On October 1, the U.S. Attorney’s Office for the Western District of Texas announced a federal charge accusing him of possessing a firearm with an obliterated serial number. The charge and the alleged threat are not proof of guilt.
What authorities say happened
The U.S. Department of Justice says the alleged threat was made on September 29. According to the criminal complaint as summarized in the DOJ announcement, Caldera told another person he was going to the Capitol and would “shoot it up.” Prosecutors also allege that he expressed anger toward the American Israeli Public Affairs Committee (AIPAC). These are allegations described in a criminal complaint, not findings established in court.
According to the DOJ account, the Texas Department of Public Safety received a report, obtained state arrest and residence-search warrants, and arrested Caldera at his home on September 30 with FBI assistance. The DOJ release says investigators allegedly found a loaded .357 revolver, a 12-gauge shotgun and six 9mm rounds. The complaint alleges that the revolver’s serial number appeared to have been filed off.
U.S. Attorney Justin R. Simmons said, “This defendant is in federal custody today thanks to a perceptive and concerned citizen seeing something and saying something.” The statement appeared in the DOJ’s October 1 announcement.

What the federal charge means
The charge announced by federal prosecutors is possessing a firearm with an obliterated serial number. The DOJ release said that, if convicted, Caldera could face up to five years in prison. That is the maximum penalty stated in the announcement, not a sentence imposed or a prediction of the case’s outcome.
The DOJ emphasizes that a criminal complaint is an allegation and that defendants are presumed innocent unless proven guilty beyond a reasonable doubt in court. The public announcement does not establish that Caldera planned an attack or committed the charged offense.

Was Caldera released on bond?
Public accounts reported by the Texas Tribune conflict. The Tribune said DPS disputed online claims that Caldera had been released on a $75,000 bond, while Bexar County Jail records showed “released on bond” with a $75,000 amount. The reporting available as of October 3, 2026, does not resolve the discrepancy, so it does not establish his definitive custody status.
Are there other suspects?
The Texas Tribune reported that a Senate staff email described the arrested man as the “main suspect” in a plan involving suspected co-conspirators. That account does not confirm that other people were involved. The Tribune also noted that DPS’s public arrest statement did not mention additional suspects or arrests. No unnamed person should be treated as a confirmed co-conspirator based on those reports.
