The right compliance archive is the one configured to preserve the records your organization must keep, protect them under the applicable rule, and produce them in a usable form. A storage product’s “immutable” label or a vendor assessment does not, by itself, make an organization compliant. This guide focuses on U.S. financial-services examples—including SEC Rules 17a-4 and 18a-6, FINRA Rule 4511(c), and CFTC Regulation 1.31(c)-(d)—because those are the requirements addressed by the available sources. Retention duties vary by jurisdiction, sector, record type, and applicable rule; map your own obligations with qualified legal and records-management stakeholders before choosing settings.
What does a regulatory archive need to do?
An archive is more than a place to put old files. It must preserve the right records for the required period, protect them according to the applicable rule, and let authorized staff find, review, export, and produce them. Its controls need to work in daily operations, including when records are corrected, placed on legal hold, or requested by an examiner.
FINRA’s Rule 4511(c) summary addresses the need to download and transfer records and audit trails in human-readable and reasonably usable electronic formats, with enough information to locate the records. It also discusses a compliant backup electronic recordkeeping system or other redundancy capabilities with equivalent protection. These are practical selection criteria, not a substitute for identifying which obligations apply to your firm.
- Preservation: records remain intact and available for the applicable retention period.
- Traceability: the system can show relevant changes, deletions, access, and custody information.
- Discovery and production: staff can locate records and export them, with useful metadata and audit information.
- Operational resilience: records can be recovered and produced if a system, account, or location is unavailable.
- Governance: retention rules, legal holds, access rights, and deletion controls are assigned and monitored.
Do you need WORM storage, or can an audit trail work?
For the amended SEC electronic recordkeeping framework described by Microsoft and the SEC staff FAQ, the options include preserving records exclusively in a non-rewriteable, non-erasable (WORM) format or using a complete, time-stamped audit trail that permits reconstruction of an original record if it is altered or deleted. The amendments took effect January 3, 2023, as described by Microsoft. The applicable method depends on the entity, recordkeeping system, and requirements that govern it; WORM is not the only permitted approach in that framework.

When evaluating the audit-trail route
- Confirm that the trail records changes and deletions with timestamps and, where applicable, identifies the actor.
- Verify that the system can reconstruct the original record rather than merely show that an event occurred.
- Test whether the record and associated audit information can both be searched, exported, and produced together.
- Document how the controls are configured and who reviews exceptions or gaps.
When evaluating WORM
- Confirm the selected mode and configuration actually prevent rewriting and erasure for the required period.
- Test how retention periods, legal holds, and authorized disposition interact. Do not assume a lock setting alone implements your complete retention policy.
- Establish how the organization will locate, retrieve, and export locked records without modifying them.
Do not select a preservation model based only on a product name or a general claim that a service supports immutability. Validate the specific configuration against the applicable rule and your records-management procedures.
How to choose an archive that meets SEC or FINRA recordkeeping needs
Start with the records and obligations, then evaluate the system. Avoid choosing a platform first and trying to make its default settings stand in for a retention schedule.

- Inventory record classes. List the records the organization must create and retain, including business-related communications where applicable. FINRA’s report highlights communications connected to business as records firms may need to preserve and supervise.
- Map each class to its rule. Record the governing requirement, retention start event, duration, holds, and deletion constraints for each class. Do not apply a single retention period to all records based on one rule or industry example.
- Choose a preservation model for each applicable system. Determine whether the obligation can be met through WORM preservation, an audit-trail approach, or another specifically permitted control. Identify the systems and records actually in scope.
- Run a discovery and production exercise. Search for sample records, check metadata and rendering, export the records and audit trails, and confirm the result is human-readable and machine-usable where needed. Measure retrieval against your own operational deadlines rather than assuming search equals production readiness.
- Review resilience and access. Assess redundancy, recovery, encryption, access controls, logging, and how continuity is maintained. Define roles for retention administration, hold placement, review, and export.
- Test legal holds and disposition. Confirm how a hold suspends ordinary deletion, how overlapping policies are resolved, how hold release is authorized, and how eligible records are eventually disposed of.
- Plan for exit and migration. Determine whether records, metadata, and audit trails can be exported in usable formats, and how custody and completeness will be preserved if you change providers or systems.
- Validate third-party assessment scope. Read its date, covered rule paragraphs, workloads, service tiers, and configuration assumptions. Retain evidence of your own settings, reviews, and operating procedures.

The sources describe two broad patterns. They solve different operational problems and should not be treated as interchangeable turnkey compliance products.

Microsoft points to Cohasset assessments for selected services. Its regulatory-resource page reports that the cited Microsoft 365 Cohasset assessment version was released in July 2022, and the page was updated September 26, 2025. Treat those dates as assessment and page context, not proof that a specific deployment is compliant today. Check the relevant assessment’s scope and the current service documentation when making a purchasing or configuration decision.
AWS immutable storage services
AWS identifies S3 Object Lock, S3 Glacier Vault Lock, FSx for NetApp ONTAP with SnapLock, and AWS Backup Vault Lock as services that can support WORM retention. AWS also acknowledges the audit-trail alternative and places responsibility on the customer to align deployment and business processes with its obligations. Evaluate ingestion, indexing, retrieval, holds, redundancy, and export alongside the immutability control.

How to decide between them
Begin with where records originate and how they must be supervised. An in-place approach may suit records managed within covered productivity workloads when its retention and discovery functions match the use case. Storage-based immutability may suit records that need a controlled archive layer, provided the organization also handles capture, indexing, metadata, search, and production. Some environments may need both patterns. Compare the complete workflow—including corrections and legal holds—not just the storage control.
Common implementation failures and how to prevent them
- Assuming a product assessment guarantees compliance: assessments cover a defined scope and configuration. Check the workloads, service tier, rule paragraphs, date, and assumptions, then validate your own deployment and processes.
- Capturing only the file, not its context: a record without useful metadata, source information, or an associated audit trail may be difficult to locate or produce. Test complete exports before rollout.
- Applying one retention rule to everything: different record classes can have different triggers, periods, holds, and deletion constraints. Maintain a mapped schedule rather than a universal setting.
- Confusing backup with an archive: the FINRA summary discusses redundancy, but recovery copies alone do not establish that records are retained, searchable, and producible under the relevant rules. Test both preservation and recovery.
- Locking data without a retrieval plan: an immutable record that cannot be found and exported in usable form creates a production problem. Test retrieval and transfer procedures while designing the archive.
- Leaving controls ownerless: assign responsibility for policy changes, hold administration, access review, exception handling, and evidence retention. Review these responsibilities when systems or business processes change.
Using website screenshots as supporting evidence—not as an archive
A screenshot can document what a public webpage looked like at a particular capture moment, which may be useful as supplementary evidence in a workflow. It is not, by itself, a regulated recordkeeping system: it does not establish your retention schedule, legal holds, complete audit trail, source-system capture, redundancy, or production procedures. If web content is a record your organization must preserve, define how the capture is authenticated, indexed, retained, and associated with required metadata under your own policies.
