For covered U.S. Citizenship and Immigration Services (USCIS) benefit requests, the updated FY 2027 fees apply when the request is postmarked on or after October 16, 2026. This is an inflation adjustment to selected fees created by H.R. 1—not a general increase to every immigration filing fee. Check the amount for your exact form and filing category before mailing; USCIS says a request with the wrong fee may be rejected.
Which USCIS fees change on October 16?
The Department of Homeland Security’s FY 2027 schedule updates specified H.R. 1 statutory fees. The amounts below compare those covered fees for FY 2026 and FY 2027; they are not necessarily the complete amount due for a form, because separate USCIS filing fees may also apply. The figures are the H.R. 1 fees identified in the notice, not an all-in price for every application. A filing can also carry a separate USCIS-set fee, and the applicable amount may depend on the request type or category.
Which date controls a USCIS filing?
USCIS applies the FY 2027 amounts to covered benefit requests postmarked on or after October 16, 2026. The notice states that USCIS will require those fees for requests postmarked from that date. If a covered request is mailed on or after October 16 with an incorrect payment, USCIS says it will be rejected.

Use the postmark date—not simply the day you prepare or sign the form—to identify which USCIS schedule applies. Before sending the package, check the current USCIS fee schedule and the instructions for the exact form and category, then include all required payments.
Why did some fees rise while others stayed the same?
H.R. 1, enacted as Public Law 119-21 on July 4, 2025, requires annual inflation adjustments for these statutory fees. DHS reports that the Consumer Price Index for All Urban Consumers (CPI-U) rose approximately 3.36% from July 2025 to July 2026. Most covered amounts are rounded down to the next $10 increment; the Annual Asylum Fee is rounded down to the nearest dollar. Those rounding rules mean the adjustment does not produce an increase in every line item.

For example, the Annual Asylum Fee rises by $3, from $102 to $105, while the initial Immigration Parole Fee rises by $30, from $1,020 to $1,050. The initial asylum-applicant, parole and TPS EAD fees each rise by $10, from $560 to $570; the Form I-821 TPS fee also rises by $10, from $510 to $520. The DHS notice gives the FY 2027 schedule and adjustment details.
Do immigration-court cases use the October 16 date?
No. The October 16 postmark threshold is for covered USCIS benefit requests. The Department of Justice’s separate FY 2027 schedule for relevant filings with immigration courts or the Board of Immigration Appeals takes effect October 1, 2026. Its listed amounts include an initial I-589 fee of $100, an Annual Asylum Fee of $105, I-485 at $1,590, I-601 at $1,100 and I-821 at $520. Check the DOJ Federal Register notice and the payment instructions for the forum handling the case; do not apply USCIS’s October 16 date to a court or Board filing.

How to check what you owe before filing
- Identify the filing destination. Determine whether the request goes to USCIS or is filed with an immigration court or the Board of Immigration Appeals; their FY 2027 schedules and effective dates differ.
- Match the precise form and category. For example, an initial Form I-765 EAD and a renewal or extension can have different statutory fees.
- Check both fee components. Review the current agency schedule and form instructions for any USCIS-set filing fee as well as the applicable H.R. 1 statutory fee. A listed H.R. 1 amount may not be the total filing cost.
- Verify the date and payment rules close to filing. For a covered USCIS request, use the postmark date to determine whether the FY 2027 amount applies. Follow the payment method and submission instructions for that form and filing forum.
USCIS says each application, petition or request must include the correct fee unless an exemption or waiver applies. Its guidance distinguishes USCIS-set fees from statutory fees under Pub. L. 119-21: the statutory fees cannot be waived, even if a filer may qualify to waive a separate USCIS filing fee. For cases before an immigration judge or the Board, EOIR’s fee page lists the initial I-589 fee as $100 and the Annual Asylum Fee as $105. EOIR says the annual fee applies when an asylum application has been pending for one year or more on or after October 1, 2025, and again for each subsequent 365-day period it remains pending. Use the EOIR filing-fees page and the payment instructions for the forum handling the case to confirm whether and how that fee applies.
