The Supreme Court did not allow the Mamata Banerjee-led Trinamool Congress faction to operate the frozen accounts, according to Hindustan Times. It also did not rule on whether the freeze was justified: the bench reportedly left the dispute to the Calcutta High Court and directed that the pending petition be heard sooner.
Why the Supreme Court declined to intervene
The faction’s petition seeking de-freezing was already before the Calcutta High Court. Hindustan Times reported that the High Court had heard arguments and listed the matter for after the Puja holidays, without specifying a date. The Supreme Court therefore declined to address the merits and instead expedited the pending High Court hearing.
Hindustan Times attributed this statement to the bench of Justices M.M. Sundresh and P.B. Varale: “We refrain from going into the merits of the matter as the issue is being considered by the high court. We are not inclined to interfere except for expediting the hearing of the petition pending in the high court.” The Supreme Court order itself was not located in the available official search results, so the quotation and case details are reported through the newspaper.
What the decision does—and does not—settle
- Account access: The Supreme Court reportedly did not grant the requested access.
- Validity of the freeze: The Court did not decide whether the freeze was lawful or justified.
- Next consideration: The de-freezing petition remains before the Calcutta High Court, whose next hearing was reported as scheduled after the Puja holidays.
- Underlying allegations: The Supreme Court’s reported procedural action is not a finding that any alleged conduct occurred.
Why reports refer to three accounts and four accounts
Hindustan Times’ lead describes four frozen accounts in connection with a land-allotment probe. In its account of the proceedings, however, the newspaper says the Enforcement Directorate had frozen three accounts in a money-laundering probe. It also reports that a High Court-appointed administrator could meet day-to-day expenses for three accounts in the ED case. The available report does not reconcile the different counts, so they should not be treated as interchangeable.

What each side reportedly argued
The Mamata Banerjee-led faction
Its lawyers, Abhishek Manu Singhvi and Shoeb Alam, reportedly told the Court that the faction needed approximately ₹19 crore a month for daily expenses, then offered to reduce its requested amount to ₹12.15 crore a month. They also cited the October 6 by-election to two assembly seats. Singhvi described the freeze’s effect as leaving a political party “paralysed”; that was counsel’s argument, not a judicial finding.
The state
Solicitor General Tushar Mehta reportedly referred to complaints alleging that Sumit Roy, described as Abhishek Banerjee’s personal secretary, deposited ₹35 crore in cash. This was an allegation raised in submissions, not an established fact or a finding by the Court.

The rival faction
Lawyer K. Parmeshwar reportedly argued that account access should await the Election Commission of India’s decision on which faction is the real party. He also said a special officer had been appointed to cover day-to-day expenses and that three accounts held sufficient funds. These, too, are submissions attributed to the rival faction.

The question of which faction is the recognized party was reportedly before the Election Commission, separate from the account-access petition. Hindustan Times reported temporary name and symbol allocations for the October 6 by-elections: the Mamata Banerjee-led faction was allotted “Mamata All India Trinamool Congress” and a football player symbol, while the rival faction was allotted “Democratic Trinamool Congress” and an envelope symbol. The ECI order was not located in the available searches; these allocations should therefore be understood as reported, temporary arrangements, not a final determination of party identity.
