The Senate passed H.R. 5235, the Skills-Based Federal Contracting Act of 2025, without amendment by unanimous consent on September 30, 2026. The bill would not abolish education requirements: it would require a contracting officer to include a written justification in a solicitation before setting a minimum education requirement for proposed contractor personnel. On October 1, Representative Nancy Mace’s office and FedScoop said the measure was heading to or awaiting presidential action; the sources reviewed do not establish whether it was formally presented or signed.
What H.R. 5235 would change
The reported-in-Senate text would add section 3313 to title 41 of the U.S. Code. It says: “A solicitation may not set forth any minimum education requirement for proposed contractor personnel in order for a bidder to be eligible for award of a contract unless the contracting officer includes in the solicitation a written justification that explains why the needs of the executive agency cannot be met without any such requirement and clarifies how the requirement ensures the needs are met.” Read the reported-in-Senate bill text.
In practical terms, an agency could still require education for proposed contractor personnel. The contracting officer would have to explain in writing why the agency’s needs cannot be met without the requirement and how the requirement serves those needs. The text makes that justification part of the solicitation; it does not set an across-the-board ban on education criteria.
Which requirements and workers are covered?
The bill addresses minimum education requirements for proposed contractor personnel in federal contract solicitations when those requirements affect a bidder’s eligibility for award. It is not a general rule for private employers’ hiring practices or for all federal employees.

Its definition is broader than college degrees alone. An “education requirement” may be met through education by itself, education or experience, or a combination of education and experience. The bill’s definition of education includes associate, baccalaureate, graduate, and professional degrees, specified coursework, and other educational attainment from qualifying institutions. The House passed H.R. 5235, as amended, on February 23, 2026, according to the Congressional Record. The Senate then passed it without amendment by unanimous consent on September 30, 2026, according to the Senate floor record.

Senate passage is not enactment. On October 1, Mace’s office described the bill as heading to President Trump, and FedScoop reported that it awaited presidential action. Those reports do not establish the date of formal presentation or any subsequent signature or veto. The GovInfo bill record identifies the reported-in-Senate text, dated September 14; that text alone does not record the later Senate floor vote. The available status accounts are the October 1 statement from Mace’s office and FedScoop’s October 1 report.
What happens if it is enacted?
- OMB guidance: The bill directs the Director of the Office of Management and Budget to issue implementation guidance within 180 days after enactment.
- Compliance evaluation: It directs the Comptroller General to submit an evaluation of executive-agency compliance to Congress within three years after enactment.
Neither deadline starts with passage alone. Both are prospective provisions in the bill text, and depend on enactment. The Congressional Budget Office summary also describes the measure.

What the bill does—and does not—establish
The mechanism is a written-justification requirement, not a finding that degree requirements are always unnecessary or that the change will produce a particular hiring or contract-performance outcome. Its practical effect would depend on how agencies apply the requirement, what they include in justifications, and any implementation guidance if the bill becomes law. The legislative text establishes those proposed process changes, not their real-world results.
