The new WA road rules you need to know before buying an electric scooter this Christmas

As at 18 August 2026, the first question is not whether a scooter is advertised as “electric” or “road legal”. It is whether the specific device meets Western Australia’s eRideable definition and whether the intended rider is old enough. A compliant eRideable is for one person, weighs no more than 25kg, is no larger than 125cm long by 70cm wide by 135cm high, and cannot travel faster than 25km/h on level ground. A child under 16 generally cannot ride that category at all.

Check the specification sheet, every riding mode and the required safety equipment before paying. A scooter can be lawful to sell yet unlawful to ride on WA roads or paths.

What changed in WA during 2026?

WA’s 2026 changes modify operating rules; they do not create a completely new e-scooter regime. The Department of Transport and Major Infrastructure says riders may now:

  • use roads with speed limits up to 50km/h;
  • omit a hand signal when giving it would be unsafe;
  • use bicycle storage boxes at traffic lights where provided; and
  • choose their lane position in a single-lane roundabout rather than being required to keep left.

The public departmental update describes the changes as taking effect “earlier this month” but does not state a precise commencement date. These changes do not permit a scooter to travel at 50km/h: the eRideable speed limit remains 25km/h on permitted roads, bicycle paths and shared paths, and 10km/h on footpaths and pedestrian crossings. The WA eRideable test to apply before buying

These are the published limits in WA’s definition and buying guide. Measure the complete device, including handlebars and stems, and use its actual weight rather than shipping weight.

There is no stated maximum motor-power output for an eRideable if the device meets the other limits. “250W”, “500W” or dual-motor labels therefore do not decide legality by themselves. However, a high-powered model that can exceed 25km/h on level ground can fail the definition even if a retailer advertises a software limiter. Treat “sport”, “off-road” and “unlocked” modes as a warning and ask whether any app, firmware or region setting can remove the limit.

The age trap for Christmas gifts

Riders aged 16 or over

Only people aged 16 or over may use a standard eRideable.

Children under 16

A child under 16 may use a separate low-powered motorised scooter category limited to 200W and 10km/h. It is not interchangeable with an ordinary adult e-scooter. Supervision does not turn an over-limit children’s model or a standard eRideable into a lawful choice. Confirm both the motor-power and speed limits in writing with the seller.

Riders must also obey signs banning wheeled devices or bicycles, use the bicycle side of a separated path, use a bicycle lane when one is available, and never ride behind or attach the eRideable to a motor vehicle. On a crossing entered from the connected path, a rider may remain mounted only at 10km/h or less, keeping left and giving way to pedestrians; entering directly from the road is a different situation. How the 2026 changes work in practice

Hand signals

Do not signal when doing so would be unsafe, but do signal where it is safe. Indicators, if fitted, can help, but the exception is not permission to skip signalling merely because it is inconvenient.

Traffic-light bicycle boxes

An e-rider may use a green bicycle storage area at traffic lights where one is provided.

Single-lane roundabouts

The former requirement to keep left in a single-lane roundabout no longer applies. Choose a safe position, signal where practical and give way according to the road rules.

Equipment to verify before purchase

Helmet

A securely fastened approved helmet is required unless a recognised exemption applies. WA’s accepted standards include AS/NZS 2063:2008, AS/NZS 2063:2020, EN 1078:2012+A1:2012, U.S. CPSC 16 C.F.R. Part 1203, ASTM F1447-18, and Snell B-95 (1995 standard with 1998 revision). Older standards including AS/NZS 2063:1996 and older Snell B-95 variants were phased out on 22 September 2025. Check the compliance label, fit and fastening; replace a helmet after a crash or when cracked, damaged or deteriorated. Details and dates are in the official buying guide.

Lights and reflectors

Look for a white front light, a red rear light and reflector, and two yellow side reflectors. They are especially important in darkness or hazardous weather.

Warning device and construction

A working bell or other warning device is required unless fitting one is impractical because of the design. Confirm that a bell is supplied or can be securely fitted. The scooter should have no sharp protrusions or edges likely to injure another person.

Battery and charger

WA Consumer Protection warns that damaged, overcharged or unapproved lithium-ion batteries can catch fire. Use only the supplied or manufacturer-approved charger; do not charge a swollen, damaged or overheating battery; keep charging away from escape routes and flammable materials; and follow the maker’s storage instructions. Phones, passengers and alcohol

  • Only one person may ride; passengers and animals are prohibited.
  • Do not hold a mobile phone while riding. A phone secured in a mount may be used for navigation or vehicle monitoring without touching it; touching it is limited to making or receiving an audio call. A phone attached to the rider’s arm has separate hands-free permissions.
  • Riders must maintain proper control and are subject to WA drink- and drug-driving laws.

What is proposed, rather than current law?

WA’s 2026 response to the Ride Safe inquiry supports or supports in principle work on safer devices, clearer rules, infrastructure, education, shared-scheme obligations and possible national approaches to classifications, licensing, registration, device identification and insurance for higher-speed devices. Those documents describe future or nationally dependent work. They do not establish blanket compulsory registration, licensing or insurance for ordinary compliant eRideables today. Christmas buyer’s final checklist

  1. Is the intended rider 16 or over, or does a child’s model stay within 200W and 10km/h?
  2. Does the complete scooter weigh 25kg or less?
  3. Is it within 125 × 70 × 135cm?
  4. Can it exceed 25km/h on level ground in any selectable mode?
  5. Is it designed for one person?
  6. Is an approved, correctly fitting helmet available?
  7. Are the front and rear lights and two yellow side reflectors present?
  8. Is there a working bell or other warning device?
  9. Are the charger, battery provenance and Australian warranty documented?
  10. Is there local repair and spare-parts support, and a safe low-traffic place to practise?

On the first ride, practise braking and turning, keep to 10km/h or less on footpaths, slow near pedestrians and blind corners, keep left and give way on paths, ride single file, stay at least 2m behind motor vehicles, never attach the scooter to a vehicle, use lights at night and wear the helmet every time.

E-bikes and power-assisted pedal cycles follow separate rules, while mobility scooters and motorised wheelchairs are separate categories; do not assume their rules transfer to a recreational e-scooter. Public-transport carriage is also governed by operator-specific conditions, so check Transperth or PTA before travelling with the scooter. See the category guide and mobility-scooter information.
