Hindustan Times and The Tribune reported on October 2 that the ministry’s stated basis was the project’s location within 10 km of Sukhna Wildlife Sanctuary and City Bird Sanctuary and its construction without prior clearance from the Standing Committee of the National Board for Wildlife (NBWL). Whether that wildlife-clearance requirement applied to this project is disputed.
What did the ministry revoke?
The reported September 30 order concerns Godrej Eternia’s environmental clearance, not the building plans or occupation certificate. The project’s original EC is identified in Godrej Properties’ June 2023 six-monthly compliance report as EC No. 21-360/2008-IA.III, dated February 26, 2009. Hindustan Times and The Tribune reported that the Ministry of Environment, Forest and Climate Change (MoEFCC) revoked it under Section 5 of the Environment (Protection) Act, 1986, with immediate effect.
The exact wording and terms of the September 30 order cannot be confirmed from the cited reports, which do not reproduce the order. The stated grounds and description of the ministry’s action should therefore be understood as reported, rather than as a direct quotation from the order.
Why does the NBWL clearance requirement matter?
According to the October 2 reports, the ministry’s reason was that the commercial complex is within 10 km of Sukhna Wildlife Sanctuary and City Bird Sanctuary and was built without prior approval from the NBWL Standing Committee. The dispute is not simply whether those sanctuaries are nearby; it is whether the project was legally required to obtain that wildlife clearance before construction, and whether that requirement was part of, or otherwise binding on, its EC.

A June 2025 report by the Supreme Court-appointed Central Empowered Committee (CEC) reportedly reached a different interpretation. It found that the project complied with the EC’s explicit conditions and that a requirement for NBWL clearance was not specifically stated in the EC or supported by a binding direction applicable to the project. MoEFCC’s reported action takes a contrary position. The available reports do not establish that a court or tribunal has settled which interpretation is correct.
How is this different from Chandigarh’s 2024 action?
Chandigarh’s Estate Office took a separate action in July 2024, revoking Godrej Eternia’s building plans and occupation certificate (OC). The Indian Express reported that the administrative order cited alleged violations involving wildlife permission and building-plan conditions, including Rules 11.1.11 and 11.3.6 of the Chandigarh Building Rules (Urban), 2017. Godrej Properties said at the time that it believed the decision rested on a wrong premise and that it would contest it, according to Hindustan Times. That company statement concerned the 2024 decision, not the reported 2026 EC revocation.

The two actions affect different permissions. Revocation of the EC does not, by itself, resolve the separate dispute over the building plans or OC, or establish whether the complex may currently be occupied.

Godrej Properties’ June 2023 compliance report describes Godrej Eternia as a commercial complex, including commercial and retail space and restaurants, at Plot No. 70, Chandigarh Industrial Area, Phase 1. It records that construction was complete and the complex operational at the time covered by the report, and says consent to operate had been obtained from the Chandigarh Pollution Control Committee. Those are dated statements from the developer’s report; they do not establish the complex’s present occupancy or consent status.

The Tribune reported on October 2, 2026, that Godrej appealed the EC revocation to the National Green Tribunal (NGT). The report does not identify the case number or filing date, and the available information does not verify whether the tribunal has issued a stay or other interim relief, or decided the appeal.
