Google’s emergency request to pause major Play Store remedies in its antitrust fight with Epic Games failed. The U.S. Supreme Court denied Google’s partial-stay application on October 6, 2025, leaving the injunction in force. By 2026, the dispute had moved from emergency litigation to implementation and settlement: Google and Epic announced a settlement framework in March, while Google’s developer guidance said qualifying U.S. third-party Android app stores could begin onboarding for catalog access on July 15, 2026.

What Google asked the courts to stop

Google did not seek to suspend every part of the Epic Games injunction. Its September 2025 Supreme Court application requested a partial stay focused on the remedies that could open Play Store distribution to rival app stores, require catalog access, and limit how Google controls interactions between Play and competing stores. Google also challenged the timetable for making the technical changes.

Google said the injunction was unusually broad and difficult to implement while its appeal was pending. Its filing argued that rapidly redesigning Play systems could create security, privacy, moderation and cost problems. Google’s stay application is the primary source for those claims.

How the dispute began

Epic removed or bypassed Google Play billing for Fortnite and distributed the game through other channels. Google removed Fortnite from Play for violating its developer terms. Epic sued Google in 2020, alleging that Google monopolized Android app distribution and in-app billing. The case went to a jury trial in 2023, followed by a permanent injunction from District Judge James Donato in October 2024. What the injunction changed

The order addressed several different forms of Play Store control rather than one single “Play Store change.”

Catalog access

Under the court-supervised framework, qualifying rival stores must be able to obtain access to Google Play’s catalog on specified terms. Catalog access does not mean every app is automatically approved for redistribution, nor does it make Google responsible for a rival store’s security or customer support.

Rival-store distribution

Google may not use Play Store rules or contracts to block rival app stores from being distributed through Google Play on Android devices. The remedy does not guarantee prominent placement, user adoption or access to every application.

Billing and user steering

Developers receive greater freedom to use alternative billing systems and direct users to payment options outside Google Play. The change can reduce a developer’s Google commission bill, but it does not guarantee lower prices: payment processing, fraud prevention, tax, support and integration costs still apply.

Anti-exclusion contracts

The injunction restricts agreements designed to discourage or prevent competing app stores. It does not prohibit every commercial agreement involving Google, developers or device makers.

Security safeguards remain allowed

The injunction did not remove Google’s ability to protect users. The Ninth Circuit said Google could apply reasonable security and privacy measures and charge a reasonable, cost-based fee for certain services. The legal fight concerned the scope and cost of those safeguards, not whether Google could perform any security review.

Google’s security-risk argument

Google warned that rival stores could distribute malicious, deceptive, infringing or pirated software. It said Play could lose visibility into activity on third-party stores and related security signals, while users might encounter applications that had not gone through Google Play’s normal review processes. Google also argued that it could be forced to support software over which it had less control, on a compressed schedule that increased the chance of operational mistakes.

Google described the potential consequences as “enormous” security and safety risks and said its costs could rise while its ability to recover them was constrained. Its public explanation of the appeal is at Google’s policy blog. These were Google’s litigation arguments, not judicial findings that the injunction would expose Android users to malware.

Why Epic and the courts disagreed

Epic argued that Google was overstating the danger to preserve control over distribution. Android already permits installation outside Google Play, subject to user controls and device settings. Epic also pointed to the injunction’s allowance for reasonable technical requirements and security measures.

The Ninth Circuit concluded that Google had not shown an imminent, irreparable security injury supported by the trial record. Its opinion affirmed the judgment and injunction on July 31, 2025. The court’s analysis is available in the Ninth Circuit opinion and an accessible opinion text.

Epic’s Supreme Court opposition said Google’s own expert evidence and trial testimony undercut the claimed emergency. Epic’s filing argued that the court could preserve user protection without restoring Play’s broader exclusivity.

The Supreme Court’s stay denial is recorded at docket 25A354. The separate certiorari case is at docket 25-521. Denying an emergency stay did not, by itself, decide every issue in Google’s underlying appeal.

What changed after the failed stay

Google’s current developer documentation describes a dedicated program for eligible U.S. third-party Android app stores. Stores can begin onboarding for catalog access under Google’s technical and eligibility requirements. The same guidance describes the March 2026 settlement-related changes to commissions, billing and other Play policies. The official implementation page is Google Play’s developer support documentation.

The settlement process and the court-ordered framework are related but not identical. A settlement can alter commercial terms or propose a revised injunction; it does not erase the distribution and catalog obligations simply because Google’s emergency stay was denied. What it means for Android users

  • More alternative app stores may become available through or alongside Google Play in the United States.
  • Apps may offer more payment choices, although developers may keep any savings rather than reduce prices.
  • Users could face duplicate applications, different update histories, store-specific subscriptions and separate refund policies.
  • Less-established stores may carry counterfeit, cloned, outdated or poorly maintained apps. Google’s safeguards can reduce those risks but cannot make every store equally trustworthy.
  • The result is not automatic access to every rival store for every Android device; store eligibility, device configuration and regional rules matter.

What it means for developers

  • Developers may gain additional billing and distribution channels and more freedom to steer users to outside payment options.
  • Supporting several storefronts can add integration, fraud, tax, compliance, update and customer-support work.
  • Alternative billing does not guarantee higher net revenue because payment and operational costs vary.
  • Participation in a rival store may depend on that store’s eligibility, Google’s technical requirements, device certification and U.S. geographic scope.
  • The remedies described here are principally U.S. measures. They should not automatically be treated as the rule in Europe, India, Brazil, Australia, China or other Android markets.

What it means for rival app stores

Catalog access removes one barrier, but it does not create a ready-made competitor to Google Play. A rival store still needs enough users and applications to attract developers, plus its own systems for malware screening, developer verification, abuse response, privacy, copyright, payments and support. Access to metadata or inventory does not mean Google endorses the store, guarantees app completeness or gives it equal placement.

What remains unresolved

  • The ultimate outcome of Google’s separate Supreme Court petition in docket 25-521.
  • The final form, approval and enforcement of any modified injunction arising from the settlement.
  • The precise catalog, security, technical and cost conditions Google may apply to participating stores.
  • Whether developers and users adopt alternative stores and billing at meaningful scale.
  • How competing stores handle licensing, privacy, refunds, updates and app authenticity across different devices and regions.

The Bottom Line

Google argued that opening Play Store distribution would create unacceptable security and privacy risks, but the Ninth Circuit found the claimed emergency harm insufficient and the Supreme Court denied the partial stay on October 6, 2025. The 2026 implementation gives qualifying U.S. rival stores a path to catalog access while preserving reasonable security controls. It limits Google’s ability to use Play Store control to suppress competition, but it does not make every alternative store safe, popular or friction-free.
