A Brookside, Alabama police chief is reportedly taking the town’s mayor and council to court over a plan to abolish the municipal police department. The filing’s accessible synopsis does not identify the chief, name the court, or explain the legal claims or requested relief, so those details remain unconfirmed.
Why Brookside is considering closing its police department
The town says it is reviewing its finances, government structure and long-term public-safety needs after its insurer reportedly advised that it would not renew coverage if the police department continued operating. Officials are considering whether contracting with the Jefferson County Sheriff’s Office could be an alternative. The town’s position and the proposed county arrangement were reported by WBRC.
That is a stated reason for considering closure, not proof that the department has already shut down or that a replacement contract has been approved. WBRC reported that the council was scheduled to discuss the issue on October 5, 2026; the report does not establish what action, if any, the council later took.
What is known about the chief’s lawsuit
An October 3, 2026 indexed headline says the chief is taking the town to court to stop the proposed closure. The accessible synopsis does not establish the chief’s identity, filing date, court, legal theory or requested remedy. It therefore does not support a more specific account of what the chief is arguing. The headline and limited synopsis appear in KhanList.

Do not confuse this reported dispute with an older case or assume the plaintiff is Michael Jones, a former Brookside chief mentioned in earlier reporting. The accessible information does not establish that identity.
What would have to happen in a department transition
Brookside says any transition would need to account for more than equipment and staffing. In a town release summarized by WBRC, officials said they would inventory police property and establish legal custody for records and other materials, while coordinating with courts, prosecutors and agencies about active matters.

WBRC reproduced the town release’s summary of its stated approach: “The town will carry out any transition in a manner intended to protect public safety, preserve evidence and official records, safeguard restricted funds, and address the rights of affected employees.” This describes the town’s stated intentions, not a completed transition plan.
How a sheriff’s service agreement would compare
A county service agreement is one option under consideration; keeping the municipal department is another if the town can resolve the insurance and financial constraints. The available reporting does not provide a finalized cost comparison, staffing plan, service-level terms, dispatch arrangements or response-time estimates. Without those details, it is not possible to conclude that either option would be cheaper or safer.

A different case, Coleman, et al. v. The Town of Brookside, Alabama, et al., is a federal class action brought by drivers represented by the Institute for Justice. It concerns allegations about fines, fees, traffic enforcement and towing—not the police chief’s reported challenge to the proposed closure.

The Institute for Justice says the town and plaintiffs submitted a proposed $1.5 million settlement and reforms in February 2026, and that a federal court granted preliminary approval on October 1, 2026. Preliminary approval is a step in the settlement process, not evidence that the chief’s case has the same claims or parties. The organization’s case page also says that around 49% of Brookside’s revenue in 2020 came from fines and forfeitures; that historical figure is the Institute for Justice’s account, not an independently audited figure established here. See the Institute for Justice case page.
