Supreme Court to Review Trump Administration’s ICE Detention Policy

The U.S. Supreme Court has agreed to hear Rhoney v. Barbosa da Cunha, a case about whether federal law requires detention without an immigration-judge bond hearing for some noncitizens who are in the United States without having been admitted. The Court granted review on October 1, 2026; it has not ruled on the legal question.

What the Supreme Court agreed to decide

The case asks how to interpret 8 U.S.C. § 1225(b)(2)(A), a provision concerning detention while removal proceedings are pending. The Court’s stated question is: “Whether 8 U.S.C. 1225(b)(2)(A) mandates the detention pending removal proceedings of aliens who, like respondent, are present in the United States without having been admitted.” The Supreme Court docket and question presented identify the issue accepted for review.

In practical terms, the dispute is whether the statute requires detention for the people described in the question, or whether they may seek release through a bond hearing before an immigration judge. The legal question is about statutory meaning and the availability of that hearing; the Court has not yet decided either point.

What the grant does—and does not—mean

A grant of review means the justices will consider the case. It is not a decision approving or rejecting the administration’s interpretation, and it does not itself determine whether any particular person will be detained or receive a bond hearing. The docket identifies the case as No. 26-104. The petitioner is Philip L. Rhoney, Acting Director of the Buffalo Field Office of U.S. Immigration and Customs Enforcement; the respondent is Ricardo Aparecido Barbosa da Cunha. The underlying Second Circuit case, No. 25-3141, was decided April 28, 2026, according to the Supreme Court docket.

Why the detention policy is being challenged

The administration’s interpretation

Al Jazeera reported on October 1, 2026, that federal immigration authorities received July 2025 guidance directing detention without bond hearings for certain undocumented immigrants while their removal proceedings continued. The government’s position, as summarized in that report, is that differing decisions among federal appeals courts have led to inconsistent enforcement. These are descriptions of the administration’s position, not findings by the Supreme Court.

The challengers’ position

Al Jazeera attributed to the ACLU, which represents the challengers, the argument that the government is applying the detention provision to people apprehended inside the United States, rather than limiting it to people stopped at the border. The Supreme Court’s question focuses on people present in the country without having been admitted; the justices will decide the statutory issue, not simply endorse either side’s framing.

Reported circuit disagreement

Al Jazeera described a divide among lower courts: it reported that most federal appeals courts allowed bond hearings in some circumstances, while the Fifth and Eighth Circuits found mandatory detention applied to certain people accused of entering or remaining unlawfully. That is a broad summary of the dispute, not a circuit-by-circuit account of each ruling. The central issue before the Supreme Court is the meaning of § 1225(b)(2)(A) for people present without admission.

How Barbosa da Cunha’s case reached the Court

According to Al Jazeera’s October 1 report, Barbosa da Cunha is a Brazilian national who had been in the United States since about 2004 or 2005. The report says he was arrested in Massachusetts in September 2025, initially denied a bond hearing under the administration’s approach, and later released on bond. Those personal and procedural details are reported background; the Supreme Court docket establishes the parties and the lower-court case.

What remains unresolved

  • The Court has not yet issued a decision on whether § 1225(b)(2)(A) requires detention in the circumstances described in its question.
  • The reviewed docket and October 1 order do not establish an oral-argument date or a decision date.
  • The eventual ruling’s practical reach will depend on the Court’s reasoning and the circumstances of individual cases; the grant alone does not guarantee a bond hearing for any person.
