State Sen. John Kane’s proposed Protect Our Games Act was still awaiting formal introduction as of October 3, 2026. If enacted as described in his September 18 co-sponsorship memo, it would require 60 days’ notice before a covered game’s use is discontinued or its features are changed, plus one or more specified remedies: offline access, an independent-play patch, or a qualifying refund.
Is the Protect Our Games Act law yet?
No. Sen. John Kane circulated a co-sponsorship memo on September 18, 2026, saying he intended to introduce the bill. The memo also states that it “has not been submitted for introduction yet.” Tom’s Hardware described the proposal as being at an early stage on September 28. It is therefore a proposal, not an introduced or passed bill, and it does not currently give players a legal right to a refund or an offline version. The Pennsylvania Senate memo is the primary source for the proposal’s terms.
What would publishers have to do?
Under the memo, a video game manufacturer intending to stop allowing use of a digital game or change its features would have to give purchasers 60 days’ notice. It would also have to provide “one or more” of the listed options—not necessarily all three to every purchaser.
- Enable offline use: Provide the ability to use the game without relying on the company’s online service.
- Provide an independent-play patch: Supply a patch that allows continued online use independently of the company’s online gaming services.
- Offer a qualifying refund: Refund an amount based on the game’s highest offered price during the 12 months before the company stops providing services for ordinary use. The amount could not be less than 25% of the game’s initial sale price.
These are proposed obligations, not guaranteed outcomes for players today. The memo does not establish which option a company would choose in a particular shutdown or feature change. Read the memo’s proposed requirements.

How would the proposed refund be calculated?
The refund would use the highest price at which the digital game operator offered the game during the 12 months before it stopped providing services for ordinary use. The refund also would have a floor: it could not be below 25% of the game’s initial sale price. Those are two parts of a proposed formula, not a current entitlement or a promise that every buyer would receive a refund.
Which games would be exempt?
The memo describes three exemptions. Their scope matters: it does not simply exempt every free-to-play game or every game that can be downloaded.

- Subscription access: Services that provide access to a game only for the duration of a subscription would be exempt.
- Games offered for free: Games provided for no monetary consideration would be exempt unless a player made purchases or invested money to upgrade characters or unlock features.
- Access the seller cannot revoke: Games would be exempt if the seller cannot revoke access after the transaction. The memo gives a permanent offline download to external storage, usable without an internet connection, as an example.
Who would enforce it?
If enacted, the proposal says Pennsylvania’s Attorney General and district attorneys would enforce the act. That describes a proposed enforcement mechanism; it is not a remedy available to players under a law currently in force.
Why is the sponsor proposing it?
Kane’s memo frames the issue as a difference between possessing a physical or offline copy and receiving a license to access a digital game, where continued access may depend on company decisions. The memo also cites a prospective 2028 end to Sony’s video game disc production as context. That is the sponsor’s stated rationale and should not be read as independent confirmation of Sony’s future plans. The memo is available from the Pennsylvania Senate.

What happens to digital-only games when servers go offline?
That depends on the game and its publisher. This proposal would create specified notice and remedy obligations if it became law and applied to a game, but it does not guarantee that every affected title could be preserved through offline play. The sponsor’s memo does not quantify how many games or players would be affected.
