Epic Games CEO Tim Sweeney’s criticism of Apple and Google is about more than app-store commissions. He argues that their control over mobile distribution, payments, and links to outside offers limits competition. The results of Epic’s campaigns, however, are sharply different: Epic lost its main antitrust claims against Apple but secured a narrower payment-link remedy, while a jury verdict and injunction against Google were upheld on appeal before the companies reached a reported agreement in 2026.
What Sweeney is criticizing
Sweeney, Epic’s founder and CEO, has made the case that mobile platform owners act as gatekeepers between developers and customers. Epic makes Fortnite, operates the Epic Games Store, and develops Unreal Engine. Its argument about competition is also a commercial one: Epic wants more control over how its products reach players, how customers pay, and how much revenue it keeps.

The dispute involves several connected practices:
- Store commissions: Apple and Google have charged commissions on qualifying digital transactions, with rates and exceptions varying by program, transaction, and period. The court record discusses a 30% rate on relevant transactions in 2020; that historical figure should not be mistaken for a universal current rate.
- Billing rules: Platform policies have required or favored the platform’s own billing system for many in-app purchases.
- Anti-steering rules: Developers have faced restrictions on telling customers about, or linking them to, outside payment options.
- Alternative-store friction: Epic argues that competing stores can be harder to discover, install, and trust than the built-in store.
- Defaults and network effects: A preinstalled store, familiar payment flow, device-maker agreements, search placement, and user warnings can make the incumbent store the practical choice even where alternatives technically exist.
In April 2025, Epic accused Apple of imposing unlawful steering restrictions, fees on outside purchases, and “scare screens,” and said Google had similar anti-steering problems under the European Union’s Digital Markets Act. Those are Epic’s descriptions of the policies, not a blanket judicial finding that every such practice is unlawful. Epic’s statement sets out its position.

Apple and Google have defended centralized review and billing as ways to support security, privacy, fraud prevention, quality control, payment handling, and platform maintenance. They also argue that alternative stores and payment systems can create risks and that platform fees help fund services developers use. Those defenses do not erase the court findings in the Google case or the Apple injunction, but they explain why the companies say the rules exist.

How the fight began
The confrontation became public in August 2020. Epic changed Fortnite so that players could use an Epic payment option intended to bypass Apple’s and Google’s in-app billing systems. Both companies removed Fortnite from their stores, and Epic filed separate lawsuits.
This was a deliberate test of the rules, not an accidental policy violation. The Ninth Circuit’s account describes the maneuver as part of Epic’s “Project Liberty” campaign. By triggering removal and litigation, Epic made the dispute concrete; by bypassing the agreed payment terms, it also gave the companies a basis to argue that Epic had breached its contracts. The cases then followed different paths in part because iOS is more tightly controlled, while Android permits more forms of sideloading and alternative distribution.
Apple: a limited remedy, not an Epic antitrust win
Epic lost its principal antitrust case against Apple in the trial court. The court did, however, issue an injunction concerning Apple’s restrictions on developers directing users to outside payment options. Apple and Epic then disputed whether Apple’s changes complied with that order and what fees or restrictions could still apply.

That distinction matters: Epic did not win a broad ruling that Apple must open iOS to rival app stores or abandon its store model. Its narrower payment-link remedy became important, but its scope and financial effect remained contested. In April 2025, Epic separately argued that Apple’s policies violated the EU’s Digital Markets Act; that was Epic’s claim about a regional regulatory framework, not a substitute for the outcome of its U.S. antitrust case.
Fortnite returned to Apple’s App Store in May 2026, according to TechCrunch’s reporting, globally except in Australia at the time. Its return did not resolve the underlying argument over outside payments or establish that Epic had prevailed on its main Apple claims.
Google: a stronger court result, followed by a reported agreement
Epic had a much stronger legal result against Google. On December 11, 2023, a jury found Google liable under federal and state antitrust laws in Android app distribution and Android in-app billing. On July 31, 2025, the Ninth Circuit upheld the liability verdict and injunction.

The injunction required Google to permit third-party Android app stores to access the Play Store catalog and to allow third-party app-distribution platforms through Google Play. The appellate record addressed how network effects, defaults, agreements with device makers, and user-facing warnings could reinforce Google Play’s position despite Android’s capacity for alternative distribution. It cited historical figures from 2020: Google Play accounted for 95% of Android app downloads in the United States and more than 80% worldwide excluding China. Those are dated figures from the case record, not current market-share measurements. The record also said 35% of users attempting to download Fortnite directly abandoned the process after Google warning messages—evidence of how installation friction can matter even when sideloading is possible. The court filing describes the verdict, injunction, and historical evidence.
In March 2026, Epic and Google reached an agreement described in GamesBeat interviews and reporting. The reported changes included lower fees, alternative-payment options, and a path for Fortnite’s worldwide return to Google Play. Sweeney said developers could pay roughly 10% to 20%, compared with previously reported rates of 15% to 30%, and called the result a meaningful improvement while saying Epic would have preferred lower fees. Those figures are attributed descriptions, not a universal rate card for every developer, region, or transaction. Because the cited coverage reports the deal through interviews rather than reproducing a complete settlement document, its precise legal scope, duration, and implementation terms should not be inferred beyond what was reported. The court order and the agreement are not the end of the practical question. In August 2026, reporting said a U.S. judge remained dissatisfied with aspects of Google’s implementation for helping users find rival app stores, including search and an “Are you looking for?” flow. That illustrates the gap between permission on paper and a competing store that users can readily discover and use. Android Central reported on the implementation dispute.

So “Epic beat Apple and Google” is inaccurate. The Google litigation produced the stronger legal victory; the Apple litigation produced a narrower result. In both cases, litigation outcomes and commercial arrangements are separate from the question of whether users and developers will actually adopt alternatives.

For users, competing stores or payment methods could mean more choice and possibly lower prices. But a fee reduction does not automatically become a price cut: developers may pass through some, all, or none of their savings. Using an outside store or payment service can also mean extra accounts, installation steps, security prompts, different refund processes, or fragmented subscriptions and purchase histories. Support for parental controls, family settings, and cross-platform ownership may differ.

Availability and rules can vary by country and device; an Android option is not necessarily available on an iPhone or iPad.

For developers, the headline commission is only one part of the economics. Compare the effective cost after payment processing, taxes, fraud, refunds, customer support, and acquisition. Then weigh that against store reach, conversion, ranking, update delivery, and the work of maintaining multiple billing systems and listings. An alternative may charge less but reach fewer customers; an external link may be allowed but buried behind warnings or extra steps. Regional rules can also create different requirements.
Why the criticism still matters
Sweeney’s campaign has helped turn app-store rules into a major competition and policy debate, and the Google result led to a stronger formal remedy than Epic obtained against Apple. But neither a court order nor a negotiated lower rate instantly removes dependence on incumbent platforms. The practical test is whether users can find and trust alternatives, whether developers can reach enough customers to justify supporting them, and whether any savings or added choice actually benefit consumers.
That makes the outcome mixed across three measures: Epic’s legal position improved substantially against Google but not in its main Apple antitrust claims; its commercial position gained concessions while it still relies on the platforms for mobile reach; and consumer gains remain possible rather than guaranteed.
