ASU Student Eryn Bonner Faces Two Tempe Misdemeanor Charges; Lawyer Calls Case Political

Tempe city prosecutors filed two misdemeanor charges against Arizona State University senior Eryn Bonner after her July arrest outside a Mill Avenue bar, according to an October 2 report: disorderly conduct for fighting and hindering or interfering with police. Bonner’s lawyer, Benjamin Taylor, called the filing a “political prosecution”; that is his characterization, not a court finding. The available reporting does not establish the case’s current court status or outcome.

What charges were filed against Eryn Bonner?

The October 2 report says Tempe city prosecutors filed two misdemeanors in Tempe City Court: disorderly conduct for fighting and hindering or interfering with police. It does not establish a conviction or provide a docket number, plea, hearing date or final disposition.

The filing followed an earlier review by the Maricopa County Attorney’s Office. Tempe police had submitted felony charges and a misdemeanor to the county office; Phoenix New Times reported on July 23 that the county attorney declined the felony submission. A spokesperson was quoted saying, “It was determined there was no reasonable likelihood of conviction.” That decision concerned the earlier felony submission; it was not a ruling on the later city misdemeanor case.

Why does Bonner’s lawyer call it a political prosecution?

Taylor alleges that union pressure influenced the city’s decision to file charges. In the October 2 report, he said: “The city police union has been pressuring the city, the city leadership to bring charges for months now.” The report says he characterized the filing as capitulation to that pressure. These are claims by Bonner’s counsel; the available reporting does not independently establish political influence.

Tempe Officers Association president Robert Ferraro defended the filing. He said it aligned with what he described as the complete video evidence, and alleged that the incident differed from a short social-media clip. His statement is the union’s position, not a judicial or investigative finding. Tempe communications director Kris Baxter declined to comment on the allegation of political motivation, according to the October report.

What was reported about Bonner’s July arrest?

Phoenix New Times reported that Bonner was arrested early on July 19 outside C.A.S.A. on Mill Avenue, while Tempe officers were arresting two men after encountering a physical altercation. According to the outlet’s description of video, Bonner approached and called for officers to release her friend. An officer ordered her to back up, shoved her to the ground, then grabbed and tackled her over a bicycle and punched her. These are descriptions in the reporting of what footage showed, not findings about culpability.

Tempe police said the circulated footage “raises understandable concerns,” but cautioned that it did not provide full context. The department said its review would examine everyone’s actions and the totality of the circumstances. The reporting available here does not give the investigation’s final findings.

How did the case move from county review to city charges?

  1. July 19: Phoenix New Times reported Bonner’s arrest outside C.A.S.A. while officers were arresting two men.
  2. July 23: Phoenix New Times reported that the Maricopa County Attorney’s Office declined the felony charges submitted by Tempe police and that an internal investigation into officers’ actions was underway.
  3. August 6: Phoenix New Times reported that Tempe was reviewing charges after the county decision. Taylor then alleged that charging Bonner would reflect political and union pressure. Coverage at this stage described a wider set of charges being considered; it should not be confused with the two-count filing later reported.
  4. October 2: Phoenix Relocation News reported that city prosecutors had filed the two misdemeanors in Tempe City Court that week. Its report closely resembles Phoenix New Times coverage, but the original publisher of the October report was not independently established.

What is known—and not known—about the court case?

The latest reported procedural step is the city’s filing of two misdemeanors. No primary Tempe City Court docket was obtained, so the available sources do not establish the case number, current counts, next hearing, plea or disposition. Do not treat the filing as a conviction, dismissal or final ruling.

The accounts also differ in evidentiary scope: reporting describes both a short clip circulated on social media and longer footage cited by the union. Neither the lawyer’s allegation nor the union’s defense substitutes for a court ruling or the police review’s final findings.
