That growth has sharpened attention on statewide expansion—but “statewide” can mean two different things: the court’s geographic framework covers the state, while only five of its eleven divisions were operating in the latest official report.
What does “statewide” mean for the Texas Business Court?
The Texas Judicial Branch describes it as “a statewide, specialized trial court created to resolve certain complex business disputes.” The statewide label refers to its geographic judicial framework, not to all planned divisions already being open. As of the court’s April 2026 report, five of the framework’s eleven divisions were operational: Dallas, Austin, San Antonio, Fort Worth and Houston. The court’s current pages list those same five locations.
So the court is statewide in design, but its operational footprint remains smaller than its full division map. The distinction matters when interpreting calls for expansion: the debate is about bringing the remaining divisions into operation, not about whether the court’s remit is limited to one city.
How quickly did the court build a caseload?
Established by H.B. 19, the court began receiving cases on September 1, 2024. Its first fiscal year ran from September 1, 2024, through August 31, 2025, and the FY2025 annual report counted 185 filings. That total included original petitions and cases removed from state district courts; it is a first-year figure, not the lifetime total.

The court’s April 2026 Mid-Year Report counted 409 cumulative cases filed through April 30, 2026, of which 221 were active and pending on that date. The report also recorded an average of 27 filings per month in FY2026 through April, compared with 16 per month in FY2025. The FY2026 rate is a period-to-date comparison only; it should not be projected across the rest of the fiscal year.
Activity extended beyond filings. Through April 2026, the report counted 82 written opinions, more than 2,200 orders and more than 700 hearings and conferences during the report’s period.

What kinds of disputes were filed?
In FY2025, corporate-governance jurisdiction was the most frequently pleaded basis, appearing in 145 filings. Qualified-transaction jurisdiction appeared in 75, while certain statutory or regulatory claims appeared in 10. These categories overlap: a case could invoke more than one basis, so the counts do not add up to the 185 total.
The annual report said most actions concerned energy, real estate, technology or financial industries. That provides a picture of the disputes reaching the court, but the figures describe pleaded jurisdictional grounds and industries—not a mutually exclusive census of case types.

What did the 2025 expansion legislation change?
H.B. 40 revised the court’s framework after its early months of operation. Its legislative analysis cited experience with jurisdiction, procedure and operations; it also described appointments to the remaining six divisions and additional judges for the First and Eleventh divisions. The Senate Research Center’s bill analysis reported that, in the first six months, the court had handled more than 80 cases across a wide range of civil business matters.
Those provisions established a path and made refinements; they did not mean every division was immediately operational. The official April 2026 report still counted five operating divisions. For the governing categories of civil jurisdiction and reporting requirements, consult the current text of Texas Government Code Chapter 25A; jurisdictional details can change with amendments.

What the numbers do—and do not—show about expansion
The upward filing figures show that the court handled a growing volume of matters during the periods reported. They help explain why statewide operations and the remaining divisions are receiving attention. But the totals alone do not establish that expansion caused the increase, that every planned division is needed, or that the same filing pace will continue. The April 2026 report is a dated snapshot, while the annual and mid-year figures use different reporting windows.
For readers assessing the current status, the clearest indicators are concrete: 409 cumulative filings and 221 active and pending cases as of April 30, 2026, alongside five operating divisions out of eleven. The court’s reports and official pages provide the basis for those counts; future operational changes should be checked against updated court information.
