Yes. The U.S. Virgin Islands subpoenaed Elon Musk for documents on April 28, 2023, as part of its civil lawsuit against JPMorgan Chase over the bank’s alleged relationship with Jeffrey Epstein. The subpoena sought records; it did not make Musk a defendant or, by itself, accuse him of taking part in Epstein’s crimes.
What happened?
The Government of the U.S. Virgin Islands issued Musk a document-production subpoena in its civil case against JPMorgan Chase Bank, N.A. The subpoena was dated April 28, 2023, and the matter became public in mid-May, when the territory asked the court for permission to serve Tesla after reportedly having difficulty serving Musk directly. The case was not a criminal prosecution of Musk. The territory was pursuing JPMorgan in civil court, and Musk was sought as someone who might have relevant records.
What documents did the subpoena seek?
The subpoena requested records in several categories, including:

- Communications between Musk and JPMorgan about Epstein or Epstein’s role in Musk’s accounts, transactions, or financial management.
- Communications between Musk and Epstein involving JPMorgan, Musk’s accounts, or the bank relationship.
- Meetings or communications involving Musk, Epstein, and/or JPMorgan.
- Records of fees Musk paid to Epstein or JPMorgan.
- Documents concerning Epstein’s involvement in human trafficking or procuring women and girls for commercial sex.
This was a request to produce documents, not necessarily a demand that Musk testify in person. The categories describe what the territory sought; they do not establish that any particular record or communication existed. The subpoena’s text sets out the requested material.
Why did the territory seek Musk’s records?
The U.S. Virgin Islands said Epstein “may have referred or attempted to refer” Musk to JPMorgan as a client. That qualified statement was the territory’s stated reason for seeking information; it was not a court finding that Epstein successfully introduced Musk to the bank, that Musk became a client through Epstein, or that Musk knew about Epstein’s crimes. What was the JPMorgan lawsuit about?
The U.S. Virgin Islands alleged that JPMorgan maintained a relationship with Epstein and benefited from or facilitated financial activity connected to his sex-trafficking operation. Those were allegations concerning the bank’s conduct. A subpoena issued during discovery can seek evidence from someone who is not a party to a lawsuit, so Musk’s appearance as a subpoena recipient did not make him a defendant or establish liability. A subpoena is a compulsory request for information or documents. In this case, it shows that the U.S. Virgin Islands sought records it considered potentially relevant to its lawsuit against JPMorgan. It does not prove that the requested records existed, that Musk had a JPMorgan account connected to Epstein, or that Epstein successfully referred him to the bank.
- It does show: Musk was asked to provide documents in the territory’s civil case against JPMorgan.
- It does not show: Musk was sued in that case, charged with a crime, accused by the subpoena of participating in trafficking, or found to have committed misconduct.
