What is the Safe Access to Cash Act?
S. 3798, the Safe Access to Cash Act, was introduced by Senators Ruben Gallego and Ted Cruz. The Congressional Record entry for February 5, 2026, describes it as a bill to amend Title 18 of the U.S. Code to establish criminal offenses involving ATMs regardless of whether a machine is on the physical premises of a financial institution. It was referred to the Senate Judiciary Committee. The ABA Banking Journal also reports that Representative John Rose introduced a House version.

What would the bill change for ATM robberies?
The ABA says the Bank Robbery Act currently does not cover ATMs in public locations. The bill’s stated purpose is to address ATM-related crimes regardless of where the machine is located, bringing off-site ATM robberies under the Bank Robbery Act framework. That distinction matters for standalone or publicly accessible machines that are not physically at a bank.

The reports describe this purpose in broad terms; they do not establish the bill’s precise offense elements or specific penalties. Those details should not be inferred from the bill’s summary.
Why do bankers and state attorneys general support it?
The American Bankers Association supports the measure, and the ABA Banking Journal reports that at least 15 state attorneys general also backed it. In an August letter, the attorneys general said criminals were increasingly targeting standalone and off-site ATMs, but the report does not provide a numeric crime trend or underlying dataset.

The ABA’s stated deterrence argument is that matching prosecution and penalties to bank robberies could make ATM users and machines less attractive targets. The ABA Banking Journal quoted the association’s letter to the bill’s sponsors: “By encouraging the prosecution of these crimes and enforcing the same penalties as bank robberies, we hope that individuals at ATMs and the ATMs themselves will be less attractive targets for crime.”
