The proposed October 6, 2026 interaction between Parliament’s One Nation, One Election (ONOE) committee and sitting Supreme Court judges was cancelled because the Court reportedly considered that the proposed amendment could later come before it for judicial review. That is a decision not to hold a meeting—not a Supreme Court ruling on whether ONOE is constitutional.
What meeting was cancelled?
The Joint Committee of Parliament examining the ONOE bills had planned an October 6, 2026 local study visit to the Supreme Court. Its circulated programme described an “informal discussion” on simultaneous elections with the Chief Justice of India and other judges. The Indian Express reported that the committee has 39 members and that the Lok Sabha Secretariat told members the visit was cancelled; its initial notice reportedly gave no reason. The Indian Express’s account of the cancellation reports the Court’s later-stated concern. A separate report describes the proposed programme and the committee chair’s account.
Those accounts do not present one agreed explanation for the cancellation. Committee chair P P Chaudhary told The Indian Express the visit was intended to familiarise members with the Court and its library, not to discuss the bill, and said other programmes were scheduled. The Federal reported that LiveLaw, citing sources, said the Supreme Court had declined the proposal. The Court’s reported communication gave a separate institutional reason for not proceeding.
Why did the Supreme Court decline?
In the communication quoted by The Indian Express, the Court said judges considered that “the proposed amendment might become a subject matter of Judicial Review” and that it “may not be expedient or desirable to discuss the issue on the administrative side.” It concluded: “The proposed meeting is accordingly cancelled. Inconvenience is regretted.” This wording is reported by The Indian Express; the official original was not independently available in the reporting cited here.

The concern is about the appearance and preservation of impartiality. If judges discuss proposed legislation with lawmakers and a dispute about that legislation later reaches the Court, observers could question whether the judges approached the case with an open mind. Opposition members, including Rajya Sabha MP and senior advocate Kapil Sibal, raised that concern. Sibal told a press conference, as quoted by The Indian Express, that courts determine a bill’s constitutionality after Parliament passes it and that he had not heard of a parliamentary committee meeting at the Supreme Court to explain a bill.
That criticism is an argument about judicial propriety, not a finding that the proposed meeting would have been unconstitutional. Nor does the cancellation decide the validity of the ONOE proposals.

What would the ONOE bills change?
The proposal is to align elections to the Lok Sabha and state legislative assemblies. The Constitution (One Hundred and Twenty-Ninth Amendment) Bill, 2024 would add Article 82A and amend provisions including Articles 83, 172 and 327. The accompanying Union Territories Laws (Amendment) Bill proposes related changes for the legislatures of Puducherry, Delhi and Jammu and Kashmir. The bills were introduced in December 2024 and referred to a Joint Committee of Parliament after a High-Level Committee chaired by former President Ram Nath Kovind recommended a framework in March 2024. The Federal’s report on the bills and constitutional context describes the proposed mechanism.
As described in that report, the proposed Article 82A mechanism would let the President bring the provision into force by notification on the date of the first sitting of the Lok Sabha after a general election. Assemblies elected after that appointed date and before the Lok Sabha’s full term expires would have terms ending with the Lok Sabha. These are proposals in bills, not changes already in force; their precise operation depends on the enacted text, if any.

What supporters and critics argue
Supporters cited in reporting say synchronised elections could reduce repeated election expenditure, repeated Model Code of Conduct periods and the diversion of administrative and political resources. These are arguments for the policy; the cited reporting does not establish a quantified saving.

- How the system would work if a government fell and an assembly or the Lok Sabha were dissolved early.
- Whether the change would affect federalism and the independent political mandate of state governments.
- What authority the proposed framework would give the Election Commission.
These questions concern the legislation’s design and constitutional implications. The cancelled meeting did not resolve them, and the cited reporting describes no Supreme Court decision on the bills.

The proposed visit was an administrative interaction, not a formal request for a judicial opinion. Article 143 of the Constitution provides a distinct route: the President may refer a question of law or fact of public importance to the Supreme Court. The Court decides what hearing it considers appropriate and, under Article 143(1), may decline to answer. The Federal describes this mechanism in its report on the proposal.

The Supreme Court’s 1997 Restatement of Values of Judicial Life, cited by The Federal, cautions judges in paragraph 8 against publicly expressing views on political matters or matters pending or likely to arise for judicial determination. Paragraph 1 addresses judicial conduct and public confidence in impartiality. Paragraph 8 specifically concerns public expression; it should not be read as an express prohibition on every private institutional conversation.
Why the cancellation matters—and what it does not settle
The episode highlights the boundary between Parliament’s work of considering legislation and the judiciary’s role if a legal challenge later asks it to assess that legislation. A committee may seek information while examining a bill, but a discussion with sitting judges about a live proposal can raise questions about future impartiality even if the meeting is described as informal or educational.
For now, the concrete outcome is limited: the planned visit did not go ahead after the Court reportedly judged discussion on the administrative side inadvisable because judicial review was possible. The bills’ merits, their effects on state assembly terms and the constitutional questions surrounding simultaneous elections remain separate matters for Parliament and, if a case is brought, the courts.
