The case is no longer simply an open investigation: CADE’s tribunal approved a negotiated cease-and-desist agreement on December 10, 2025, and the authority announced it on December 22. The investigation was suspended while Google fulfills the agreement’s obligations. This matter concerned Android distribution arrangements—not, on the available official account, Google Play developer commissions or billing rules.
What CADE investigated
CADE, Brazil’s Administrative Council for Economic Defense, examined agreements Google used with mobile-device manufacturers and operators. The regulator’s concern was that terms governing access to important Android services could give Google leverage over which search and browser apps appeared on devices and how prominently they were placed. CADE described the arrangements and its concerns in its announcement of the agreement.
The three agreement types
- Anti-Fragmentation Agreement (AFA/ACC): Android-related arrangements intended to address fragmentation across devices.
- Mobile Application Distribution Agreement (MADA): An agreement governing access to Google’s mobile-app package.
- Revenue Sharing Agreement (RSA): Commercial arrangements involving revenue sharing with manufacturers or operators.
CADE’s theory was that these agreements could make access to Google Play or other important Android services conditional on pre-installing Google Search or Chrome, giving those apps prominent placement, or accepting search-service exclusivity. Those were regulatory concerns addressed through commitments, not a final finding that Google violated competition law.
Why Google Play was part of the dispute
Android is an operating system; Google Play is a Google services and app-distribution layer used on many, but not all, Android devices. The case was not simply about whether Google operates an app marketplace. The question was whether manufacturers could face contractual or commercial pressure to favor Search and Chrome in order to obtain or retain access to Google Play and related services.

Pre-installation and default placement can influence what users discover and use even when competing apps can technically be downloaded. The relevant concern is therefore distribution, visibility, incentives, and switching friction—not merely whether alternatives exist. The official case summaries do not establish that this proceeding addressed Play Store commissions, developer billing requirements, app-review rules, or a general right to install alternative app stores.
What Google agreed to change
Under the negotiated TCC (Termo de Compromisso de Cessação), Google undertook to change the covered terms and practices. CADE’s Portuguese announcement approving the TCC records the tribunal’s December 10, 2025 approval; the authority’s English announcement describes the commitments and monitoring.

- Google must not condition Google Play licensing on pre-installing Search or Chrome, or on giving either app prominent placement.
- Google must not retaliate against manufacturers that do not adopt those applications.
- Relevant exclusivity clauses must be abandoned, and RSA payments must not be tied to exclusivity of search services.
- Google must inform its partners of the revised conditions.
- CADE’s Office of the Superintendent General oversees transparency and monitoring measures.
These are restrictions on the covered contractual conditions. They do not require manufacturers to pre-install rival apps or to display a universal choice screen.
What the agreement does—and does not—mean
The agreement removes specified contractual links between Google Play access and Search or Chrome placement or exclusivity. It does not amount to a ban on Google Play, a breakup of Android, or a finding that Google was guilty. CADE’s public announcements describe a negotiated commitment and suspension of the investigation pending fulfillment of the obligations, not a final penalty judgment or fine in this case.

For manufacturers, the commitments should give them more room to decline Search or Chrome placement without losing Google Play access or facing retaliation under the covered arrangements. The practical effect depends on how Google implements the revised terms and how manufacturers choose to configure their devices; CADE’s announcement does not establish a universal change in device offerings.
For consumers, any effect is indirect and may take time. Manufacturers could give competing search engines or browsers more visibility, but the agreement does not itself change existing phones, remove Google apps, or guarantee a new choice screen. A manufacturer may continue to favor Google apps for reasons including consumer demand or commercial and technical considerations.

For app developers, the public summaries do not establish a change to Play Store fees, payment rules, review policies, or app-store access. The case focused on Google’s dealings with device manufacturers and operators.

Mobile operating systems and app-distribution services can act as important routes to users. When a company controls a key layer of that distribution, regulators may examine whether arrangements at that layer reinforce the position of the company’s other products. CADE’s concern was that Android service access and commercial incentives could strengthen Search and Chrome at the device-distribution stage.

There is also a trade-off: integrated services and consistent technical requirements can support compatibility and a predictable user experience, while restrictive placement or exclusivity terms can make it harder for rival products to compete for visibility. CADE characterized its negotiated remedy as a way to preserve competition while retaining Android’s compatibility model; that is the regulator’s explanation of the agreement, not proof that every competitive concern has been resolved.
Keep the separate Google case distinct
In April 2026, CADE separately reopened a 2019 matter concerning Google’s use of news content in search and generative-AI features, according to Reuters reporting published by UOL. That is a different proceeding from the Android agreements resolved through the 2025 TCC. The existence of multiple Google matters makes it important to identify which conduct and case a headline or update refers to.
