Short answer: Do not scrape Walmart.com unless Walmart has given you express prior written consent or you are using an approved Walmart developer/API route for the specific data and purpose. Walmart’s current Terms of Use prohibit robots, spiders, site-search or retrieval applications, and other manual or automatic devices from retrieving, indexing, scraping, data mining or otherwise gathering site materials without that consent. They also restrict systematic downloading, storage and commercial use. Start with authorization and an approved data source—not browser automation.
This guide explains how to plan a compliant Walmart data project, what the published agreements actually cover, how to document permission, and how to stop safely when access is denied. It is practical risk control, not a legal safe harbor; obtain qualified legal advice for consequential commercial collection.
What Walmart’s current terms say
Walmart.com’s Terms of Use were marked “last updated September 9, 2026.” Their prohibited-conduct language says you may not:

- “Use any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, ‘scrape,’ ‘data mine’ or otherwise gather any Materials … without Walmart’s express prior written consent.”
- Systematically download or store site materials.
- Use the site or materials in ways restricted by the agreement, including commercial use where the terms prohibit it.
Read the complete, current wording at Walmart.com’s Terms of Use before designing a project. A public product page, a low request rate, or a page that your browser can view is not stated there as an exemption.

Choose an authorized route before collecting anything
Route 1: written permission for a defined collection
Ask Walmart for express written consent that names your organization, domains or endpoints, data fields, collection method, frequency, geographic scope, permitted purpose, retention period, display or redistribution rights, security controls, and a contact for changes or revocation. Keep the signed approval and the version of the terms in your project records.
Route 2: an applicable Walmart API agreement
Walmart publishes separate developer agreements. Walmart I/O terms state that an unaccepted applicant may not use the API or link to Walmart.com through it unless approved. The Walmart Marketplace API License Agreement describes developer-application use and addresses redistribution or commercial exploitation, excessive or abusive request volume, and attempts to bypass technical limitations.
API documentation is therefore a terms-governed route, not blanket permission to copy consumer-facing pages. Confirm that your approval covers the exact dataset, fields, purpose, retention, display, redistribution and current technical limits. Approval for one Walmart program does not automatically authorize another.

A responsible workflow
- Define the minimum data need. Write down the business question, fields, Walmart properties, time period and refresh frequency. Exclude fields you do not need.
- Classify the data. Identify whether records could contain personal, sensitive, account, seller or location information. Plan to avoid collecting it unless the authorization expressly requires it.
- Check the current terms. Review the Walmart.com terms and the specific API or marketplace agreement. Save the access date, URL and version information.
- Request or confirm approval. Obtain written consent or an accepted developer/API arrangement before sending automated requests. Ask who may access the data, where it may be stored, how long it may be retained and whether it may be displayed or redistributed.
- Implement only the approved scope. Use the authentication method, endpoints, request limits, user agent and schedule specified by Walmart. Do not rotate identities, disguise traffic, defeat bot checks or bypass technical limits.
- Minimize collection and retention. Store only necessary fields, restrict internal access, set deletion dates and protect credentials. Hash or remove identifiers when they are not needed.
- Monitor denials and changes. Log status codes, approval scope, request counts and errors. Pause when a technical denial, notice, changed terms or revocation affects your scope.
- Stop and escalate. If Walmart asks you to stop, or you cannot verify that a request is authorized, stop collection and obtain clarification from Walmart and qualified counsel.
Robots.txt: useful signal, not permission
Google’s robots.txt documentation explains how Google fetches and parses a robots.txt file to decide which areas its crawlers may access. That file coordinates crawler behavior; it is not a license, contract amendment or general permission to collect Walmart data. Do not infer Walmart’s current path directives from Google’s documentation, and do not treat an allowed path as consent to scrape.
Why “public data” and a low rate do not settle the question
Walmart’s terms address the method and use of gathering materials, not only whether a page is visible without logging in. A slow script can still be an automated retrieval application. “Only a few pages,” caching, or a normal browser user agent does not create an exemption stated in the terms. Contract, copyright, privacy, consumer-protection and other rules may also apply to a particular use.
What Van Buren does—and does not—decide
In Van Buren v. United States, decided June 3, 2021, the U.S. Supreme Court interpreted the Computer Fraud and Abuse Act phrase “exceeds authorized access.” Justice Barrett’s opinion for the Court said: “An individual ‘exceeds authorized access’ when he accesses a computer with authorization but then obtains information located in particular areas of the computer—such as files, folders, or databases—that are off limits to him.” Read the opinion text.
That is a limited statutory interpretation. It is not permission to scrape Walmart, and it does not resolve Walmart’s contract terms, copyright, privacy, state-law or other claims. Whether a planned collection is lawful depends on its facts and jurisdiction.
Do-it-yourself capture for an authorized visual record
If Walmart has expressly authorized you to capture page images, use a normal browser session and the exact scope in the authorization. Keep the process auditable:
- Use a dedicated account or profile approved for the project; do not share credentials.
- Open only the approved URLs and confirm that the page is within scope.
- Wait for the page to finish loading without bypassing a CAPTCHA, bot check or access denial.
- Capture the minimum viewport or element needed. Avoid personal data and unrelated page areas.
- Record URL, timestamp, authorization reference, viewport, browser version and outcome.
- Encrypt the image, restrict access and delete it on the approved schedule.
Do not continue after a block, cease-and-desist message, terms change or other clear denial. A screenshot is still a copy of site material and remains subject to your authorization and applicable terms.

Troubleshooting without bypassing controls
HTTP 401 or 403
The credential may be missing, expired or outside its approved scope, or Walmart may be denying access. Verify authorization and endpoint permissions with Walmart. Do not rotate keys, spoof identity or retry indefinitely.
CAPTCHA or bot-check page
Stop. A challenge is an access control, not an invitation to automate around it. Ask Walmart for an approved API, allowlisted process or written instruction.
429 or repeated rate limiting
Pause requests, preserve the response and consult the agreed limit. Reduce scheduled volume only if Walmart approves the change; never distribute traffic across identities to evade limits.
Blank, partial or stale content
Record the URL, timestamp and response headers. Check whether the approved API provides the needed field. Do not collect hidden data or expand the scope silently.
Terms or API documentation changed
Freeze the job, save the prior approval and current terms, and obtain confirmation that your use remains authorized before resuming.

Budget for the approved source’s quotas, storage, retries and human review rather than assuming that public pages are free to collect. Keep an immutable audit trail containing authorization, terms URL and date, endpoint or URL, fields collected, request count, response outcome, retention deadline and deletion record. Separate transient failures from access denials, and make your scheduler fail closed when scope or credentials are uncertain.

When to get legal review
Obtain advice from counsel familiar with technology contracts and data protection when collection is commercial, involves personal or seller information, will be redistributed, spans jurisdictions, relies on a marketplace agreement dated June 2024, or continues after a dispute. The June 2024 Walmart Marketplace Terms PDF contains similar anti-scraping language but may be superseded; confirm its current status before relying on it.
