Texas and federal regulators found that SpaceX’s Starbase launch deluge system discharged industrial wastewater without the individual permit required under the Clean Water Act and Texas law. That finding supports describing the releases as unauthorized discharges into or near regulated waters. It does not, by itself, prove lasting ecological damage, unsafe drinking water, or widespread toxic contamination.
What happened at Starbase?
SpaceX operates Starbase near Boca Chica in Cameron County, South Texas, beside wetlands and coastal waters. During Starship engine tests and launches, its deluge system releases very large volumes of water around the launch mount.
The water is intended to absorb heat, sound, vibration and exhaust effects. SpaceX added the system after the April 2023 Starship test damaged the launch area. But once the water contacts the launch mount, concrete, combustion residues, metals and other industrial materials, it is no longer necessarily equivalent to clean stormwater.

The regulatory question was therefore not simply whether SpaceX used water. It was whether water associated with an industrial launch operation was discharged from the facility into or adjacent to regulated waters without the correct authorization.

The FAA’s final environmental assessment describes the relevant releases as industrial wastewater discharges and summarizes the resulting state and federal enforcement actions.
What regulators documented
The Texas Commission on Environmental Quality received 14 complaints alleging environmental effects from the deluge system. A TCEQ compliance review identified four industrial-wastewater discharges between March and July 2024.
The review concluded that SpaceX’s existing general-permit arrangement did not authorize the deluge-water discharges. TCEQ and the U.S. Environmental Protection Agency determined that the releases required an individual Texas Pollutant Discharge Elimination System permit.

SpaceX submitted an individual TPDES permit application on July 1, 2024.
The findings involved the Clean Water Act, 30 Texas Administrative Code §305.42(a) and Texas Water Code §26.121(a)(1). In practical terms, regulators found that SpaceX released wastewater without the required individual authorization.
Was this a pollution finding or only a paperwork violation?
It was not merely a paperwork dispute. Regulators classified the deluge water as industrial wastewater and found unauthorized discharges governed by water-quality laws.

However, an unauthorized discharge and demonstrated severe ecological injury are different conclusions. A facility can violate wastewater-permitting requirements even when available measurements do not establish acute harm to fish, wetlands or people.

What pollutants were reported?
Records associated with the dispute referenced potential contaminants including:
- Mercury
- Total suspended solids
- Cyanide
- Copper
- Chromium
- Other industrial pollutants
Those references should not be read as proof that every substance exceeded a legal limit. The significance of a measurement depends on where the sample was taken, how it was collected, whether it was a single or composite sample, and which standard was used for comparison.
Drinking-water standards, aquatic-life criteria, wastewater-permit limits and screening values are not interchangeable. A reported comparison with one of those benchmarks does not automatically establish contamination of surrounding waters or a risk to human health.

Why mercury became controversial
Mercury received the most attention because media coverage described very large exceedances in material connected with TCEQ’s review. SpaceX disputed that interpretation.

According to the FAA’s written re-evaluation, SpaceX said its own sampling found mercury was generally undetectable or below relevant drinking-water or aquatic-toxicity limits. The company also challenged how some results were reported and interpreted.
The FAA later acknowledged conflicting information in the record and considered SpaceX’s sampling alongside agency responses. That means the mercury issue should be presented as a dispute over sampling, reporting and applicable criteria—not as an uncontested finding that Starbase caused dangerous mercury contamination.
The public summaries also do not resolve every technical question, such as whether each disputed value represented a discharge sample or receiving-water sample, whether it was a single result or part of repeated monitoring, and whether any table or transcription errors affected the reported comparisons.
What SpaceX said
SpaceX said it had worked with TCEQ and EPA while developing the deluge system. The company said it asked whether operations needed to stop and was told that operations could continue.
SpaceX also argued that the system’s water use was limited relative to local rainfall and said its own sampling did not support claims of dangerous contamination.
Those statements do not erase the agencies’ permitting finding. They do, however, explain why the case should not be reduced to a claim that SpaceX knowingly poisoned local waters. The documented dispute involved both the legality of the discharge and the interpretation of pollutant data.

What enforcement actions followed?
TCEQ Agreed Order
On August 13, 2024, SpaceX and TCEQ entered an Agreed Order addressing the alleged violations. The order required SpaceX to:

- Sample future discharges; and
- Operate under defined conditions while the permitting process continued.
The FAA’s executive summary records those requirements and explains that continued operations were allowed subject to the order and permit conditions.
EPA Consent Agreement
SpaceX separately entered an EPA Consent Agreement and Final Order, Docket No. CWA-06-2024-1768, addressing Clean Water Act violations.
The EPA action was separate from the TCEQ Agreed Order. The FAA’s later environmental material states that the EPA administrative order was closed after SpaceX met specified requirements. That closure should not be confused with a conclusion that the earlier unpermitted discharges were lawful.

Not permanently, based on the documented FAA record. EPA and TCEQ informed the FAA that Starbase could continue operating under the enforcement agreements, monitoring requirements and permit conditions.
The FAA did postpone environmental-assessment meetings concerning SpaceX’s request to increase Starbase launch activity while seeking additional information. The agency incorporated the water-quality developments into its environmental review.

That is different from revoking a launch authorization. The available FAA documents support a finding of additional review and compliance obligations—not an automatic or permanent cancellation of SpaceX’s launch license.
What the case does—and does not—establish
The available regulatory record establishes that:
- SpaceX’s Starbase deluge system produced wastewater associated with industrial launch operations.
- TCEQ identified four discharges during its March-to-July 2024 investigation period.
- State and federal regulators found the discharges were not authorized by the applicable general permit.
- SpaceX was required to seek an individual TPDES permit and monitor future releases.
- Operations continued under specified conditions rather than being automatically shut down.
It does not, from the FAA summaries alone, establish fish kills, human exposure, drinking-water contamination, long-term wetland damage, or permanent ecological injury. It also does not establish that every reported pollutant exceeded a legally relevant limit, or that the most serious mercury claims were scientifically uncontested.
The four identified discharges should not be interpreted as four total uses of the deluge system. They are the discharge events identified during the relevant compliance review, not necessarily a complete count of all system activations.
Why the distinction matters
Calling the episode “polluted waters” captures the seriousness of the regulatory finding but compresses several separate issues: an unauthorized discharge, industrial-wastewater classification, reported pollutant measurements, alleged exceedances and possible environmental effects.
The clearest conclusion is narrower and stronger: regulators found that SpaceX released industrial wastewater without the required permit, creating violations under federal and Texas water-quality law. The evidence summarized by the FAA does not justify upgrading that legal finding into a claim of proven, lasting ecosystem damage.
Nor does SpaceX’s claim that its samples showed little or no dangerous contamination establish that the releases were harmless. Compliance with discharge authorization and proof of ecological harm are separate questions, and both matter when industrial wastewater reaches a sensitive coastal environment.
