Who has authority to write federal immigration statutes?
Congress is the federal legislature, and it enacts federal statutes through the constitutional lawmaking process. Its enumerated powers include establishing a uniform rule of naturalization, and the Necessary and Proper Clause supports laws carrying its constitutional powers into execution. The Constitution does not name one general immigration power in a single clause. The constitutional foundations of federal immigration authority are more complex: courts and legal analysis have discussed multiple constitutional sources.
The Library of Congress’s Constitution Annotated describes longstanding Supreme Court precedent as recognizing Congress’s “plenary” power over immigration—broad authority over whether noncitizens may enter or remain in the United States. “Plenary” describes the breadth of that doctrine; it does not mean Congress is free of all constitutional limits. Does the President make immigration law?
The President does not enact statutes alone. Article II vests federal executive power in the President and requires the President to take care that the laws are faithfully executed. Executive departments and agencies administer and enforce immigration statutes, and Congress can authorize officials to make decisions within statutory bounds. Those decisions can shape how the law works in practice, but implementation and enforcement are not the same as Congress changing the statutory text.

That distinction also means the Executive Branch is not simply a passive messenger: officials exercise authority and discretion where the law allows. The legal effect of a particular executive action depends on the authority claimed and the applicable statutes and constitutional rules. The Constitution Annotated explains the President’s executive role in its overview of Article II.
What do courts do?
Courts interpret statutes and resolve disputes about their meaning and constitutionality. They can assess whether government action falls within legal authority and whether constitutional protections apply. Immigration law is therefore subject to constitutional review; it does not operate outside the Constitution.

The scope and context of constitutional protections can vary. The Constitution Annotated explains that due-process safeguards apply to aliens within the United States, while the particular protections depend on circumstances. Its discussion of aliens in the United States provides more detail.

So, when someone asks who writes immigration law, the precise answer is that Congress enacts federal immigration statutes. The President and agencies administer them, sometimes making consequential choices under delegated authority, while courts determine how legal disputes are resolved. That division of responsibility answers the institutional question; it does not establish what any political group remembers or believes.
