The parents of Landon Embry, 34, sued Tesla and the driver of a Model 3 after a 2022 Utah crash in which the car struck Embry’s Harley-Davidson motorcycle from behind. The complaint alleges the Tesla was traveling about 75–80 mph with Autopilot engaged and that both the driver and Tesla’s safety technology failed to prevent the collision. Those are allegations, not a court finding that Tesla or the driver was liable.
What happened in the Utah crash?
In 2022, a Tesla Model 3 struck the rear of a Harley-Davidson ridden by Landon Embry in Utah. Embry, who was 34, died at the scene. A lawsuit filed by his parents in Utah state court in the Salt Lake City area was reported in August 2024.
According to Reuters’ account of the complaint, the Tesla was traveling approximately 75–80 mph and Autopilot was engaged. The available reporting does not establish the precise roadway, visibility, lane positions, braking distance, or findings of a police reconstruction, so those details should not be inferred.

The complaint names Tesla and the Model 3 driver as defendants. It reportedly alleges that Autopilot and other safety features were “defective and inadequate,” and contends that the car’s cameras and sensors should have recognized the motorcycle as a hazard. The plaintiffs also argue that an adequate automatic-braking system could have slowed or stopped the car before impact.

The complaint reportedly alleges that the driver was tired and was not acting as a reasonably prudent driver. In other words, the suit places responsibility claims against both the driver and the vehicle maker; it does not say that the technology alone was necessarily the cause.
These are claims made by the plaintiffs. The fact that a motorcycle was struck from behind, or that Autopilot was reportedly active, does not on its own prove a software defect or determine who was legally at fault. The available reporting does not provide the full complaint, the exact causes of action, requested damages, a case number, or a verified later court outcome.

Autopilot is driver assistance, not autonomous driving
Tesla’s Autopilot is a driver-assistance system that requires a human driver to supervise the vehicle and remain ready to intervene. Its name does not mean a driver can sleep, look away, or hand over legal responsibility. Tesla’s separately branded Full Self-Driving feature set is not interchangeable with ordinary Autopilot, and the Embry case was reported as involving a Model 3 with Autopilot engaged.

The branding has attracted criticism because “Autopilot” can sound more capable than a supervised assistance feature. But the relevant questions in this case are not answered by the label alone: what the car detected, how it responded, whether any warnings were issued, what the driver was doing, and whether conditions were within the system’s operating limits.

Why a federal investigation is not a verdict in this lawsuit
The National Highway Traffic Safety Administration opened a special investigation into a 2022 Utah crash involving a Tesla Model 3 and a motorcycle. Separately, NHTSA’s broader Autopilot investigation examined crash patterns, driver engagement, vehicle control, and whether warnings and controls were adequate for a system requiring constant supervision. The agency’s investigation and the Embry family’s civil suit are distinct proceedings; the cited NHTSA materials do not establish that a defect caused this particular collision or decide the family’s claims.
A civil case can involve overlapping allegations about a driver’s conduct and a product’s design or performance. Evidence that could matter includes vehicle and event data, system logs and warnings, crash reconstruction, and expert analysis. The evidence would need to show what happened in this specific crash, rather than simply whether Autopilot was switched on.

A separate Seattle-area crash is not the Embry case
Reporting on the 2024 lawsuit also noted a separate fatal motorcycle crash in the Seattle area in April 2024 involving a Tesla Model S. Police reportedly said that vehicle was operating in Full Self-Driving mode. That was a different crash, involving a different car and a different system label; it is context for wider scrutiny, not evidence about what occurred in Embry’s Utah collision.

The reporting confirms that Embry’s parents filed suit in 2024, but the available sources do not establish whether Tesla or the driver later answered, sought dismissal, settled, or went to trial. They also do not establish a judgment or finding of liability. It would therefore be inaccurate to say that a court has held Tesla responsible.
