Yes. Image-to-video and other AI systems can be used to place an identifiable person in a fabricated kissing or intimate-looking scene without that person’s permission. That does not mean every video app allows it, or that every AI-made kiss is sexual or illegal. The key distinction is whether a real person’s identity is used without consent—and how the result is presented or shared.
What “AI kissing videos” can mean
Several different kinds of video are often lumped together under this label:
- Fictional video: Invented characters kiss. No real person’s likeness is involved.
- Consensual likeness use: Someone knowingly authorizes a service to use their face or body in a generated scene. Permission should cover the scene and its intended audience, not be assumed from a relationship or friendship.
- Unauthorized likeness transformation: A real person’s photo or video is used to depict them kissing, embracing, or behaving in another fabricated way without permission.
- Nonconsensual intimate imagery: A legal or platform-policy category that may include AI-generated or altered material. Its definition varies by law and service.
- Impersonation or defamation: A fabricated scene is presented as real or used to imply a relationship, betrayal, or other compromising conduct.
A kiss need not involve nudity to cause harm. A fake can be used to humiliate, harass, intimidate, or damage someone’s reputation. But a fabricated kiss is not automatically “intimate imagery” under every law; the depiction, context, intent, distribution, and applicable statute matter.
How likeness abuse happens
At a high level, someone may take a photograph or video of an identifiable person—sometimes one already posted publicly—and use an image-to-video or face-manipulation system to place that person in a new scene. The resulting clip can then be sent privately, posted publicly, or used to harass or extort the person depicted. Copies may spread across services before the person finds the original.

A publicly viewable photograph is not permission to fabricate a romantic or sexual scene. Nor should this kind of identity-based abuse be confused with a fictional scene involving invented characters.
Why a fake kiss can slip past safeguards
“Two people kissing” may describe ordinary fictional romance. The same scene changes materially when one person is identifiable and did not agree to appear in it. A filter focused mainly on explicitness may miss deception, humiliation, stalking, or reputational harm.

- Consent can be hard to verify: A service may ask a user to attest to permission without independently confirming it.
- Public photos are easy to misuse: An image’s availability online does not show that its subject agreed to an AI transformation.
- Moderation varies: Results can differ by model, app version, account, region, and whether the input is text, image, or video. Anecdotal reports do not establish how a product behaves for every user.
- Watermarks are limited: A provenance mark may help identify AI-generated media, but cannot stop copying, screenshots, cropping, or reputational damage.
- Removal is incomplete: Taking down one post does not ensure that downloads, private shares, search results, or reposts disappear.
- Minors require urgent escalation: Sexualized or intimate-looking material involving a child is a serious child-safety matter, not merely an adult consent dispute.
What major services and platforms say
Provider policies and safeguards are not proof that abuse is impossible. They describe what a company says it prohibits or does to reduce risk; official complaints and investigations show why policy must be distinguished from enforcement.

xAI’s reporting guidance for non-consensual intimate content covers intimate imagery and sexual acts made or shared without an identifiable person’s consent, including generated or uploaded material. The company says this content is prohibited and provides a reporting route. Its Grok FAQ says generated media carries a watermark or provenance signal; that does not prevent redistribution or guarantee that a victim can get every copy removed.

On February 3, 2026, the U.K. Information Commissioner’s Office announced an investigation into X and xAI concerning personal-data processing and the potential to generate harmful sexualized imagery and video. An investigation is not a final finding of liability. A March 2026 letter from U.S. senators also raised concerns about “nudify” apps and sexual deepfakes made from social-media photographs, placing Grok within a broader commercial ecosystem rather than establishing that one service is the only source of the problem. Sora and Sora 2
OpenAI’s Sora system card identifies nonconsensual intimate imagery as a video-generation risk. OpenAI’s Sora 2 safety materials describe consent-based likeness controls and restrictions on real-person generation; these are stated safeguards, not a guarantee of perfect prevention. Availability needs a product-specific qualification: OpenAI said the earlier Sora product was no longer available as of April 26, 2026. That statement should not be read as saying that every later Sora 2 deployment is available everywhere—or that Sora 2 is simply the same product. App stores and other reporting routes
Google Play’s AI-generated content policy expressly addresses AI-generated nonconsensual deepfake sexual material. App stores, social networks, advertising systems, and websites also influence whether harmful content can be distributed or monetized; responsibility does not end with the model that generated a clip. Google also provides a process to report Google AI policy violations involving a person’s likeness.

