Generally, no: New York does not require an at-will employee to give two weeks’ notice or keep working after resigning. But a contract or union agreement can change the rules for a particular job, and the reported hotel exchange does not establish what terms applied to that worker.
What was reported—and what it does not establish
An October 2, 2026, Attack of the Fanboy report says a hotel pastry worker gave four days’ notice and her manager responded that he would start a two-week clock anyway. The report presents her reply as citing New York law. It does not establish the worker’s contract, union status, applicable benefit policy, or what happened afterward, so the general legal rule cannot resolve the details of her individual case. Is two weeks’ notice required in New York?
For an at-will employee, no. The New York State Department of Labor says an employee may leave at any time without defending or explaining the decision. Can a boss make you work two more weeks?
A manager’s statement does not, by itself, establish that an employee must keep working after resigning. Under the general at-will rule, an employee can leave. A contract restricting termination or a union agreement may set different terms, so check the agreement that actually covers the job before applying the general rule to a specific situation. What happens to final wages and unused vacation?
Wages for work already performed and unused vacation are treated differently under New York guidance.

The report about the pastry worker does not say the manager threatened to withhold wages. A dispute about vacation pay is a separate question from whether two weeks’ notice was legally required.

What to check if you are resigning
- Review any individual employment contract and, if you are represented, the applicable union agreement for resignation or termination terms.
- Read the written vacation or resignation policy to see whether it sets conditions for paying accrued vacation, including any notice requirement.
- Keep relevant agreements, policy documents, pay records, and communications if a dispute arises.
- If wages or a promised wage supplement remain unpaid, consult the New York State Department of Labor’s guidance on claims.
