Yes, police may be able to obtain Snapchat account records—and content that Snap still has—through valid legal process or a qualifying emergency request. That does not give officers automatic access to every private photo. Opened or expired Snaps are generally deleted from Snapchat’s servers, but a recipient’s saved copy, a device, or records preserved before deletion may still matter. Snapchat is ephemeral, not consequence-free.
What “police can see your private pics” really means
There are several different places a Snapchat photo might exist: on Snap’s servers, in a user’s Memories, on the sender’s or recipient’s phone, in a screenshot or recording, or in a backup or another app. A photo disappearing from one place does not prove that every copy is gone.
Snap says it responds to valid legal requests for records it possesses. Depending on what exists and what process applies, that can include account information, metadata, or content. The company does not describe law enforcement as having a general window into all private accounts. Its law-enforcement guidance sets out request and preservation procedures; its support explanation also notes that some records may be obtained through proper legal process.
The original story behind this topic was published on October 15, 2013. Its figures and product details—including a claim that Snapchat processed more than 350 million Snaps a day—are historical, not descriptions of today’s service. The enduring point is that content may be available while it remains with a company, and recipients can make copies that the company cannot delete. See the 2013 report for that historical account.

What Snapchat deletes—and what it may not
Snapchat’s deletion rules differ by content type. The company says opened or expired Snaps are, in most cases, automatically deleted and typically cannot be retrieved from its servers. Unopened one-to-one Snaps are designed to be automatically deleted after 31 days. Those are qualified descriptions, not a guarantee that every record disappears on a fixed schedule in every circumstance.
Records that remain available may be subject to a legal request or preservation request. A recipient may also have saved a copy by taking a screenshot, recording the screen, photographing it with another device, or using another saving method. Snapchat’s server-side deletion cannot erase those copies. A copy may also remain in Memories, on a device, in a cloud backup, or in another service.
Stories are not the same as one-to-one Snaps: they are shared with an audience for a limited display period, and availability can vary with the Story feature and account settings. An active Story may be available to Snap during its display window. Do not assume an old, fixed “24 hours” description applies to every current Story type.

Even if the image itself is no longer retained, metadata may remain. Snap’s data-use information says it keeps metadata such as the date and time of a Snap. Metadata is not the photo, but account and timing records can still be relevant to an investigation.
What legal process can Snap receive?
In the United States, Snap lists several kinds of law-enforcement requests. Which process is appropriate depends on the records sought and applicable law; it is inaccurate to say that every request requires the same kind of warrant—or that a police request alone grants access.

Snap says it will attempt to preserve available records associated with properly identified users and specified date ranges after a qualifying formal request. For U.S. requests, its guidance describes preservation for up to 90 days, with a possible additional 90-day extension following a formal request. Preservation matters because a request can arrive before a record’s ordinary deletion would otherwise occur. It does not mean every requested item exists, or that preserved records are automatically disclosed.

For requests from outside the United States, the process may differ. Snap describes mechanisms such as mutual legal assistance treaty requests and letters rogatory for many foreign authorities. The U.S. process should not be assumed to govern every country.

- Private from the public: A Snap sent to one person or a private Story is not a public post, but that does not make it inaccessible to its recipient or legally immune.
- Private from ad personalization: Snap says private content and communications with friends are not used to personalize ads or recommendations, subject to limited circumstances such as content flagged for a Community Guidelines violation or content a user asks Snap to review. This is Snap’s stated data policy.
- Private from the recipient: No. A recipient can preserve or reproduce what they receive, even if the app’s normal behavior is to make it disappear.
- Private from law enforcement: Not absolutely. Snap may disclose records it still has when required by applicable legal process or in a qualifying emergency.
Privacy settings control who can ordinarily see content; they do not erase copies, guarantee that a recipient will keep a confidence, or override a valid legal demand. The cited policies also do not establish that every Snapchat communication is end-to-end encrypted, so “private” should not be treated as a synonym for “unavailable to the provider.”
What My Eyes Only does—and does not do
My Eyes Only is a passcode-protected area within Memories for saved content. It is not a disappearing-message setting. Snapchat says users can use a four-digit passcode or an alphanumeric passphrase; eligible items include photo Snaps and video Snaps shorter than 10 seconds. Saved Snaps or Stories, as well as Camera Roll content, can be moved into the feature.

Snap says it cannot recover My Eyes Only content if the user forgets the passcode. That is an important access and recovery limit, not a guarantee that no other copy or route to the content exists. It does not prevent a user from sharing the passcode, someone from photographing the screen, a copy from existing outside Snapchat, or a separate legal process involving a device. - Was it still on Snapchat’s servers? An unopened Snap, an active Story, saved content, or other available account record may be different from an opened or expired Snap already deleted from the servers.
- Was available data preserved in time? A preservation request can matter if it reaches Snap before ordinary deletion of records that are still available.
- Was it saved to Memories or My Eyes Only? Saved content follows a different path from a temporary Snap sent to a recipient.
- Did someone make a separate copy? Check not just the Snapchat account but both users’ devices, backups, and any service to which the image was forwarded.
- Could metadata or account records remain? The media file may be unavailable while some associated records still exist.
- Which jurisdiction and circumstances apply? The process varies outside the United States, and emergency or child-safety reporting can involve channels other than an ordinary request for records.
This is a general explanation, not legal advice about a particular investigation. If you are involved in a case, consult a qualified lawyer rather than relying on an app’s deletion behavior.
Notice to users and safety reporting
Snap’s stated policy is generally to notify users when it receives legal process seeking their records. It also identifies exceptions, including when a court or other legal authority prohibits notice and exceptional circumstances such as child exploitation or an imminent risk of death or serious bodily injury. Notice is therefore not guaranteed in every case. Snap describes its policy in its law-enforcement guidance and transparency-reporting information.
Safety reporting is distinct from an ordinary police request. Snap says it uses technologies including PhotoDNA and Google’s CSAI Match to identify known child sexual abuse imagery and reports qualifying cases to the National Center for Missing & Exploited Children, which coordinates with law enforcement as required. This does not mean all private images are proactively reviewed. Snap’s H1 2024 transparency report describes this child-safety activity.
How to understand the request numbers
Snap publishes transparency reports twice a year. The latest report identified here covers July 1 through December 31, 2025, and was released or updated June 30, 2026. It reports government requests and other safety and enforcement activity, with regional and request-type categories. Consult the H2 2025 report for current figures. When comparing numbers, check the reporting period, geography, and whether a figure counts requests, accounts, or content items; those measures are not interchangeable. The dozen or so requests mentioned in the 2013 story are not a current rate.

- Assume a recipient can make a copy, whatever the app’s normal deletion behavior.
- Use a strong device passcode and protect your Snapchat account; securing one account does not control copies on another person’s phone.

- If an image concerns a crime or immediate danger, contact appropriate authorities. A disappearing-message feature is not an evidence-preservation or emergency-response system.
