On October 28, 2002, Lumileds Lighting and Nichia Corporation announced a broad cross-licensing agreement covering their respective LED technologies. The companies said it would reduce the risk of patent disputes and related supply problems while helping them develop brighter, higher-power LEDs for applications including general lighting.
What the agreement did
A cross-license lets each company use intellectual property covered by the other company’s license, subject to the agreement’s terms. It is a way to gain access to complementary technology and reduce the risk that overlapping patent claims will obstruct product development or sales.
The announcement described a broad license covering the companies’ respective LED technologies. It did not publish a list of patents or define the precise technical boundaries. A cross-license does not, by itself, transfer patent ownership or mean that every patent, product, process, or future invention is included.
Nor was this announcement an acquisition, merger, supply contract, or expressly identified settlement of active litigation. Nichia’s release said the agreement was intended to avert patent disputes; it did not say that a particular lawsuit had been resolved.

Why it mattered to the LED business
In 2002, high-brightness LEDs were advancing rapidly, and valuable intellectual property was central to the competition. Patent conflict could impose legal costs and uncertainty not only on the manufacturers, but also on customers concerned about product availability. The companies said their agreement could help avoid disputes and potential supply issues associated with them.
They also expected each company to be able to incorporate the other’s research and development into new products. That could give engineers more room to pursue improved LED performance without first resolving every potential conflict through litigation. These were the companies’ stated goals, not evidence that the agreement guaranteed uninterrupted supply or produced a particular product outcome.

Two different technology profiles
The 2002 announcement presented the companies as bringing complementary experience. Lumileds was described as a high-power LED manufacturer with products for general and automotive lighting, traffic signals, signage, and LCD backlighting. Its Luxeon family was a prominent example; the release said the Luxeon V produced 120 lumens of white light from one emitter. That figure is a contemporaneous company claim, not a current product specification.
Nichia was identified with high-brightness indium gallium nitride (InGaN) LEDs, including blue LEDs, and with a white-LED approach using a blue InGaN die and yellow YAG phosphor. These are historical descriptions from the announcement, not claims about either company’s present-day ranking or product lineup.

At the time, Lumileds was described as a joint venture of Agilent Technologies and Philips Lighting, with its headquarters in San Jose and operations in the Netherlands and Malaysia. Nichia was headquartered in Anan, Tokushima, Japan. Those details describe the companies as presented in 2002 and should not be read as current corporate information.
Ambitions for brighter LEDs and general lighting
The companies said access to one another’s research and intellectual property could speed development of higher-power, brighter, and more cost-efficient LEDs. Their hoped-for destination was broader use in general lighting, beyond applications such as cellphone LCD backlighting, outdoor video displays, color scanners, traffic signals, and automotive lighting.

The announcement also raised the possibility of discussions about industry standards for high-power LEDs. That was an opening for dialogue, not a report that this agreement created or adopted a formal standard. Similarly, the stated goal of encouraging wider adoption was a forward-looking expectation, not a measured result attributed to the pact.

The available announcement does not disclose the royalty structure, duration, geographic scope, exclusivity, patent schedule, sublicensing rights for customers, or enforcement and termination terms. It therefore does not support calling the deal royalty-free, saying that all patents were exchanged, or concluding that every downstream manufacturer received rights under it. The sources cited here also do not establish whether the 2002 agreement remains active, was amended, expired, or was superseded.

Part of a broader period of LED licensing
The Lumileds-Nichia announcement came amid other patent-related agreements in the LED sector. Nichia separately announced a cross-license with OSRAM in June 2002. In November, it announced an agreement with Cree that it explicitly described as both a patent cross-license and a settlement of litigation. That distinction matters: the Cree announcement’s settlement language should not be imported into the Lumileds-Nichia deal.
Nichia’s October 28, 2002 announcement is the primary source for the Lumileds agreement and the companies’ stated aims. Contemporary coverage also reported the agreement in EE Times.
