Plymouth Superior Court Judge William Sullivan denied the defense motion seeking a not-guilty finding because the prosecution had not presented sufficient evidence. In considering that motion, the judge viewed the evidence in the light most favorable to the prosecution. The ruling means the prosecution’s case could proceed past that evidentiary challenge; it is not a guilty verdict and does not resolve whether Clancy was criminally responsible.
The ruling is also distinct from the defense’s argument about mental illness. At trial, the defense argued Clancy was not criminally responsible, while prosecutors argued she knew what she was doing. The October 1 ruling did not decide that dispute. Associated Press
Could Lindsay Clancy face a retrial?
Yes. A retrial remains possible because the first trial ended without a verdict, but it had not been announced or scheduled in reporting available as of October 3, 2026. Prosecutors had not publicly committed to trying the case again. The judge did not set a trial date at the September 29 status hearing.

A mistrial after a jury deadlock leaves the case unresolved; it is not an acquittal. Whether prosecutors pursue another trial and when it might occur remain open questions.
What remains pending, and what happens next?
A separate defense motion to dismiss remained unresolved in the latest reports reviewed. The court scheduled another hearing for November 2, 2026. That motion, the prosecution’s decision about a retrial, and the October 1 evidence-sufficiency ruling are separate procedural matters.
