The Supreme Court has asked Uttar Pradesh and Union officials to explain by affidavit what action has been taken against the driver and registered owner of the double-decker bus that caught fire near Jewar, and whether the bus met applicable rules before it went on the road. The Court listed the matter for 25 November 2026. It has not yet made a finding on the owner’s arrest status or the bus’s compliance.
What happened in the Yamuna Expressway bus fire?
A sleeper bus caught fire on the Yamuna Expressway near Jewar during the night of 23–24 September 2026, killing nine passengers, according to contemporaneous reporting by LiveLaw. The Supreme Court proceeding is an interlocutory application in S. Rajaseekaran v. Union of India, a road-safety case dating to 2012. The bench comprised Justices J.B. Pardiwala and K.V. Viswanathan.
What has the Supreme Court asked officials to disclose?
In its 28 September 2026 order, the Court directed the Uttar Pradesh Chief Secretary, the Union of India and the Secretary of the Ministry of Road Transport and Highways (MoRTH) to provide the necessary information by affidavit before the next hearing. It asked:
“We would like to know what steps have been taken against the driver of the bus concerned, including the registered owner of the bus. Whether they have been arrested so far? Whether the registered owner had complied with all rules and regulations before plying this double-decker bus on road?”

The order lists the matter for 25 November 2026. The order reproduced by Indian Kanoon does not itself answer the questions it puts to officials.
Have the driver and bus owner been arrested?
A contemporary report says two drivers and a conductor were arrested. It does not establish whether the registered owner was arrested, and the reviewed order does not specify the owner’s status. The Court has asked officials to clarify arrest status and other action; until an affidavit or later order answers, the owner’s status remains unconfirmed.

Was the bus compliant with safety rules?
No official compliance finding for this bus appears in the reviewed order or reporting. The Court has asked whether the registered owner complied with all rules and regulations before the bus was put on the road. The available material does not establish the bus’s permit, fitness or insurance history, the condition of its safety equipment, or the final cause of the fire.
For broader context—not as evidence about this bus—MoRTH said in a response posted on 11 February 2026 that it had advised states and Union territories to check compliance with AIS:052 and AIS:119 at registration and during fitness inspections under Rule 62 of the Central Motor Vehicles Rules, 1989. In discussing an earlier Jaisalmer–Jodhpur sleeper-coach fire, the Ministry listed an overlength bus, undersized emergency doors, an obstructed emergency exit, one roof hatch instead of two, a roof luggage carrier with ladder, a driver-cabin partition, and no fire-detection and suppression system among the observed issues. It said local transport officers should have detected the modifications during certification. Those observations concern a different fire and do not show that the Yamuna Expressway bus had the same defects. See the Ministry’s response published by the Press Information Bureau.

What wider safety measures does the application seek?
The application asks for a package spanning bus design and equipment, certification, enforcement, and emergency response. These are requests made by the applicant and reproduced in the order—not measures the Court granted in its 28 September order.
Driver, vehicle and inspection controls
- Identify passenger-bus drivers with five or more offences in a relevant one-year period, and have licensing authorities consider action after notice and an opportunity to be heard.
- Restrict vehicles with more than five unpaid challans and check highway access for required fitness, speed-limiter, vehicle-location-tracking and emergency-button compliance.
- Adopt a uniform physical-inspection checklist for sleeper, two-tier sleeper and double-decker buses, with inspections prioritized by risk.
- Suspend registration or permits for buses that fail critical safety requirements until repairs and recertification.
Monitoring and passenger preparedness
- Connect vehicle-location tracking with speed limiting, route monitoring and smoke or fire detection so alerts can reach control centres.
- Electronically verify fitness, permits, insurance, tracking and challan status through VAHAN, e-challan and FASTag systems.
- Train crew in fire response and require pre-departure passenger safety briefings.
- Integrate panic buttons with Emergency Response Support System-112.
Roadside rescue and older buses
- Develop risk-based highway fire-rescue plans with fire tenders, ambulances and rescue equipment; conduct night drills and publish response times.
- Decide whether older sleeper and double-decker buses should be retrofitted or phased out.
What do the wider figures say about sleeper-bus safety?
MoRTH reported 49,616 registered sleeper coaches as of 6 February 2026 and 886 accredited bus body builders in its 11 February 2026 response. Separately, figures cited in an Allahabad High Court proceeding from a Rajya Sabha response recorded 45 bus-fire incidents across India between January 2023 and 10 December 2025, resulting in 64 deaths and 145 injuries. Those figures were reported by PTI via NDTV; they are not a finding about the cause of this fire or the compliance of this bus.

How is the Allahabad High Court case different?
The Allahabad High Court proceeding is separate from the Supreme Court road-safety case. In that matter, the High Court sought state affidavits on sleeper-bus permits and inspections, including permits issued over the preceding three years, checks against standards, vehicle design changes, commercial parcels, border and night inspections, fire extinguishers, passenger awareness of emergency exits and crew training. PTI reported that the High Court set 13 October 2026 for the matter and described initiation of criminal proceedings.
The High Court’s reported concern that sleeper buses appear to operate without proper checks is an observation in that proceeding, not an adjudicated finding about every bus or this vehicle. Its requests should not be confused with the Supreme Court’s affidavit direction or with reforms that the applicant has asked the Supreme Court to adopt.