What U.S. law does—and does not—cover
The TAKE IT DOWN Act became Public Law 119-12 on May 19, 2025. It addresses knowing publication or threatened publication of certain nonconsensual intimate visual depictions, including qualifying AI-created “digital forgeries.” Covered platforms must provide a notice-and-removal process for qualifying material. The law concerns publication, threats, covered services, qualifying depictions, and other statutory conditions; it does not make every private AI-generated romantic video or fabricated kiss a federal crime. The statutory text is available through GovInfo; the Congressional Research Service summary explains the law, and Congress.gov provides the bill text.
In May 2026, the Federal Trade Commission said platforms covered by the Act must offer an easy way to request removal of qualifying nonconsensual intimate images, including AI-generated material. This is a reporting route, not a guarantee of immediate deletion everywhere. A person may also need to contact the generator, the hosting platform, and search services. (See the FTC’s compliance guidance.) Laws outside the United States differ, and creation, possession, publication, threats, and commercial distribution can be treated differently.
What to do if someone made or shared a fake of you
- Do not engage with the creator. If the person is threatening or blackmailing you, preserve the threat and seek help rather than negotiating alone.
- Preserve essential evidence: record the post URL, account name, timestamps, messages, and platform report numbers; take screenshots where safe and lawful. Avoid repeatedly downloading or forwarding the material.
- Report the content where it appears. Use the platform’s categories for nonconsensual intimate imagery, impersonation, harassment, privacy, or synthetic media, whichever applies.
- Report it to the AI provider if you can identify the service. xAI has a dedicated NCII reporting process; Google explains how to report likeness-related violations involving its AI services.
- Use the formal removal process when applicable. In the United States, a covered platform’s TAKE IT DOWN process may apply to qualifying material; the FTC explains the obligation here.
- If a minor is involved, contact law enforcement or an appropriate child-protection reporting channel promptly. Do not circulate the material to prove what happened.
- Consider legal or specialist support if the video is tied to stalking, school or workplace harassment, extortion, threats, or financial demands.
Reporting one post may not remove copies, and a service may not reveal the creator’s identity. You do not need to prove the technical method used before reporting content that misuses your likeness. Do not rely on a watermark or visual inspection alone to establish authenticity; metadata can be stripped, and generated video may be difficult to identify by appearance.

How to assess an AI video service before using it
For a consumer, a useful evaluation is whether a provider explains and enforces consent, reporting, and distribution controls—not whether it merely advertises safety.
- Likeness consent: Does the service require specific permission for a real person’s face or body, and explain how that permission is enforced?
- Input rules: Can users upload photos or videos of identifiable people, and are those inputs screened?
- Policy clarity: Does the provider explicitly prohibit nonconsensual intimate or sexualized imagery, including manipulated media?
- Reporting quality: Is there a dedicated form, a way to track a report, and a clear escalation route?
- Removal and appeals: Are response processes and appeal options explained?
- Minor protection: Are rules and escalation procedures for material involving children explicit?
- Provenance and sharing: Are outputs marked, and can users publish them publicly by default?
- Transparency: Does the provider publish safety evaluations or enforcement information?
Fictional kissing scenes are not inherently abusive, and public figures’ faces are not free to use without limits. Parody, defamation, publicity rights, and privacy rules differ by jurisdiction. The practical dividing line is not simply whether a scene contains nudity: it is whether a real person’s identity and apparent conduct were manipulated without consent, and what is done with the result.
