Apple is not waiting for its first major EU Digital Markets Act (DMA) penalty: the European Commission fined the company €500 million on April 23, 2025, over App Store anti-steering restrictions. Separate proceedings covering alternative app distribution, the Core Technology Fee and interoperability could still lead to further enforcement, but no new “massive” fine had been imposed or definitively announced in the official material available through August 18, 2026.
What Apple was fined for
The 2025 penalty concerned the DMA’s anti-steering obligation, principally Article 5(4). Developers using the App Store must be able to tell customers about cheaper or alternative offers outside Apple’s billing system, direct users to those offers and enable purchases through other channels without restrictions that make the option ineffective.
The Commission concluded that Apple’s rules limited how developers could communicate and steer customers to external offers. It said Apple had not shown those restrictions were objectively necessary and proportionate. The Commission’s decision and the €500 million fine are described in its April 23, 2025 announcement; the formal case summary records the Article 5(4) finding, a cease-and-desist order and potential periodic penalties for non-compliance at EUR-Lex.
Why reports may say another fine is possible
The Commission opened a separate non-compliance investigation into Apple’s contractual terms for alternative app distribution. The issues include third-party app marketplaces, web distribution (often called sideloading), eligibility conditions and the Core Technology Fee. In its June 24, 2024 announcement, the Commission said these terms might discourage developers from using channels outside the App Store and therefore undermine effective DMA compliance.

That proceeding is not the same as the concluded anti-steering case. A preliminary finding is the Commission’s provisional view, not a final infringement decision. A formal investigation gathers evidence and gives Apple procedural opportunities to respond. Only a final non-compliance decision establishes a violation and can impose a fine or a cease-and-desist order.
Specification decisions are different
The Commission can also issue a specification decision explaining the concrete measures a gatekeeper must provide. The Commission’s DMA Q&A says a specification proceeding does not itself establish non-compliance or impose a fine. It is therefore inaccurate to treat every Apple DMA proceeding as a penalty case.

How large could a future DMA penalty be?
The DMA sets ceilings, not automatic invoices. For an infringement, the Commission can fine a company up to 10% of its total worldwide annual turnover. That ceiling can rise to 20% for a repeated infringement. It can also impose periodic penalty payments of up to 5% of average daily turnover to compel compliance. The same Commission guidance describes additional behavioural or structural remedies for systematic infringements, including the possibility of divestiture in extreme circumstances.

The €500 million Apple penalty was materially below the ordinary statutory ceiling. Any later amount would depend on the particular conduct, its duration and gravity, Apple’s compliance efforts, the evidence, procedural history and whether the Commission treats the conduct as repeated or systematic. The ceiling is calculated from worldwide turnover, not merely App Store revenue.

Apple’s gatekeeper status remains in force
Apple is designated under the DMA for the App Store, iOS, Safari and iPadOS, according to the Commission’s DMA Q&A. On July 8, 2026, the EU General Court dismissed Apple’s challenges to its App Store and iOS gatekeeper designations. The Court also found Apple’s actions concerning iMessage inadmissible; iMessage was not designated as a gatekeeper service. The Court of Justice press release confirms that the judgment did not impose a new fine. It strengthened the legal basis for continued Commission oversight, including the treatment of Apple’s different App Store versions as one core platform service.
Other Apple DMA issues to watch
Alternative app stores and web distribution
The DMA requires effective distribution through channels beyond Apple’s App Store, including third-party marketplaces and web distribution, and limits situations in which Apple can force developers to use its in-app payment system. The practical legal question is whether fees, warnings, notarization, eligibility rules and contractual terms leave alternatives commercially usable—not merely technically available.

Core Technology Fee
The Core Technology Fee is part of the additional investigation. It is not established as illegal by the material available here. The precise issue is whether the fee and related contract terms discourage developers from choosing alternative distribution and thereby undermine the DMA’s effective-access requirements.
Interoperability with connected devices
Article 6(7) requires free and effective interoperability with relevant iOS and iPadOS hardware and software features, subject to strictly necessary and proportionate security measures. The Commission’s interoperability portal explains the obligation.

Separate specification proceedings require Apple to improve interoperability with connected devices and create a structured process for developer requests. That process includes technical reference information, documented timelines, reasons for rejecting requests, internal review and dispute-resolution mechanisms, as set out in the Commission’s Apple interoperability proceedings page. These measures explain how Apple must provide compliance; they are not, by themselves, new infringement findings or fines.
Siri and Apple Intelligence
The Commission’s 2026 DMA Q&A rejects the claim that the Act prohibits Apple from launching products in the EU. It says Apple’s decision not to release a new Siri AI version in the EU was Apple’s decision, while the DMA requires regulated services to provide equivalent access to third parties where applicable. Apple argues that interoperability and compliance requirements complicate or delay an EU rollout; the Commission says Apple can launch in a compliant way. Neither position establishes a Siri-related fine.

- The Commission identifies possible non-compliance and may issue preliminary findings or open formal proceedings.
- Apple receives procedural rights and can submit legal arguments, technical evidence and proposed remedies.
- The Commission may accept corrective measures, narrow the matter or continue its investigation.
- If non-compliance is established, the Commission adopts a decision that can order Apple to stop the conduct and impose a fine.
- Apple can challenge that decision before the EU courts.
- Continued failure to comply can lead to periodic penalty payments or additional remedies.
This sequence is why “Apple could be fined” and “Apple was fined” are materially different statements. A report should identify the relevant DMA article, say whether the matter is preliminary or final, provide the decision date and amount, and distinguish an official penalty from a headline based only on the statutory maximum.
What users and developers may notice
- Developers may gain more practical freedom to link customers to external subscriptions or other offers.
- Alternative marketplaces and web distribution may remain available under Apple’s security, notarization and eligibility controls, but legal access does not guarantee comparable scale or economics to the App Store.
- EU users may see different payment disclosures, distribution choices and operating-system behaviour from users elsewhere.
- Third-party accessories and connected devices may receive broader access to iOS and iPadOS features as the interoperability specifications are implemented.
- Apple can continue to cite privacy, security, fraud and user-experience risks; the regulatory test is whether restrictions are necessary and proportionate rather than whether all controls must disappear.
Bottom line on the “massive fine” claim
Apple’s €500 million DMA fine is real, but it dates from April 23, 2025 and concerned App Store anti-steering. Apple’s unresolved alternative-distribution and interoperability obligations create a genuine possibility of further enforcement. As of August 18, 2026, however, the official material does not establish a newly imposed or definitively announced massive penalty. The DMA’s 10% and 20% figures are legal ceilings, not forecasts.
