What the published rules mean
Consumer accounts
The consumer terms allow people to view individual records through ImmobilienScout24’s supplied online search masks. They expressly prohibit automated queries by scripts, bots, crawlers, software that bypasses the search mask and comparable measures, including data mining and data extraction. The same rules restrict using queried data to build a database or for commercial exploitation.
B2B accounts are not a scraping exemption
The B2B terms contain materially similar restrictions. A business login may provide different products or permissions, but business status alone does not authorize crawling the public site, copying listings at scale or creating a competing database. Ask for a contract that covers your exact access and reuse rather than assuming a business account changes the rule.

The API is a separate, licensed route
ImmobilienScout24 publishes API terms and documentation. The surfaced API terms describe use for retrieval and display for an end customer under the applicable license and contract. They also prohibit crawler-like access to the website or database. The version found here states that stored API data must be deleted after 24 hours and limits other uses, including database creation or analysis. Treat those details as version-specific: the page is marked 15 August 2022, so verify the current contract before designing storage or analytics.
The documentation shows an expose lookup pattern such as .../search/v1.0/expose/{expose_id} and says the design aims to protect user data and support GDPR compliance. Documentation describes an interface; it does not itself grant eligibility or permission.
German database rights add a second layer
Contract terms and statutory rights are separate questions. Under Germany’s Urheberrechtsgesetz (UrhG) § 87a, a database consists of independently accessible elements arranged systematically or methodically where obtaining, verifying or presenting the contents requires substantial investment. Section 87b gives the database maker exclusive rights over the database or a qualitatively or quantitatively substantial part. It also addresses repeated and systematic extraction of insubstantial parts when that conflicts with normal exploitation or unreasonably prejudices the maker’s interests.

That statutory summary is not a ruling on your dataset. A low request rate does not automatically make extraction permissible, and a single page fetch is not automatically unlawful. Purpose, repetition, scale, contracts and the nature of the material all matter. Have German counsel review a commercial, research or machine-learning deployment and obtain written permission where the analysis requires it.
Choose an authorized access model before writing code

Project checklist before implementation
- Describe the purpose. Write one sentence naming the users, business or research objective and the output. “Collect everything for later analysis” is too broad for a permission request.
- Define the fields. List identifiers, prices, locations, descriptions, images, seller details and timestamps separately. Request only what you need.
- Specify the audience and display. State whether results are private to an end customer, shown to employees, embedded in a public site or redistributed to third parties.
- Set retention and deletion. The surfaced 2022 API terms state a 24-hour storage limit. Build a deletion job, but confirm the current contract before treating 24 hours as a current rule.
- Address personal information. Do not collect or expose user-specific information without a lawful basis and explicit authorization. Ask whether contact details, names or exact addresses may be returned at all.
- Confirm operational limits. Get documented rate limits, pagination rules, error handling, authentication, change notices and support contacts in writing.
- Record the governing agreement. Save the contract version, effective date, permitted endpoints and approved use cases alongside your code and compliance records.
- Plan deletion and revocation. Know how to remove a listing when instructed, when a license ends or when the source record is withdrawn.
Implementing a licensed API client
The following pattern is deliberately endpoint- and host-neutral because the current enrollment URL, base host, credentials and field permissions are contract-dependent. Set IMMO_API_BASE only to the base URL supplied in your agreement. Do not point this code at the public website.

console.log(await res.json());These examples fetch one authorized expose record. Add pagination, retries and concurrency only within the limits your contract specifies. Never defeat a challenge, rotate identities to evade controls or fall back to HTML crawling when the API rejects a request.
Reliability, privacy and cost design
Use a small, auditable pipeline
- Keep credentials in a secret manager, not source control or logs.
- Log request time, endpoint, response status and a non-sensitive correlation ID; avoid logging full personal data.
- Validate schemas so a changed field fails safely instead of silently corrupting your database.
- Use an explicit deletion worker keyed to the contract’s retention rule.
- Cache only when caching is authorized. A cache can turn a permitted display integration into an unauthorized database.
Handle failures without increasing pressure
For transient server errors, use bounded exponential backoff and honor any Retry-After header. Stop on authentication failures, permission errors and policy responses until the provider clarifies them. Do not increase concurrency to compensate for a denied or throttled request.
Budget the project around the contract
No current API price, quota or enrollment terms were established here. Ask the provider for these figures and model the monthly number of records, refresh frequency, storage, support and overage charges. A technically successful request is not evidence that your planned volume is included.

401 or 403 responses
Check that the token belongs to the licensed application, has not expired and is sent to the API host specified by the contract. A 403 can mean the endpoint, field or end-customer use is outside your license. Do not retry indefinitely; contact the provider.
404 for an expose
Verify the identifier format, URL encoding and whether the expose is still available to your account. Do not infer that a missing API record authorizes a website scrape.
429 or throttling
Reduce concurrency, honor the provider’s retry guidance and request an approved quota if your workload is legitimate. Distributed clients or proxy rotation to bypass limits create additional compliance risk.
Unexpected fields or empty values
Compare the response with the versioned schema in your agreement, test null handling and ask whether the field requires a separate entitlement. Never fill gaps by collecting the same information from HTML pages.

Make deletion idempotent, monitor failures and quarantine records that cannot be removed. If the current contract imposes a deadline, alert before it expires and stop new ingestion until the issue is fixed.

What a defensible 2026 workflow looks like
- Pause any crawler or bulk fetcher aimed at the public site.
- Send a written project description to ImmobilienScout24 and request the current API or feed terms.
- Have counsel review database rights, GDPR responsibilities and the proposed display.
- Implement against the licensed host and endpoint, with least-privilege fields and deletion controls.
- Test authentication, throttling, schema changes and deletion in a non-production environment.
