Do not assume that filing a general complaint with a state agency will resolve an HOA dispute.

How Surfside changed condominium obligations

The June 2021 partial collapse of Champlain Towers South in Surfside killed 98 people, according to the Associated Press’s 2025 reporting. The disaster became central to Florida’s condominium safety reforms, but those reforms are not a blanket set of rules for every association that people casually call an HOA.

Inspections and structural reserve planning

Florida DBPR’s condominium resource page describes four condominium-related laws enacted since 2022. It says the 2022 SB 4D measures included milestone inspections, structural integrity reserve studies, funding for future structural repairs, and disclosure of inspection and study information. These requirements sit within the condominium framework; they should not be projected onto all Chapter 720 homeowners’ associations.

What HB 913 changed

HB 913 became law on July 1, 2025, as the fourth law in the series described by DBPR. The 2025 law revises reserve-funding provisions and allows specified options—including member-approved special assessments, lines of credit, or loans—in particular circumstances. It also authorizes board and unit-owner meetings by video conference under statutory conditions and requires recordings of video meetings to be kept as official records.

These options change parts of the funding and governance framework; they do not erase applicable safety obligations. Whether a particular association can use a funding option depends on the statute’s conditions and the facts of that community.

Why owners may feel the rules in their budgets

Safety obligations can have household-cost consequences when associations need to inspect, repair, or fund structural work. In its April 30, 2025 report, the Associated Press described condominium owners facing higher costs under the 2022 safety framework and reported on lawmakers’ effort to revise it. That is evidence of cost pressure, not a verified statewide average for assessments, insurance increases, or monthly fees. Costs will depend on the building, its needs, the association’s finances, and the rules that apply.

A practical checklist for owners

  • Identify the legal regime. Determine whether the property is governed as an HOA under Chapter 720 or a condominium under Chapter 718.
  • Read the governing documents. The statute sets legal requirements, but an association’s documents also matter to its powers, duties, and procedures.
  • Use meeting and records rights deliberately. For an HOA, consult Florida Statute 720.303 on open meetings, speaking on designated agenda items, and official records. For a condominium issue, consult Chapter 718 and the applicable association documents.
  • Match the complaint to the remedy. The agency route differs by association type and issue. Miami-Dade County’s 2025 report describes limited DBPR jurisdiction for HOAs, rather than general investigation of all HOA complaints.
  • For condominium safety or funding questions, check the current law. Florida’s post-Surfside framework changed, including through HB 913 effective July 1, 2025; a general article cannot determine which requirement or funding path applies to a particular building.

What the rest of America can learn

Florida’s experience illustrates a broader tension: owners may be subject to private association rules while relying on state law to set procedural rights, fiduciary duties, safety requirements, and dispute channels. The practical safeguard is not to treat every association as the same kind of institution. Know which legal structure governs the property, what owners can inspect or attend, and which public or private remedy fits the issue. Florida’s post-Surfside reforms also show that association governance can become a building-safety matter, not just a disagreement about rules or fees.
